NM-1: A Pattern?

Albuquerque, New Mexico-anchored NM-1 Congressional District

June 4, 2021 — Several media reports — typified by an MSNBC website analysis article that Steve Benen authored after Tuesday’s New Mexico special election — are trying to make the point that Melanie Stansbury’s landslide victory is a potential benchmark for future Democratic victories. Such a conclusion is a stretch.

The two-pronged premise is that Stansbury was so strong that she even ran ahead of President Biden’s performance in the district, and that the Republican campaign’s emphasis on the crime problem and the national effort to defund the police proved a political failure.

While Stansbury, a two-term state representative, scored a 60-36 percent win in the Albuquerque anchored congressional district that former Rep. Deb Haaland (D) resigned to become US Interior Secretary, her performance is not unusual. In fact, her vote total was less than two points above the mean average Democratic congressional percentage since the party converted the seat from the Republicans back in 2008.

To the argument that Stansbury’s victory margin was larger than President Biden’s 60-37 percent spread against then-President Trump, and it was only one percentage point better, it is not unusual for a House campaign to outperform the top of the ticket. In most instances, the congressional winner is better known than his or her competitor, has greater funding and outside support, and is consistently in position to overwhelm the opposition. Such is rarely the case in a national presidential campaign or in a major statewide contest for senator or governor.

The crime issue was certainly a focal point of Republican nominee Mark Moores, an Albuquerque state senator. The national party, however, did very little to support Moores, virtually conceding the race from the outset based upon the voting history here for more than a decade.

For an underdog candidate in Moores position, emphasizing the crime issue, on paper, made sense as a point of attack. Albuquerque, according to FBI statistics has the ninth worst violent crime statistics in the country, meaning 1,352 crimes per 100,000 residents according to the latest available figures (2019). To put this number in perspective, Chicago, which has drawn much national media attention for its high murder rate, ranks 31st on the same scale, at 943 crimes per 100,000 city residents.

Perhaps one reason the crime issue did not propel the Moores candidacy is there was no serious effort to defund the Albuquerque Police Department, nor is there the sharp racial tension that is present in some of the cities where we saw serious problems along with a local movement to reorder policing.

Stansbury Wins New Mexico Special

June 3, 2021 — The New Mexico special election went as expected Tuesday, as state Rep. Melanie Stansbury (D-Albuquerque) defeated state Sen. Mark Moores (R-Albuquerque) by a 60-36 percent count, which is consistent with the partisan early vote turnout.

The overall participation factor exceeded 131,000 voters, or 28.2 percent of the district’s registered voter universe, which is relatively high for a special election. It appears that over 70 percent of the people participating in the electoral contest cast an early ballot.

Stansbury, twice elected to the state House of Representatives, was victorious in the special Democratic district convention whose delegates were empowered with choosing a party nominee to replace resigned Rep. Deb Haaland (D-Albuquerque). Haaland vacated the House upon being confirmed as US Interior Secretary in the Biden cabinet.

The Stansbury congressional victory margin came from population-dominant Bernalillo County, where more than 90 percent of the CD-1 residents live. Stansbury captured 61 percent of the vote here. In the smaller rural counties, Moores took three of four, but the aggregate vote total from each of those entities was individually less than 2,500 cast ballots.

The Democratic mean average in the seat since partisan conversion in 2008 is 58.2 percent, so Stansbury ran about two points above the benchmark. The state’s current governor, Gov. Michelle Lujan Grisham, represented the 1st District for three terms and scored the single-highest Democratic election percentage during the 13-year post-conversion period. She tallied 65.1 percent in 2016, the same election in which Hillary Clinton posted a 52-35 percent CD-1 result and 48-40 percent statewide.

NM-1 Special Election Tuesday

June 2, 2021 — The latest in the series of special elections to fill US House vacancies was held yesterday, and the race has an obvious favorite.

On the ballot: state Rep. Melanie Stansbury (D-Albuquerque); state Sen. Mark Moores (R-Albuquerque); ex-Land Commissioner Aubrey Dunn, a former Republican who is running as an Independent; and Libertarian Party nominee Chris Manning.

The major parties nominated their candidates in special convention soon after incumbent Rep. Deb Haaland (D-Albuquerque) resigned to accept her appointment as Interior Secretary in President Biden’s cabinet.

Rep. Stansbury prevailed in a close multi-candidate Democratic convention, ultimately defeating state Sen. Antoinette Sedillo Lopez (D-Albuquerque) in a final round of delegate voting. Many believed winning the Democratic convention was tantamount to claiming the special election. Sen. Moores was an easy winner on the Republican side.

