Early House Outlook – Part IV

Jan. 24, 2021 — Concluding our electoral US House preview, today we look at the final dozen states in the country’s southern region.


• Alabama – 7 Seats (1D6R)

Alabama is on the cusp of losing one of its seven seats in reapportionment. Sources suggest the final numbers are very close and the state may sue over how the figures are tabulated should apportionment take away one of the Republican seats. The Democrats have only one CD in the state, which is a majority minority seat (Rep. Terri Sewell-D) that is a certainty to remain as part of the delegation.

Should Alabama lose a seat in reapportionment, the state’s southeastern region, most particularly the Montgomery anchored 2nd District, would probably the most affected since this is the least populated area of the seven CDs.


• Delaware – 1 Seat (1D)

The home of new President Joe Biden was once a relatively conservative state, but no longer. Delaware is growing but won’t come anywhere near gaining a second seat. Therefore, three-term Rep. Lisa Blunt Rochester (D-Wilmington) will have an easy electoral ride for the foreseeable future.


• Florida – 27 Seats (11D16R)

The Sunshine State is one of two entities perched to gain multiple new districts. Florida is projected to add two seats, which should give the GOP map drawers the opportunity of protecting the newly won South Florida District 26 (Rep. Carlos Gimenez) and 27 (Rep. Maria Elvira Salazar) while maximizing the Republican compilation of Florida seats. Winning the aforementioned Miami-anchored CDs might result in conceding one of the new seats to the Democrats, however, in order to off-load a significant portion of their left-of-center voters, which would make both seats more Republican.

Holding the governor’s office, both houses of the legislature, and now a majority on the state Supreme Court will allow the GOP to become the big winner in redistricting. The fact that 25 of the 27 districts are over the estimated per district population projection of approximately 740,000 residents provides statistical evidence for expanding the delegation.

Rep. Darren Soto’s (D-Kissimmee) 9th District is the most over-populated seat with more than 931,000 people. Only Reps. Neal Dunn’s (R-Panama City) and Charlie Crist’s (D-St. Petersburg) seats are slightly below the projected population target. Twelve of the current 27 districts now hold more than 800,000 constituents. Expect the new seats to be added in South Florida, most likely toward the Gulf Coast side of the peninsula, and in the Orlando area.


• Georgia – 14 Seats (6D8R)

Though Republicans will control the redistricting pen as a result of holding both the legislature and governor’s office, the party map drawers will be hard-pressed to construct a map that allows their members to dominate the delegation as they did 10 years ago. Gaining a seat in 2010 reapportionment, the GOP began the decade with a 10-4 advantage in the House delegation only to see two Atlanta suburban seats slip away as a result of demographic and political changes in the metropolitan area.

Georgia is expected to remain constant in this reapportionment with their 14 seats. The GOP will attempt to make at least one of the seats they lost, District 6 (Rep. Lucy McBath) or District 7 (Rep. Carolyn Bourdeaux) more Republican and thus give themselves a chance to re-claim a seat for the coming decade.

Expect a move to make one of these two seats, probably District 6, more Democratic in order to make District 7 more Republican especially since the latter CD is the most over-populated seat in the state with more than 844,000 residents and will have to shed close to 90,000 individuals to other districts.

Winners & losers in the redistricting tug of wars

Nov. 19, 2020 — In yesterday’s Update, we ended with the paragraph, “Considering the states that are losing and gaining seats, party control, and changing political trends, the Republicans are still likely to lose a small net number of seats in the transfer process despite holding the most redistricting power.”

This statement generated some questions about why the Republicans could lose seats in the apportionment transfer when they hold the balance of power in more states. Today, we delve deeper.

At this point, and remembering these are only estimates that could change when the actual apportionment formula produces the official number of seats that each state will possess, it appears ten seats will move from one state to others. Therefore, it is projected that Texas (3), Florida (2), Arizona, Colorado, Montana, North Carolina, and Oregon will gain districts, while Alabama, California, Illinois, Michigan, Minnesota, New York, Ohio, Pennsylvania, Rhode Island, and West Virginia will lose a seat apiece. We will now explore each individually:


States That Lose

• Alabama – Even though Republicans have full control and a 6R-1D delegation, the Republicans will take the loss here. The Democratic district is a Voting Rights seat, so the loss will come from the GOP column even though they hold the redistricting pen.

• California – The lopsided California delegation, even with Republicans gaining one to three seats here when the votes are all finally counted, will likely yield the Democrats losing the district. California is a commission state that operates under strict guidelines. Therefore, the mathematics suggest, in what will potentially end as a 43D-10R delegation that the transfer seat loss will come from the Democratic column.

• Illinois – Though the state delegation features only five Republicans from a group of 18 members, the Democrats control the redistricting process here and 10 years ago produced the most lopsided of partisan gerrymanders. Expect them to figure a way for the Republicans to take the one seat loss.

• Michigan – The voters adopted a new redistricting commission, but the composition parameters look to favor the Democrats. Therefore, expect the 7D-7R delegation to recede by one Republican seat.

• Minnesota – This state features the only state legislature where each party controls one legislative chamber. Though this gives the Republicans a seat at the redistricting table, the population loss in the northern part of the state, where they have two seats, will likely result in the 4D-4R delegation lessening by one Republican seat.

The Redistricting Prelude

Nov. 18, 2020 — The Census Bureau continues to make progress in completing the decennial population count and it appears the national apportionment report, which details how many congressional seats each state’s population earns, will be delivered to Congress in early January. Because of COVID, the apportionment process has been slightly delayed since the report typically has a year-end deadline.

