Analyzing the 2020 Turnout Increase

March 29, 2021 — As we know, election year 2020 produced the largest voter participation level in history, including a substantial increase from the last presidential turnout in 2016. Now that all states have reported finalized election numbers, we know that a total of 158,507,137 individuals cast ballots in the 2020 presidential election, a number that shattered even the highest pre-election turnout predictions.

The figure also represents a 15.9 percent turnout increase when compared with 2016, which, at that time also set a record for raw number voter participation. Attempting to explain the large jump, the proponents of the election system overhaul legislative package in Congress, HR-1/S.1, credit the rise to the heightened use of early and mail voting, and therefore want to make permanent most of the court ordered COVID-19 pandemic response procedural changes. Digging deeper, however, we find that there are other factors present that help explain the voting uptick.

While all but five states (Alabama, Connecticut, Mississippi, Missouri, and New Hampshire) employed some form of early voting, another five conducted their elections only through the mail. The usual all-mail states of Colorado, Oregon, and Washington were joined by Hawaii and Utah according to the Ballotpedia election statistics organization that regularly publishes related data.

All five of these latter states saw turnout growth rates that exceeded the national average, including the state posting the highest increase, the Aloha State of Hawaii, which saw a whopping 32.5 percent rise in voting.

As stated earlier, the national average turnout increase when comparing the 2020 figures with 2016 is 15.9 percent. Eighteen states saw an increase greater than the national mean average, while 32 states and the District of Columbia fell below that number. All 51 entities, however, reported an upsurge in voting from 2016. The median average calculated to an increase of 12.8 percent.

Let’s concentrate on the 10 states with the highest increase from 2016. They are:

Early House Outlook – Part I

Jan. 20, 2021 — With the presidential Inauguration dominating political attention this week, it is a good time to set the upcoming electoral stage for the US House on a 50-state basis. Today, a first of a four-part series, will begin to look at the 13 western states. During the rest of the week, we will move eastward.


• Alaska – 1 Seat (1R)
Rep. Don Young (R-Ft. Yukon), the Dean of the House, won his 25th term in November with a 54-45 percent victory in a competitive race. With Alaska being an at-large state, reapportionment and redistricting won’t change the political situation. The big question surrounding the 87-year-old congressional veteran is when will he retire?


• Arizona – 9 Seats (5D4R)
The Arizona population growth rate makes them a cinch to gain a 10th District in reapportionment. It is also clear that the new seat will be placed in the Phoenix metropolitan area. Arizona has a redistricting commission comprised of two Democrats, two Republicans, and one Independent. The latter member becomes the chairman. The membership has not yet been chosen.

The state’s marginal nature suggests that we will see a very competitive state once all 10 seats are in place. Currently, there are two districts where the winning House member received 52 percent of the vote or less. This means GOP Rep. David Schweikert (2020 winning percentage: 52.2) and Democratic incumbent Tom O’Halleran (2020 winning percentage: 51.6) will be looking to add more Republicans and Democrats to their seats, respectively.

An open governor’s race (Republican Gov. Doug Ducey ineligible to seek a third term) and what should be a competitive re-election for Sen. Mark Kelly (D) could cause open seats in the House delegation should any of the sitting members attempt to run statewide.


• California – 53 Seats (42D11R)
For the first time in history, the Golden State appears positioned to lose a seat in their US House delegation. With migration exiting the state exceeding those incoming, it appears the California growth rate did not keep up with the specified threshold in order to keep all of their 53 seats. The Los Angeles area is likely to absorb the loss of the seat, but which member will be paired with another is an open question.

California voters adopted an initiative before the 2010 census that established a citizens’ commission to administer redistricting under strict parameters that emphasizes keeping cities and counties whole when possible and irrespective of where any particular incumbent may reside. Therefore, with the mapping power removed from the legislature, it is possible that inside Democratic politics might play a lesser role in the redistricting process.

Analyzing the Patterns

Dec. 2, 2020 — Now that election results are being certified around the country, we can begin to analyze the numbers in an attempt to detect what voting patterns developed throughout the electorate.

In looking at the presidential state-by-state totals from all 50 states and the District of Columbia, we can begin to see that President Trump fell below his previous vote marks not only in places like Arizona, Georgia, and the Great Lakes region, but in several other places, as well. This, despite seeing over 10.5 million more people voting for him in 2020 when comparing his totals from those recorded four years ago.

In a total of 18 states, Trump dropped below his 2016 performance rate, including eight places that he carried in both 2016 and 2020. In all eight, however, his drop-off rate was less than one-half percentage point.