All indications pointed to a Stansbury victory, which is what played out last evening. The only recent publicly released poll before yesterday’s election, one that RRH Elections conducted (May 18-21; 555 likely NM-1 voters, interactive voice response system), found the Democratic nominee holding a 49-33 percent lead over Moores.

Secondly, the district has moved sharply to the left over the past decade, as the 2016 and 2020 presidential elections suggest. In the ’16 campaign, Hillary Clinton defeated Donald Trump here, 52-35 percent. This past November, the Biden margin over ex-President Trump soared to 60-37 percent. The last Republican to represent the 1st District was former Rep. Heather Wilson (R-Albuquerque) who left the House in 2008 to run unsuccessfully for US Senate.

The House Opens – Part I

May 7, 2021 — With the number of House open and vacant seats continuing to grow, today we open a two-part series to update the status of each and begin to project where the most competitive incumbent-less districts might lie in 2022.

Adding the most recent retirement announcements or declarations for a different office, we see 16 districts that will introduce freshman members from their next election, eight from the Democratic side and an equal number of Republican seats. Of the 16, five are vacant and in special election cycles.

Today, we look at the Democratic open seats and tomorrow, the Republicans. The eight Democratic seats come from six states with another potential candidacy announcement coming shortly, at least based upon reading the Florida political tea leaves in association with this week’s gubernatorial race declaration from Rep. Charlie Crist (D-FL).

Three of the five vacancies are on the Democratic side and will be filled in elections conducted from June 1 through Jan. 11 of next year. The other five Democratic openings result from retirement decisions (3) and members seeking a different office (2) with an additional open seat announcement apparently coming imminently in Florida as all indications suggest that Rep. Val Demings (D-Orlando) will soon announce her gubernatorial bid.


AZ-2 – Rep. Ann Kirkpatrick – retirement

Rep. Kirkpatrick had represented the 1st District for three non-consecutive terms beginning in 2009. She then ran unsuccessfully for Senate in 2016 and returned in 2018 with a victory in the 2nd District. She was re-elected in 2020 with 55 percent of the vote. In March, Kirkpatrick announced that she would retire at the conclusion of the current Congress.

The reapportionment picture drastically changes the 2nd District political outlook. Originally, Arizona was projected to gain a seat, but did not once the official population figures were announced. Therefore, the Tucson anchored CD-2, expected to significantly change, is likely to remain closer to its current configuration.

If so, then the re-draw process will likely keep the 2nd in the Democratic column. The two leading early contenders to replace Rep. Kirkpatrick are state representative and surgeon Randy Friese (D-Tucson) and state Sen. Kirsten Engel (D-Tucson).

• President Biden carried the 2nd with a 54-44 percent margin.

Texas’ 8th Congressional District – more change likely coming …

April 16, 2021 — Veteran Texas Congressman Kevin Brady (R-The Woodlands), who is the Republican’s ranking member of the House Ways & Means Committee, announced Wednesday that his current 13th term will be his last as a member of the House. Brady, first elected in 1996 after serving three terms in the Texas House of Representatives, will retire at the end of the 117th Congress with 26 years of seniority.

Rep. Brady is now the fifth Republican to announce he won’t seek re-election, but three of those are running for different offices. Rep. Mo Brooks (R-AL) is a declared US Senate candidate; Rep. Jody Hice (R-GA) is running for Georgia Secretary of State; and Rep. Lee Zeldin (R-NY) has announced he plans to challenge Gov. Andrew Cuomo (D) next year. Joining Brady in retiring from Congress is New York Rep. Tom Reed (R-Corning). The 6th District of Texas, due to Rep. Ron Wright’s (R-Arlington) death, is in special election and will likely be filled sometime in late June or early July.

Two Democrats are retiring, another Texan, Rep. Filemon Vela (D-Brownsville) and Arizona’s Ann Kirkpatrick (D-Tucson). Four Democratic seats are currently in special election cycles, however: LA-2 (Rep. Cedric Richmond), NM-1 (Rep. Deb Haaland), OH-11 (Rep. Marcia Fudge), and FL-20 (Rep. Alcee Hastings). The first three Democratic vacancies are due to Biden Administration appointments of the listed members, while Rep. Hastings passed away last week.

Brady first came to office in an unusual manner. After qualifying for the original runoff election from the early March 1996 Texas primary, he defeated his Republican opponent with 53 percent of the vote in the secondary election a month later.