Once apportionment is known, states then begin receiving their updated data necessary for drawing new congressional and state legislative districts. The states with the earliest primaries are the first to receive their data so they have adequate time to prepare their new congressional and state legislative boundaries.

In terms of apportionment, it is expected that Texas may gain approximately three seats and Florida two. The other gaining states are likely to be Arizona, Colorado, Montana, North Carolina, and Oregon. Those losing seats appear to be Alabama, California (for the first time in history), Illinois, Michigan, Minnesota, New York, Ohio, Pennsylvania, Rhode Island, and West Virginia. These estimates are not always completely correct, so this list could change when the actual apportionment is applied and publicly released.

A total of 34 states will draw their new districts solely through the legislative process. The remaining multi-member states operate through a type of commission, either an independent body or one under political control. Seven states are at-large meaning their congressional race is statewide. Rhode Island joins this group in 2021 as it will lose its second seat, while Montana will likely regain the district that was lost in the 1991 reapportionment.

In the Nov. 3 election, Republicans saw a net gain in state legislative seats around the country. Only one state saw its legislative chambers flip, however, the New Hampshire House and Senate moving from Democrat to Republican. This means Republicans will control 61 legislative chambers as compared to the Democrats’ 37. The Nebraska unicameral legislature is elected on a non-partisan basis, but Republicans control that chamber as well.

Republicans will again have the advantage in the states where the legislatures and governors determine the new map boundaries. Democrats, largely under the National Democratic Redistricting Committee that former Attorney General Eric Holder leads, targeted 13 states to protect or gain legislative chambers. They failed in all, as Republicans kept their majorities in each state they previously controlled and flipped New Hampshire to their column.

Pennsylvania Voting Rules

Sept. 21, 2020 — Pennsylvania’s Democratic controlled Supreme Court changed their state election procedures late last week in a series of rulings on a lawsuit that the Pennsylvania Secretary of State and PA Democratic Party previously filed.

Under the new process, receiving votes after the election is allowed if “no evidence exists” that the ballot was mailed after Election Day, Nov. 3. The deadline for ballot acceptance now moves from 8 pm on Election Day to 5 pm, Friday, Nov. 6. Pennsylvania becomes the 17th state to allow post-election reception for this 2020 election. The ruling increases the chances that we will not have a winner declared on election night.

Additionally, three other rulings will allow drop boxes to be used as ballot receptacles in the various counties, affirmed that poll watchers can only serve in their own county of residence, and Green Party candidate Howie Hawkins’ name was removed from the ballot. The court did not grant the lawsuit motion to allow ballot harvesting, which would permit third parties to deliver ballots to the authorities or ballot drop boxes.

The drop boxes will be placed in various locations around a county and voters can deposit their ballots without using the postal service to transfer their vote to the county election authorities. Hawkins’ name was removed from the ballot because the court said he “failed to comply with the Election Code’s strict mandate” and the attempts to fix the problem “did not suffice to cure that error,” but the specifics were not addressed.

With the large number of absentee ballots expected here and in other states, the trend toward allowing post-election reception, and the laws that some states, like Pennsylvania, have to control when the mail ballots can be counted, makes it less likely that we will see a definitive presidential campaign result on Nov. 3. The same will be true for certain US Senate and House races.

Of the 17 states, now including Pennsylvania, that are allowing post-election ballot reception, seven appear competitive. The others, Alaska, California, Kansas, Massachusetts, Mississippi, New Jersey, Utah, Virginia, Washington, and West Virginia will likely declare a clear winner relatively early in the counting period.

Last Night’s Results

June 10, 2020 — Voters in Georgia, Nevada, North Dakota, South Carolina, and West Virginia chose nominees last night or sent finalists to runoffs in the two southern states.


• GEORGIA: Former vice president Joe Biden clinched his party’s presidential nomination with an 83 percent victory in the Georgia primary and sweeping the state’s 105 delegates. By all counts, Biden has secured the 1,991 bound first-ballot delegate votes to seal the nomination.

In the Democratic US Senate primary, former congressional candidate and documentary filmmaker Jon Ossoff looks to have fallen just short of the 50 percent mark to secure the party nomination. If the trend holds as the final votes are counted, he will advance to an Aug. 11 runoff election. After trailing former lieutenant governor nominee Sarah Riggs Amico most of the night, ex-Columbus mayor Teresa Tomlinson appears to have secured the second runoff position in a close vote.

Logistical problems in the Atlanta area could delay the final totals, so whether Ossoff won outright and deciding the second runoff position are still not necessarily determined. It is likely, however, that a runoff will occur between Ossoff and Tomlinson, assuming the latter candidate chooses to continue. The percentage spread between the two is a lopsided 49-16 percent.

Numbers are also not final in the Atlanta suburban 7th District, but it appears that 2018 Democratic nominee Carolyn Bourdeaux, who came within 420 votes of winning the seat in that year, came close to avoiding a runoff with 46 percent of the vote. Should this trend hold, she will face state Rep. Brenda Lopez Romero (D-Norcross) in the secondary election.

On the Republican side, retired Navy officer and physician Rich McCormick won the crowded primary outright as he topped 55 percent, an impressive total within a field of seven candidates. State Sen. Renee Unterman (R-Gwinnett County) placed a distant second.

In the open 9th District, the seat that Rep. Doug Collins (R-Gainesville) is leaving to run for the Senate, state Rep. Matt Gurtler (R-Tiger) and retired Navy officer Andrew Clyde will advance to the Aug. 11 runoff. Former US Rep. Paul Broun finished in fourth position. In this safely Republican northeast Georgia district, the runoff winner will clinch the general election.
