House Incumbent Primaries, Part II: Democrats

Feb. 21, 2022 — Part II of our incumbents’ primary challenges report concentrates on the Democratic members who find themselves in serious nomination contests. (Note: Part I — the Republicans — was published Friday. Please scroll down to read.) Nine such situations are covered in this update, with one of them, the Texas race of veteran Rep. Henry Cuellar (D-Laredo) to be decided on March 1.


GA-7: Dem Pairing

Republicans held the redistricting pen in Georgia and after losing two Atlanta metropolitan districts in consecutive elections, it was clear the GOP map drawers were going to take one back. That translated into loading Democrats from the previously Republican 6th District into the transitioning 7th CD.

Along with bringing more Democrats into the 7th, the 6th District incumbent, Rep. McBath, decided to join them. Instead of fighting for re-election in a new Republican 6th District (R+24), she moved south to challenge freshman Democrat Carolyn Bourdeaux in the party primary. As you can see from the cash-on-hand totals above, both incumbents are well-heeled financially, so a major campaign is underway.

Also in the Democratic field is state Rep. Donna McLeod (D-Lawrenceville), who points out that she is the only one of the three that actually lives in the 7th CD. Her campaign has been slow to begin, so it is doubtful that she will be much of a factor, and probably will not draw enough support to force the two congressional incumbents into a runoff. Therefore, it is likely that this pairing will be settled in the May 24 primary.

Among carryover constituents Rep. Bourdeaux has a big advantage in seeing a majority of her current 7th District constituency (57 percent) remaining in the new 7th. McBath, however, sees only 12.1 percent carryover from her 6th District. The larger Democratic influx came from Rep. Hank Johnson’s 4th CD, as 26 percent of his constituency was transferred to the new 7th.

On the other hand, the new 7th is overwhelmingly minority: 29.8 percent black, 21.3 percent Hispanic, and 15.8 percent Asian. Thus, the demographics could help Rep. McBath, who is African American. Her strength within the party’s leftward faction is also a benefit in a primary contest. With each incumbent showing similar strength levels, this will be an interesting race to watch on May 24.


GA-13: Rep. David Scott

After only scoring 52.9 percent in the 2020 Democratic primary against three opponents, Rep. David Scott’s (D-Atlanta) 2022 race may be even more serious. Opposing him in this election are two candidates with an election track record, former state senator and 2017 Atlanta mayoral candidate Vincent Fort, and South Fulton City Councilman Mark Baker. The latter man bills himself as the “strongest progressive” in the race, but ex-Sen. Fort was well entrenched with the Bernie Sanders campaign.

Therefore, both opponents are attacking Rep. Scott from the left, which should help him split the opposition vote. Whether such a split will be enough to again allow him to capture majority support in the May 24 primary may be another question. Rep. Scott has long been attacked over not being further to the left on the ideological spectrum, which could again be a problem for him in a district that is overwhelmingly Democratic. Neither Baker nor Fort filed an FEC report at the end of the 2021, meaning they are behind on fundraising.

Rep. Scott must still be rated as the favorite to prevail, but this is another contest that will merit attention on May 24.


IL-6: Dem Pairing

The Illinois race is the second of the three Democratic congressional pairings, and it features sophomore Rep. Casten and freshman Rep. Newman. This particular pairing came about because of complaints that a second Hispanic seat should be drawn in Chicago.

Fearing a loss in court, the Democratic legislative leadership acquiesced and drew a new open 3rd District that is 44 percent Hispanic. As a result, Rep. Newman’s home was placed in Rep. Chuy Garcia’s (D-Chicago) 4th District, but she pivoted to run in the 6th against Rep. Casten. Her move made sense because 43 percent of her constituency was drawn into the new 6th District versus just 24 percent coming from Rep. Casten’s current 6th District.

While Casten has a financial advantage and the support of most of the Chicago Democratic establishment, Rep. Newman is a darling of the far left and will likely attract the more ideological voter that tends to dominate primary voting in both parties.