Conversely, in 32 states, he exceeded his 2016 performance mark and surprisingly so in such left of center states as California (+2.7 percent), Hawaii (+4.9 percent), Nevada (+2.2 percent), New Mexico (+3.5 percent), New York (+5.6 percent), and Washington (+2.2 percent). Mind you, he came nowhere near carrying any of these states, with the exception of Nevada, but the president did record slight improvement when compared with his 2016 vote performance.

The state where Trump outperformed his 2016 total by the most is Utah (12.6 percent), but that is largely because there was no strong Independent or significant minor party candidate on the ballot in the 2020 election. Four years ago, Independent Evan McMullen did well in Utah, attracting 21.5 percent of the Beehive State vote thus allowing Trump to carry the state with only a plurality of 45.5 percent. In 2020, his victory percentage improved to 58.1 percent.

One of the key reasons former vice president Joe Biden won the election is because he increased Democratic performance over Hillary Clinton’s 2016 vote totals in every state but New York. This allowed him to tip the balance away from President Trump in the critical states of Arizona, Georgia, Michigan, Wisconsin, and Pennsylvania, those states the latter man carried in 2016 but were lost to Biden in this current election.

The Decisions Within the Election

Oct. 30, 2020 — The 2020 election cycle has been unique in many ways, but a series of significant decisions, typically through judicial rulings, will likely have a long-lasting effect upon the way the various states administer their elections.

Expanded early voting is likely here to stay. With more than 66 million people already voting through Wednesday, we can expect the states to continue with this relatively new process. Currently, only four states do not have some form of early voting.

Whether we see a continuance of the post-election ballot reception period may be another matter. There is likely to be controversy over this practice that 21 states will feature beginning next week. If the presidential race is close and gets bogged down in the political overtime, the negative aspects of counting votes that come in after the election could come to the forefront.

We have also seen changes in some states, most of which came in previous years, over their primary voting procedures. With reapportionment and redistricting on the political horizon, we are seeing states place measures on Tuesday’s ballot that could bring even more change to electoral systems around the country.

According to research presented from the University of Virginia’s Dr. Larry Sabato’s Crystal Ball publication and the Ballotpedia organization, voters in nine states will be deciding measures that could alter even further the way future elections are conducted. As we have seen develop, states adopting changes lead to further states following suit. Therefore, if many of the measures receive voter approval Tuesday, other states may also begin adopting some of these practices.

We start with states potentially changing their primary systems to a variation of the jungle primary system. Currently, Louisiana, where the procedure began, California, and Washington use the top-two qualifying system. In those states, all candidates are placed on the same primary ballot and the top two vote-getters advance to the general election irrespective of political party affiliation. Louisiana can elect a candidate outright if he or she receives majority support in the primary election because the state schedules the primary concurrently with the national general election.

Voters in Florida have a ballot proposition to decide if they want their state to adopt the jungle primary system. The Sunshine State voters are also considering a proposition that would allow changes voted through initiative only to take effect if the measure passes in two general elections. Therefore, should this latter idea attain approval, it, and all of the other passed measures, would be delayed until they again pass in a subsequent election.

Alaska voters are looking at another variation of the jungle primary. They are considering a measure where the primary would produce four finishers, thus setting up multi-candidate general elections.

Michigan Reverses Direction
On Mail-In Ballot Oversight

Oct. 20, 2020 — The Michigan Court of Appeals on Friday reversed a lower court ruling that allowed a post-election ballot reception period that would have lasted until Nov. 17, and granted the process known as “ballot harvesting,” where another individual or individuals can deliver unspecified numbers of ballots for voters.

The three-judge high court unanimously overturned a ruling from Court of Claims Judge Cynthia Stephens who made the original directive in deciding an election lawsuit that the Michigan Alliance for Retired Americans, a union-funded organization, brought forth.

When the Michigan attorney general and secretary of state jointly decided not to appeal Judge Stephens’ ruling, the Republican controlled state House and Senate filed the motion and were granted standing. It is unclear now whether the Michigan Alliance will appeal to the state Supreme Court.

According to the Detroit News’s reporting, the original ruling contained the directive that the ballots must be postmarked by Nov. 3. That clerical distinction, however, will be difficult to enforce once we advance into the post-election counting and challenge stage.

The US Postal Service, themselves, according to their employee practices handbook, indicate that many mail pieces do not require postmarks. In most of the 21 states that are now allowing the post-election reception period, the ballots will fall into one of these categories thus making the postmark question moot, and that will invariably lead to further lawsuits and litigation. Below is the official language for the postmark directives:

“Postmarks are not required for mailings bearing a permit, meter, or precanceled stamp for postage, nor to pieces with an indicia applied by various postage evidencing systems.”