Post nomination, a federal court ruled that several Lone Star State districts were illegal for racial representation reasons and an immediate re-draw was ordered. Though Brady’s 8th District was not one of the seats deemed illegal, re-drawing an adjacent district labeled as such affected his seat. Therefore, he was again forced to run in another primary and runoff election, the latter against the same opponent he defeated earlier in the year. In all, Brady had to run in four elections all in the same year to capture the 8th District for the first time.

The House Convenes

House Speaker Nancy Pelosi (D-CA) barely retained the Speakership in a narrow vote.

Jan. 4, 2021 — The 117th House of Representatives was called to order yesterday in an unusual Sunday commencement session, and even on the first day the House membership is not complete. The elected body includes 433 members. The NY-22 seat is still undecided, and the LA-5 district is now vacant due to the shocking death of Rep.-Elect Luke Letlow (R).

The vote for Speaker in favor of incumbent Nancy Pelosi (D-CA) was 216-209. Two Democrats, Reps. Conor Lamb (D-PA) and Jared Golden (D-ME), did not support Pelosi, voting for Rep. Hakeem Jeffries (D-NY) and Sen. Tammy Duckworth (D-IL), respectively, while three others voted present. Reps. Elissa Slotkin (D-MI), Mikie Sherrill (D-NJ), and Abigail Spanberger (D-VA), all re-elected with closer than expected margins, only acknowledged their presence in the chamber while responding to the vote for Speaker.

Two members were unable to participate in yesterday’s ceremony. Florida Rep. Alcee Hastings (D-Delray Beach), due to cancer treatments, and fellow Sunshine State Rep.-Elect Maria Elvira Salazar (R-Miami), because of a positive COVID test, were absent for the first session.

Three other seats will soon be vacant. Reps. Cedric Richmond (D-LA), Marcia Fudge (D-OH), and Deb Haaland (D-NM) have all been appointed to or nominated for positions in the Biden Administration.

Rep. Richmond will resign on Jan. 20 to run the White House Office of Public Engagement. This position does not require Senate confirmation. Reps. Fudge and Haaland must receive Senate confirmation for their nominations as secretaries of Housing and Urban Development and Interior, respectively. They will resign from the House upon receiving such approval for their new positions.

The NY-22 election is still undecided, now two full months after Election Day, and it may still be some time before the winner is actually determined. As the counties are finally finishing their vote totals after Justice of the Oswego County Supreme Court Scott DelConte ordered seven of the eight local entities to review and properly submit the challenged ballots to the court. Justice DelConte ruled that the seven counties failed to adhere to New York election law in processing and accounting for the challenged ballots.

The totals continue to fluctuate, as Tenney has seen her 12-vote lead swell to 29, before her fortunes changed to trailing by 14 tallies. Perhaps more importantly, DelConte has been ruling in favor of Rep. Anthony Brindisi’s (D-Utica) challenges, which could be a prelude to the final outcome. More than 2,000 ballots were contested by the competing parties.

NM-1: New Vacancy

Dec. 21, 2020 — Late last week, President-Elect Joe Biden announced that he is nominating New Mexico US Rep. Deb Haaland (D-Albuquerque) to be Interior Secretary. Upon confirmation, Rep. Haaland will resign her seat in the House, which will become the body’s third vacancy.

Biden has already chosen Reps. Cedric Richmond (D-LA) and Marcia Fudge (D-OH) to run the White House Office of Public Engagement and become Secretary of the Department of Housing and Urban Development, respectively.

Special elections will be held in all three districts and scheduled once the member officially resigns to accept his or her new position. Democrats will be prohibitive favorites in Louisiana and Ohio, but it’s possible the New Mexico seat could become competitive.

Haaland was first elected to what was an open district in 2018 when then-Rep. Michelle Lujan Grisham (D) risked the 1st District House seat to wage an ultimately successful campaign for Governor. Grisham was first elected to the House in 2012 in an open seat campaign. She succeeded then-Rep. Martin Heinrich (D), who won a Senate seat in the same election.

Prior to Heinrich’s initial House win in 2008, the 1st District congressional seat, anchored in Albuquerque, had been in Republican hands for 40 consecutive years in the person of Reps. Manuel Lujan, Steve Schiff, and Heather Wilson, consecutively. Though the district has significantly changed politically, it has largely kept its same basic geographic context during the entire aforementioned stretch. Prior to the 1968 election, New Mexico’s representatives were chosen in at-large elections.

Once Haaland, one of the first Native American females to be elected to the House, resigns, Gov. Grisham will schedule a special election. Under New Mexico procedure, the political parties will caucus to choose their nominees, so there will be no primary election. Therefore, it is probable to see a contested convention process for both parties, particularly for the Democrats since their eventual nominee will begin the special election campaign in the favorite’s position.