The aspect of this race that attracts little attention is that the pairing winner is not necessarily home free in the general election. With the Illinois gerrymander drawing 14 Democratic seats of 17 total districts, some of the Dem seats are weak. The 6th, with a D+6 rating from the FiveThirtyEight data entity, is one of those. Therefore, a divisive primary could make the eventual Republican nominee even more viable in the general election.

This draw was not favorable to either Democratic incumbent, and we will see a spirited fight between now and the June 28 primary.

Census by District

Aug. 17, 2021 — We can now see exactly where each congressional district in the country stands in terms of population. The Census Bureau delivered the state redistricting data last week, and the Daily Kos Elections site data team segmented the numbers into individual congressional districts.

Below is a chart of the 38 states that have more than two districts, isolating the CDs that are the most over and under populated. The “High” column depicts the district that is the most over-populated in the state, while the “Low” is the one requiring the most new residents. The “+/-” column shows how many districts in the particular state are over and under populated.

The most robust district is that of Texas freshman Rep. Troy Nehls (R-Richmond). His southwest Houston seat houses just under one million people, at an exact count of 972,309. The least populated seat is West Virginia’s 3rd District (Rep. Carol Miller-R): 326,267 people under quota. With all of the Mountain State seats seriously down, it is clear as to why West Virginia lost a seat in reapportionment.

There are only two states, Colorado and Oregon, where all of the current districts are over-populated. Both entities gain one seat in reapportionment. On the other end of the spectrum, Michigan and Pennsylvania saw all districts falling below their new population quota, and in Illinois, 17 of their current 18 do as well. All three states are losing a district.

It is not surprising that California lost a seat for the first time in history. A total of 35 of their current 53 seats require more population versus 18 that must shed residents. New York barely lost a seat, by just 89 people statewide, which is surprising when seeing 23 of their current 27 districts requiring additional population.

The states are now converting their new data into their redistricting software systems. After that, most will hold hearings for public input prior to district construction beginning.

Early House Outlook – Part III

Jan. 22, 2021 — Continuing with our electoral preview for the US House, today we look at 13 states in the country’s northeastern region. Monday, we conclude in the south.


• Connecticut – 5 Seats (5D)

With all of the Nutmeg State’s five congressional districts venturing past the 700,000 resident mark, each of Connecticut’s CDs appear secure after the state lost a seat in 2010 reapportionment. With Democrats holding the redistricting pen, expect only perfunctory changes in the congressional delegation map with each incumbent being awarded a safe seat. All were re-elected in 2021 within a vote percentage range between 56 and 65.


• Illinois – 18 Seats (13D5R)

Democrats have a big advantage in the Illinois delegation and, with the party leaders in control of the redistricting pen, their edge is positioned to expand. Despite the Republicans holding less than half of the number of Democratic seats comprising the delegation, it is one of the Dem’s members who is likely to be paired with another incumbent.

The state has actually lost population (approximately 250,000 residents) when compared with the 2010 census, meaning Illinois will certainly lose one CD with the outside possibility of dropping two. Since the major population loss is coming from the downstate area, the Democrat map drawers will have little trouble taking the seat from the Republicans and can justify such a draw based upon the region losing so many people. This, even though Rep. Cheri Bustos’ (D-Moline) seat has the lowest population figure in the state.

The Chicago area gives the Democrats some redistricting challenges, however. Three of their metro incumbents, Reps. Marie Newman (D-La Grange), Sean Casten (D-Downers Grove), and Lauren Underwood (D-Naperville) scored re-election percentages of 56.4, 52.8, and 50.7 respectively, meaning all three will be lobbying to add more Democrats to their districts. Their lower win percentages are a clue that the metro districts are already stretched to the maximum from a Democratic perspective, so it’s possible such an over-reach could have backfire potential.


• Indiana – 9 Seats (2D7R)

The nine Hoosier State seats also appear secure from a population standpoint, so Indiana looks to be a sure bet to retain all of its nine congressional districts. One seat to watch from a competitive perspective is that of freshman Rep. Victoria Spartz (R-Noblesville), who won an Indianapolis suburban CD in a tight 50-46 percent margin. Democrats will target her in 2022. All of the veteran incumbents seeking re-election broke the 61 percent mark. Freshman Democrat Frank Mrvan (D-Highland/Gary) succeeded retiring Rep. Peter Visclosky (D) with a 57-40 percent victory margin.