The Appellate Court ruling means, at least until if and when the state Supreme Court addresses the issue, that there will be no post-election ballot reception period in Michigan. Ballot harvesting pertaining to individuals who are not immediate family members of the person wanting to vote absentee or is not an election office clerk, will again be prohibited. Therefore, all ballots are required to be in the possession of election authorities throughout Michigan’s counties before the polls close on Election Day, Nov. 3.

Pennsylvania Voting Rules

Sept. 21, 2020 — Pennsylvania’s Democratic controlled Supreme Court changed their state election procedures late last week in a series of rulings on a lawsuit that the Pennsylvania Secretary of State and PA Democratic Party previously filed.

Under the new process, receiving votes after the election is allowed if “no evidence exists” that the ballot was mailed after Election Day, Nov. 3. The deadline for ballot acceptance now moves from 8 pm on Election Day to 5 pm, Friday, Nov. 6. Pennsylvania becomes the 17th state to allow post-election reception for this 2020 election. The ruling increases the chances that we will not have a winner declared on election night.

Additionally, three other rulings will allow drop boxes to be used as ballot receptacles in the various counties, affirmed that poll watchers can only serve in their own county of residence, and Green Party candidate Howie Hawkins’ name was removed from the ballot. The court did not grant the lawsuit motion to allow ballot harvesting, which would permit third parties to deliver ballots to the authorities or ballot drop boxes.

The drop boxes will be placed in various locations around a county and voters can deposit their ballots without using the postal service to transfer their vote to the county election authorities. Hawkins’ name was removed from the ballot because the court said he “failed to comply with the Election Code’s strict mandate” and the attempts to fix the problem “did not suffice to cure that error,” but the specifics were not addressed.

With the large number of absentee ballots expected here and in other states, the trend toward allowing post-election reception, and the laws that some states, like Pennsylvania, have to control when the mail ballots can be counted, makes it less likely that we will see a definitive presidential campaign result on Nov. 3. The same will be true for certain US Senate and House races.

Of the 17 states, now including Pennsylvania, that are allowing post-election ballot reception, seven appear competitive. The others, Alaska, California, Kansas, Massachusetts, Mississippi, New Jersey, Utah, Virginia, Washington, and West Virginia will likely declare a clear winner relatively early in the counting period.

Recapping the Primaries

Aug. 6, 2020 — Five states held their primary elections on Tuesday night and many were close, most of which are now complete. Additionally, electorates in several safe open House seats chose a party primary winner who will be the next representative. Therefore, we want to recap the final action along with a projection for the general election.


ARIZONA

Arizona Senate candidate, retired astronaut Mark Kelly (D); appointed Sen. Martha McSally (R)

Senate: Appointed Sen. Martha McSally scored a 76 percent victory in the Republican primary against minimal opposition, while retired astronaut Mark Kelly was unopposed on the Democratic side. Arizona will host a major national Senate campaign in the fall, and Kelly has the early sustained polling lead.

Even with him facing no opposition on Tuesday, Democratic turnout rose nine percent when compared to 2018, but 55,617 more people voted in Tuesday’s GOP primary. This, after more Democrats had voted early according to pre-election ballot tabulations. Because of the large number of mail ballots present in this election, it is likely that the final count is incomplete.

AZ-1: Rep. Tom O’Halleran (D-Sedona) scored only a 59 percent Democratic primary win over former Flagstaff City councilwoman Eva Putzova on Tuesday, despite a better than 2:1 spending advantage. Attorney Tiffany Shedd won the Republican nomination. This district could become competitive, but Rep. O’Halleran is the clear favorite for re-election. The expansive eastern Arizona district leans Democratic as the party’s 3,000-plus vote edge in primary turnout suggests.

AZ-2: Rep. Ann Kirkpatrick (D-Tucson) was easily re-nominated on Tuesday and is a heavy favorite in the general election. Defense contractor Brandon Martin won the Republican primary, but he faces a very uphill climb against Kirkpatrick in November. Despite more Republicans than Democrats voting statewide, Democrats outpaced Republican turnout in this district by a substantial 75,780 to 58,277.


KANSAS

Senate: Rep. Roger Marshall (R-Great Bend) convincingly won the controversial Republican primary, and advances into a general election race with state Sen. Barbara Bollier (D-Mission Hills), a physician and former Republican. This will be a competitive general election despite the strong Republican voter history because Bollier already has over $4 million cash-on-hand to begin the November campaign cycle. We will soon see new polling here. The last published poll pairing Marshall and Bollier came from the Civiqs research organization at the beginning of June: Marshall 42-41 percent.

