Is Sen. Kamala Harris Protecting
Her California Senate Seat?

Dec. 5, 2019 — Sen. Kamala Harris (D-CA) became the first of what one might consider the top-tier candidates to end her presidential effort, but the announcement timing on Tuesday likely has more to do with her 2022 Senate race than the presidential contest.

The California candidate filing deadline is tomorrow, so Sen. Harris deciding to end her presidential effort means she won’t be on the Golden State presidential primary ballot, and thus avoids an embarrassing loss within her own constituency. Recent polling was forecasting her in the single-digit range even in California.

Obviously, losing any race in one’s home state reveals political weakness, and though she is virtually invulnerable against a Republican in the 2022 general election, the same might not be true if her opponent were a strong Democrat.

Under the California election system that features the jungle primary concept, variations of which are also seen in Washington state and Louisiana, members of the same party can advance into the general election. Florida voters will have the opportunity of adopting that jungle primary concept via ballot initiative next year.

Because California and Washington hold regular primaries before the general election, a pair of candidates always advance irrespective of percentages attained. Conversely, Louisiana holds one election concurrent with the general, meaning a candidate exceeding 50 percent is elected outright; otherwise the top two finishers advance into a December run-off election.

In the California 2022 Senate race, for example, two candidates will move into the general election from their March or June primary (California has continually alternated their primary election dates between the two months, depending upon the political situation at the time the legislature acted) so long as more than one candidate files. Thus, a strong Democrat — and California has many such individuals — could challenge Sen. Harris, draw a relatively meager percentage in the primary while finishing second, and then rally to make a serious general election challenge against her.

Other previous presidential candidates have often found the political going much tougher than expected when returning home to seek re-election after engaging in the national contest, and it remains to be seen if Sen. Harris will find her road to re-election any bumpier.

Projected Democrat Delegate Count

Aug. 12, 2019 — Several polls in key states have been released in early August, so it is a good time to again review the Democratic presidential delegate count estimate based upon the available data.

Projected delegate counts based on polling in nine key states of Democratic candidates jockeying for their party’s nomination for president in 2020.

We see new polls from Iowa, New Hampshire, California, Texas, North Carolina, Washington, and Pennsylvania. Adding the numbers from Nevada and South Carolina — important because this pair is part of the momentum setting First Four — we can gain a decent, though not wholly accurate, picture of where the race would stand if delegate apportionment were based upon these polling totals.

The most current surveys come from North Carolina, Iowa, and Pennsylvania all conducted between July 29 and Aug. 5.

In chronological order, based upon the latest studies, we begin with the Tar Heel State. Survey USA polled the North Carolina Democratic electorate (Aug. 1-5; 534 likely North Carolina Democratic primary voters) and find former Vice President Joe Biden leading his opponents by 21 points. He would post 36 percent as compared to Sens. Bernie Sanders (I-VT) and Elizabeth Warren (D-MA) scoring 15 and 13 percent, respectively. All others fall to single digits.

Accounting for some of the lower-tier candidates eventually dropping out before voting begins, it is likely that the three listed above would exceed the 15 percent threshold to qualify for delegates. If so, Biden would capture approximately 62 delegates, Sen. Sanders would earn 26, and Sen. Warren, 22.

Monmouth University conducted a new Iowa poll (Aug. 1-4; 401 likely Iowa Democratic caucus participants) and found much different results than when we last visited this electorate through the Change Research data in July. Those results projected the top five candidates qualifying for delegate apportionment, but Monmouth sees things quite differently.

According to their latest numbers, it is only Biden and Sen. Warren who would exceed the 15 percent threshold and qualify for delegates, polling at 28 and 19 percent respectively. Therefore, Iowa’s 41 first ballot delegates would split 24 for Biden and 17 for Warren.

Trump’s Ballot Politics

May 28, 2019 — Earlier this month, the California state Senate approved a bill that would require presidential candidates to release their tax returns in order to qualify for the Golden State ballot. A similar measure was vetoed by then-Gov. Jerry Brown (D) in 2017, but current Gov. Gavin Newsom (D) is expected to sign the measure.

A total of 17 other states also have similar pending legislation, with the strongest chances for enactment coming most probably in New York and Washington.

The move, of course, is targeted at President Trump who will not release his tax returns. But, would denying him ballot placement in states that he won’t carry actually hurt him?

A contrary argument exists to suggest that Trump and the down-ballot Republican candidates in those states might actually receive some tangential benefits from the president not being on the official ballot in places like California and New York, in particular.

First, if Trump didn’t appear on the California, New York, and Washington ballots, it would not change the Electoral College outcome because he won’t carry any of those states. He will likely concede them at the outset and spend no campaign money in any of those locations. Therefore, his ballot placement in these places could arguably be irrelevant.

Could The Democrats Be Headed
Towards a Convention Free-For-All?

April 11, 2019 — One of the most interesting facets of the Democratic presidential nomination process sounds mundane, but it may be more telling than any single campaign factor.

The primary/caucus schedule will in many ways determine if the party can coalesce behind one candidate before the Democratic delegates convene in Milwaukee during mid-July, or if they’ll be headed to a contested convention featuring several roll calls.