• Maine – 2 Seats (2D)

The Pine Tree State again holds two districts with smaller base population figures for the coming decade, one from the north and the other south. Democrats hold both and will control the redistricting pen but with only approximately 30,000 people needing to move from the southern 1st District (Rep. Chellie Pingree-D) to the northern 2nd (Rep. Jared Golden-D), the map will only change marginally. The 2nd CD is the more competitive seat of the two and will again be contested but the state’s Ranked Choice Voting system tends to give the Democrats an added advantage.


• Massachusetts – 9 Seats (9D)

The Bay State, home to one of the Democrats’ most loyal constituencies in the entire country, will retain its nine districts after dropping a seat in the 2010 reapportionment. All nine Democratic incumbents are safe and will continue to be so. The victory percentage range fell between 58-74 percent for the nine current Democratic incumbents, all but one of whom was running for re-election.


• Michigan – 14 Seats (7D7R)

Michigan redistricting will be different in 2021 with the introduction of a voter-passed redistricting commission. The citizen members will be tasked with reducing the 14-member delegation to 13, and Republicans will likely find themselves on the short end. Rep. John Moolenaar’s (R-Midland) 4th CD looks to be the most vulnerable. The districts in the northern part of the state all must gain population, and with Rep. Moolenaar’s seat being surrounded by the rest, his is the most likely to be split in pieces order to feed the others.

Reps. Elissa Slotkin (D-Holly/Lansing) and Haley Stevens (D-Rochester Hills), with respective 2020 win percentages of 50.9 and 50.2, will be in need of more Democrats that may not be forthcoming. Therefore, we could see a more competitive Michigan congressional delegation at least in the early part of the new decade.

The Decisions Within the Election

Oct. 30, 2020 — The 2020 election cycle has been unique in many ways, but a series of significant decisions, typically through judicial rulings, will likely have a long-lasting effect upon the way the various states administer their elections.

Expanded early voting is likely here to stay. With more than 66 million people already voting through Wednesday, we can expect the states to continue with this relatively new process. Currently, only four states do not have some form of early voting.

Whether we see a continuance of the post-election ballot reception period may be another matter. There is likely to be controversy over this practice that 21 states will feature beginning next week. If the presidential race is close and gets bogged down in the political overtime, the negative aspects of counting votes that come in after the election could come to the forefront.

We have also seen changes in some states, most of which came in previous years, over their primary voting procedures. With reapportionment and redistricting on the political horizon, we are seeing states place measures on Tuesday’s ballot that could bring even more change to electoral systems around the country.

According to research presented from the University of Virginia’s Dr. Larry Sabato’s Crystal Ball publication and the Ballotpedia organization, voters in nine states will be deciding measures that could alter even further the way future elections are conducted. As we have seen develop, states adopting changes lead to further states following suit. Therefore, if many of the measures receive voter approval Tuesday, other states may also begin adopting some of these practices.

We start with states potentially changing their primary systems to a variation of the jungle primary system. Currently, Louisiana, where the procedure began, California, and Washington use the top-two qualifying system. In those states, all candidates are placed on the same primary ballot and the top two vote-getters advance to the general election irrespective of political party affiliation. Louisiana can elect a candidate outright if he or she receives majority support in the primary election because the state schedules the primary concurrently with the national general election.

Voters in Florida have a ballot proposition to decide if they want their state to adopt the jungle primary system. The Sunshine State voters are also considering a proposition that would allow changes voted through initiative only to take effect if the measure passes in two general elections. Therefore, should this latter idea attain approval, it, and all of the other passed measures, would be delayed until they again pass in a subsequent election.

Alaska voters are looking at another variation of the jungle primary. They are considering a measure where the primary would produce four finishers, thus setting up multi-candidate general elections.