Wacky Wins in a Senate Primary; Incumbents Watkins & Clay Lose

Aug. 5, 2020 — We review last night’s primary action in the states of Kansas, Missouri, Michigan, Arizona and Washington:


KANSAS

Rep. Roger Marshall (R-Great Bend)

The 2020 election cycle’s wackiest Senate primary ended last night with a big victory for Kansas Rep. Roger Marshall (R-Great Bend) as he defeated former secretary of state and 2018 gubernatorial nominee Kris Kobach and Kansas City Plumbing Company owner and self-funder Bob Hamilton in the statewide Republican primary.

The Marshall victory margin is 40-26-19 percent over the two men, while former Kansas City Chiefs football player and state Turnpike Commission chairman Dave Lindstrom captured 6.7 percent of the vote, best among the also-ran candidates.

The race featured both parties making seven-figure media buys. The national Republican leadership, however, came in to run negative spots against Kobach, a risky strategy in case he would become their nominee. It was clear that Republican survey research provided virtually the same results that Democrats were seeing, namely Kobach winning his primary would give the Democrats the inside track toward snatching away what should be a safe Republican seat.

The other unusual Kansas Senate facet was seeing Democratic organizations come into the state to actively boost Kobach in the GOP primary. He lost the 2018 governor’s race to Democrat Laura Kelly, and the party leaders believed Kobach would be the weakest general election candidate to oppose their party’s consensus nominee, state Sen. Barbara Bollier (D-Mission Hills). Now, she must run against the Republicans’ presumed strongest candidate, Rep. Marshall.

Interestingly, the most recent publicly released poll, which dated back to the beginning of June from the Civiqs organization surveying for the Daily Kos Elections website, found Rep. Marshall and Sen. Bollier falling into a virtual tie. It is likely, however, as the new Republican nominee, that Marshall will become a clear favorite to win in November.

Monitoring Mail-in Vote Turnout

July 7, 2020 — With many states emphasizing mail voting as a way to increase voter participation in the COVID-19 era, has adoption of near universal mail voting in the states that have done so achieved its fundamental purpose, or has it caused more problems than it solved?

Voter turnout is always a definitive factor in determining election outcomes, and the push to change voting procedures has occurred in 31 state primaries. Therefore, the voting system alterations, should they continue into the general election, will most likely have a major impact upon the electoral outcomes.

Most of the states adopting change only expanded their mail absentee ballot procedures for the primaries; therefore, we can expect another round of battles over the general election processes to soon come before legislatures and courts.

Many of the states, Maryland, Georgia, Nevada, Pennsylvania, and New York to name several, had administrative problems with their expanded mail programs including reports of homes receiving multiple ballots because inactive voters were forced to be mailed, some people requesting absentee ballots and not receiving them, and long post-election counting periods because of the large number of mail ballots coming into the county clerk’s offices.

New York, in fact, has still not even completed its unofficial tabulation and the primary was June 23. The Clark County (Nevada) County Clerk said publicly that the directive to mail inactive voters led to chaos in the state primary since so many ballots were being sent to individuals no longer living at the mailed address.

Largely, Democrats and voting rights organizations are attempting to persuade legislatures, governors, and/or the courts to expand the mail absentee ballot voting option to all registered voters both active and inactive, enact same-day voter registration, adopt ballot harvesting, which allows any individual to collect ballots from voters and turn them into county election authorities (this process is only legal in California, to date), and allow ballots to be post-marked on Election Day as opposed to requiring that they be received on voting day. Republicans and conservative organizations typically object to most of these ideas on verification grounds.

Mail Voting Polarization

May 4, 2020 — The COVID-19 pandemic has greatly affected everyday life, going even so far as touching American voting procedures. Before the pandemic hit, for example, just four states conducted their elections exclusively through the mail (Oregon, Washington) or predominantly so, meaning having few polling places (California, Colorado).

With so many early primary states postponing their primary elections in conjunction with the disease precautions, we now see either all-mail systems, or including the mail option for all voters, being utilized for upcoming primary elections in 20 additional states, and the list keeps growing.

Predictably, progressive left voter organizations are using the pandemic as a catalyst to push for their long-term election systemic goals. Lawsuits around the country are being filed in such places as Indiana, Pennsylvania, Texas, and several other states, to expand the all-mail option from the primaries into the general election. And, once the all-mail system has been instituted in places around the country, thus establishing it as an electoral fixture, the process becomes much easier to make permanent.

Additionally, we are seeing further lawsuits filed to include automatic voter registration, prohibiting the purging of registration names of people who consistently haven’t voted in multiple elections, and the controversial ballot harvesting idea that allows any voter to collect ballots and deliver them to election authorities.

The Pew Research Center just completed a nationwide survey, testing the population about their attitudes and perceptions of these types of procedural issues. It came as no surprise that the survey results produced rather polarizing responses from the self-identified affiliates of the two major political parties, since virtually every contemporary issue yields deep divides between the partisans.