To win the nomination a candidate must either garner majority support on the first ballot (1,885 votes from a field of 3,768 elected delegates) or from among the full complement of 4,532 Democratic delegates on subsequent roll calls when the 764 Super Delegates are eligible to vote.

Joining the early mix, meaning the states that will vote on or before March 17, 2020, is Washington state, which has moved their nomination event. Additionally, over just this past weekend, the Washington Democrats passed a new party rule that transforms the previous delegate-apportioning caucus into a statewide primary. Previously, the state featured both apparatuses, with the caucus attenders selecting the delegates while the primary was no more than a political beauty contest.

The Early Targets

April 3, 2019 — Continuing our early outlook of the 2020 House situation, we can begin by narrowing the field to those districts where Republicans will be concentrating at least their initial efforts in order to reclaim the majority they lost in November.

After the 2016 election, there were 12 districts that supported President Trump but elected a Democrat to the House. After the 2018 midterm, that number rose to 31. For the Republicans to regain the majority, they will need to convert a net 18 seats back to their column, or 19 if the Democrats score a victory in the NC-9 special election to be held later this year in the Charlotte-Fayetteville metro areas in southern North Carolina.

The other two House special elections, PA-12 (May 21) and NC-3 (Sept. 10), unless huge upsets occur, look to remain within the Republican stable of districts.

Of the 31 Trump/House Democrat seats, 16 of them also voted for Mitt Romney over President Obama in 2012. Furthermore, a dozen within this group elected a Republican Representative until the 2018 election. They are:

  • GA-6 – Rep. Lucy McBath (D) – Defeated Karen Handel (R)
  • IL-14 – Rep. Lauren Underwood (D) – Defeated Randy Hultgren (R)
  • MI-8 – Rep. Elissa Slotkin (D) – Defeated Mike Bishop (R)
  • MI-11 – Rep. Haley Stevens (D) – Replaced David Trott (R)
  • NJ-11 – Rep. Mikie Sherrill (D) – Replaced Rodney Frelinghuysen
  • NM-2 – Rep. Xochitl Torres Small (D) – Replaced Steve Pearce (R)
  • NY-22 – Rep. Anthony Brindisi (D) – Defeated Claudia Tenney (R)
  • OK-5 – Rep. Kendra Horn (D) – Defeated Steve Russell (R)
  • SC-1 – Rep. Joe Cunningham (D) – Replaced Mark Sanford (R)
  • UT-4 – Rep. Ben McAdams (D) – Defeated Mia Love (R)
  • VA-2 – Rep. Elaine Luria (D) – Defeated Scott Taylor (R)
  • VA-7 – Rep. Abigail Spanberger (D) – Defeated Dave Brat (R)

Join Democratic Presidential Fray

March 6, 2019 — Former Colorado Gov. John Hickenlooper joined the Democratic presidential field over the weekend, following Washington Gov. Jay Inslee who jumped in last Friday. The pair became the 12th and 13th official Democratic presidential candidates, and the first governor and former governor to join the campaign.

But what are the paths to actual nomination for each man? Neither has high national name identification and both are from states moderate in size: Washington has 107 total Democratic National Convention delegates, and Colorado 80. This places them as the 14th and 17th largest states among the 57 voting entities that will comprise the Democratic delegate pool.

It’s hard to see a viable way to the nomination for Gov. Inslee. Without a strong geographical base or high name ID, the two-term Pacific Northwest governor is attempting to carve a niche for himself as the climate change candidate, but that is a space already heavily populated. Sen. Bernie Sanders in particular stresses the climate change issues as part of his portfolio, as do most of the other candidates at least to a degree.

It’s possible Inslee also doesn’t see much of a path for himself, which explains why he answered so vociferously that he is not ruling out running for a third term in his present position when asked during his announcement event. With almost two-thirds of the bound delegate votes likely being decided on or before March 17, 2020, Inslee will have plenty of time to pivot back into a governor’s race because the Washington candidate filing deadline doesn’t elapse until May of that year.

Reflecting on the 2018 Numbers

Jan. 24, 2019 — Now that all but one of the 470 House and Senate races from the election cycle just ended are final and recorded, it is time to better understand what the results portend.

As we know, the Democrats had a good election overall, and most particularly in the US House where they converted a net 40 seats — possibly 41 if NC-9 turns their way when the new election is finally scheduled — but Republicans did expand their majority in the Senate, thus largely disqualifying 2018 as an official wave election. Overall, there are 93 freshman House members and nine new senators when counting appointed Sen. Martha McSally (R-AZ).

Democrats came very near wave proportions, however – the Ballotpedia organization studied past wave elections and found that a swing of 48 House seats is necessary to constitute such a designation. While the effects from the 2018 election will certainly have long term reverberations, much more time is required to determine if the results are providing the foundation for transformational policy changes or are merely a blip that could just as quickly swing back to the Republicans.

What we do know is that women made significant gains in federal representation. In the Senate, the body now features a net three more female members (gaining Kyrsten Sinema and appointed Sen. McSally, both from Arizona, along with new Sens. Jacky Rosen (NV), and Marsha Blackburn (TN), but losing North Dakota’s Heidi Heitkamp), meaning that 25 women are now incumbent senators.