Pennsylvania Voting Rules

Sept. 21, 2020 — Pennsylvania’s Democratic controlled Supreme Court changed their state election procedures late last week in a series of rulings on a lawsuit that the Pennsylvania Secretary of State and PA Democratic Party previously filed.

Under the new process, receiving votes after the election is allowed if “no evidence exists” that the ballot was mailed after Election Day, Nov. 3. The deadline for ballot acceptance now moves from 8 pm on Election Day to 5 pm, Friday, Nov. 6. Pennsylvania becomes the 17th state to allow post-election reception for this 2020 election. The ruling increases the chances that we will not have a winner declared on election night.

Additionally, three other rulings will allow drop boxes to be used as ballot receptacles in the various counties, affirmed that poll watchers can only serve in their own county of residence, and Green Party candidate Howie Hawkins’ name was removed from the ballot. The court did not grant the lawsuit motion to allow ballot harvesting, which would permit third parties to deliver ballots to the authorities or ballot drop boxes.

The drop boxes will be placed in various locations around a county and voters can deposit their ballots without using the postal service to transfer their vote to the county election authorities. Hawkins’ name was removed from the ballot because the court said he “failed to comply with the Election Code’s strict mandate” and the attempts to fix the problem “did not suffice to cure that error,” but the specifics were not addressed.

With the large number of absentee ballots expected here and in other states, the trend toward allowing post-election reception, and the laws that some states, like Pennsylvania, have to control when the mail ballots can be counted, makes it less likely that we will see a definitive presidential campaign result on Nov. 3. The same will be true for certain US Senate and House races.

Of the 17 states, now including Pennsylvania, that are allowing post-election ballot reception, seven appear competitive. The others, Alaska, California, Kansas, Massachusetts, Mississippi, New Jersey, Utah, Virginia, Washington, and West Virginia will likely declare a clear winner relatively early in the counting period.

How Sen. Markey Won in the
Massachusetts Primary

Sept. 3, 2020 — Sen. Ed Markey’s win over Rep. Joe Kennedy III (D-Newton) is attracting a great deal of media attention in the aftermath of Tuesday’s 55-45 percent Democratic primary election, and it should. In many ways, this was an extraordinary campaign.

Sen. Markey should be credited with running an excellent political effort in that he maximized his advantages and minimized his weaknesses. It also featured bizarre happenings in that the 74-year-old candidate received 71 percent of the 18- to 29-year-old vote against his 39-year-old opponent, and he re-created, virtually word for word, an ad his campaign produced for his first congressional race back in 1976 highlighting an issue that defined his career in the state legislature.

Conversely, Kennedy ran a failing campaign that never got untracked and proved strategically wrong from the outset.

Let’s go back to where this race began in order to set the stage. Kennedy announced his candidacy in October. Polling had already begun in late August, and Change Research released the first public poll of a proposed Markey-Kennedy race (Aug. 23-25, 2019; 80 registered Massachusetts voters) and found Rep. Kennedy leading Sen. Markey, 42-25 percent.

The last poll, conducted exactly a year later from Boston-based Emerson College (Aug. 25-27; 453 likely Massachusetts Democratic primary voters), found Sen. Markey ahead 56-44 percent. Thus, all of the campaign movement favored Markey, and Kennedy was unable to expand outward from his original support base.

What Markey Did Right

Sen. Markey can count. Understanding that his home county of Middlesex is the largest in the state by far — some 1.58 million people — he returned to his boyhood home in Malden where he based his campaign. His re-created 1976 ad from the first congressional campaign about “Ed Markey’s Desk” was done to emphasize his home roots in the Malden-Melrose area and the surrounding Boston suburbs that comprise the heart of Middlesex County.

Markey, Neal Win Big in Massachusetts

Sen. Ed Markey recorded a strong double-digit victory over Rep. Joe Kennedy III (D-Newton) yesterday in Massachusetts.

Sept. 2, 2020 — The Massachusetts primary election was held yesterday, and Sen. Ed Markey recorded a strong double-digit victory over Rep. Joe Kennedy III (D-Newton) after a year-long campaign in the US Senate Democratic race, which, in the Bay State, is tantamount to winning the seat in November.

Sen. Markey’s victory spread landed at exactly 10 percentage points with an estimated 20 percent of the vote still outstanding, 55.5 – 45.5 percent, and the 131,651-vote margin left no doubt about the outcome. Turnout is just under 1.2 million Democratic voters and will go higher when late-arriving ballots are collected and counted. The total turnout could reach 1.5 million individuals, which would be higher than the March 3 Democratic presidential primary participation figure that fell just under 1.4 million.

The county largely responsible for the senator’s victory margin was his home county of Middlesex; with a total population figure of over 1.5 million people, it’s the state’s largest local entity. There, Sen. Markey recorded a 65-35 percent margin and an 88,858-vote spread, which accounts for two-thirds of his statewide vote difference. Sen. Markey scored majorities in 10 of the state’s 14 counties.

The only place Rep. Kennedy recorded a county victory outside of his 4th Congressional District was in western Massachusetts. He carried Hampden County, which houses the city of Springfield, and, rather surprisingly, Worcester County despite the flap that found the Kennedy campaign sending a mailer into the locality with the name spelled, “Worchester.”

Temporarily, at the very least, Rep. Kennedy’s defeat spells the end of the Kennedy family political dynasty in the state. In fact, according to the MSNBC network, this is the first loss for a family candidate in 27 Democratic primary campaigns dating back to when John F. Kennedy won the 1946 congressional primary in what was then the Boston area’s 11th CD.

Massachusetts Primary Today

Sept. 1, 2020 — A major political dynasty will end this evening. Today is Primary Day in Massachusetts and the long-awaited Democratic intra-party battle between two icons of Bay State politics, Sen. Ed Markey and Rep. Joe Kennedy III (D-Newton) will be decided.

Sen. Markey was first elected to the state legislature in 1972 and has served in elective office consecutively ever since. He spent four years in the state House of Representatives, 36 years in the US House, and was elected in a special US Senate contest in 2013 to replace then-Sen. John Kerry (D) who had resigned to become US Secretary of State in the Obama Administration. Markey was re-elected to a full term in 2014.

Rep. Kennedy is the grandson of Robert F. Kennedy, and thereby related to President John F. Kennedy, and the late Sen. Ted Kennedy (D-MA). He is the latest member of the famed Kennedy political dynasty. Joe Kennedy III was elected to the House in 2012, replacing retiring Rep. Barney Frank (D-Newton) in the district that contains the cities of Newton and Brookline before moving south to annex Taunton and Fall River. Should he lose tonight, he will be the first Kennedy not to win a Massachusetts campaign.

The race appeared close from the outset, but Sen. Markey appears to be pulling away in both campaign funds ($11.8 million raised through the pre-primary filing period on Aug. 12 to $8.8 million) and polling. Both see significant expenditure organizations conducting independent operations to support their Senate bids.

Since the end of July, Sen. Markey has pulled away. He has led in seven consecutive polls by an average of 8.7 percentage points after trailing in the early stages of the race. The latest poll, from Emerson College (Aug. 25-27; 453 likely Massachusetts Democratic primary voters) gives Sen. Markey a 56-44 percent lead when all respondents were prodded to make a choice. Interestingly, the last poll to find Rep. Kennedy leading also came from Emerson College during the early part of May. Those results show just how much the race has changed. Emerson previously projected Rep. Kennedy to a 58-42 percent advantage.

The Senate race is not the only major campaign on the Massachusetts ballot, however. House Ways & Means Committee chairman Richard Neal (D-Springfield) is striving to avoid becoming the ninth US House incumbent to be denied re-nomination in 2020. He faces a spirited challenge from Holyoke Mayor Alex Morse, who is hitting Rep. Neal from his left and criticizing him for being part of the “status quo.” Like the other Democratic upset winners this year, he Justice Democrats PAC has endorsed Morse, but their spending here appears less than the other campaigns in which they became involved.

MA-1: Will Rep. Neal Become #9?

Aug. 25, 2020 — The intense Democratic Senate primary battle between incumbent Sen. Ed Markey and challenger, Rep. Joe Kennedy III (D-Newton), is not the only Massachusetts competitive intra-party campaign to be decided in the upcoming Sept. 1 nomination election.

House Ways & Means Committee chairman Rep. Richard Neal (D-Springfield) finds himself defending his seat against credible Democratic challenger Alex Morse, the mayor of Holyoke, a city of 40,000-plus people located just eight miles north of Springfield on I-391. Neal is clearly taking this primary seriously and fighting hard to avoid being the ninth House incumbent denied re-nomination in the 2020 election cycle.

Rep. Neal has already spent $4.3 million for his re-nomination campaign as reported in the Aug. 12 pre-primary Federal Election Commission campaign finance disclosure report. Conversely, Mayor Morse has spent just over $1 million, but the contest still appears close.

Now, an outside organization, Democratic Majority for Israel, has launched an attack television ad that hit Morse for a poor attendance record at Holyoke City Council meetings while claiming the local schools are among the lowest performing in Massachusetts. They cite, in support of their contention, the state government coming into the Holyoke district and assuming control of their education system.

Earlier, controversy arose when the College Democrats organization at the University of Massachusetts at Amherst, located within the 1st District, accused Morse of sexual impropriety, which resulted in an immediate loss of local and national support. The move backfired, however, when it came to light that no such incidents had occurred during the times when Morse appeared at the university both as a candidate and previously a guest lecturer.

This challenge appears typical of the other three Democratic primaries where candidates successfully opposed veteran incumbents from the political left armed with money and support from national activists and progressive organizations. The three such challenges that transformed into upsets came at the expense of Reps. Dan Lipinski (D-IL; 8 terms), Eliot Engel (D-NY; 16 terms), and Lacy Clay (D-MO; 10 terms). Whether the Morse effort proves as successful remains to be determined.

Sen. Markey Surges in Massachusetts

Aug. 13, 2020 — A new University of Massachusetts statewide Democratic primary survey posts Sen. Ed Markey (D) to a surprisingly large lead over four-term Rep. Joseph P. Kennedy III (D-Newton) in their impending US Senate battle. The poll has methodology flaws, however, as the high error factor suggests.

The UMass survey (July 31-Aug. 7; 50 registered Massachusetts voters, 199 likely Democratic primary voters, 163 Independents saying they will choose to vote in the Democratic primary) posts Sen. Markey to a 50-32 percent first question ballot test lead, and 51-36 percent margin when those who say they are leaning to one candidate or the other are added.

The self-stated error factor is 5.9 percent for all registered voters and a whopping 7.0 percent for those likely to cast a Democratic primary ballot. Asking the ballot test and individual candidate profile questions to only the likely voters limits the sampling universe to 362; hence, the high error factor because the segmentation is too low for a statewide campaign in a place with a population large enough to fill nine congressional districts.

Even when taking into account the high error rate the new Markey advantage is beyond doubt, and it appears the senator’s campaign may be peaking at the proper time considering the primary is Sept. 1 and early voting begins Aug. 22.

Recently, Sen. Markey has been on an aggressive upswing. He’s receiving outside support from strong environmental groups that are delivering a seven-figure independent expenditure; he earned an endorsement from the largest state teacher’s union; and Rep. Alexandria Ocasio-Cortez (D-New York) is narrating his closing ads. The moves forced another group of unions and the Kennedy Family to counter by announcing a $1.6 million independent expenditure effort on the Representative’s behalf.

The UMass questionnaire asked the entire sample if they would describe the two candidates with one word apiece, and the results suggest Rep. Kennedy has a more negative image than Sen. Markey. While not all the top one-word answers were favorable to the veteran office holder – “old” was one of the most often mentioned terms, for example – he received more positive descriptions than negative. The top responses were, “progressive, good, dedicated, liberal, smart, and experienced.” Negative terms about Markey included “useless, unknown, and unsure.”

For Rep. Kennedy, we see a different picture. The top three words describing him were, “entitled, young, and ambitious.” Other major descriptors were, “opportunist, privileged, arrogant, and fake.” On the positive side, Kennedy was characterized as, “good, smart, energetic, and honest.”
