Potential California Candidate Pairing Snapshots

Now that the California redistricting map is law, we can examine the various incumbent pairings and potential pairings that could exist. The California Citizens Redistricting Commission clearly did not pay heed to incumbency, since a huge number of sitting incumbents were placed in districts with a colleague.

District 4: Dan Lungren/Tom McClintock – Since the map was finalized Aug. 15, Rep. Dan Lungren (R-CA-3) indicated that he may hop over into the new District 4 to challenge Rep. Tom McClintock (R-CA-4) in the Republican primary rather than stand for re-election in new District 7, where his home was placed. This would be a curious move, since District 7, which contains the majority of Lungren’s current territory, could certainly elect a Republican but likely would be at least moderately competitive throughout the decade.

New District 4, which begins in South Lake Tahoe and travels south down the Nevada border all the way to Yosemite National Park, is comprised of a preponderance of McClintock’s current CD. The fact that Lungren would even suggest such a move indicates he likely feels more comfortable doing battle against a Republican than facing a Democrat in a competitive general election, especially when winning the 2012 battle against McClintock would likely yield a safe seat until 2022. The new CA primary law that qualifies the two top vote-getters into the general election regardless of party means that the pair would likely face each other in both June and November, adding yet another caveat to the northern California political picture.

It is probable that Lungren will stay in District 7, because he would be a decided underdog to McClintock in District 4. The fact that Lungren would suggest taking on his Republican colleague in this configuration is quite surprising, however.

District 16: Dennis Cardoza/Jim Costa – This is another surprising situation. The commission map was not particularly kind to the Central Valley incumbents. Technically, three sitting members, Cardoza (D-CA-18), Costa (D-CA-20), and Republican Jeff Denham (R-CA-19) were all placed in new District 16. Each, however, has an adjacent seat in which to run. Denham will choose the new District 10, which is more competitive than his current district, but still one that he can win.

Since the map was enacted this past Monday, retirement rumors began swirling around Cardoza, suggesting that he would rather leave the House than run against his friend and fellow Democrat, Costa. The new 21st district, however, is a place where Costa could run – in fact, in contains the bulk of his current CD – but apparently the congressman does not want to face another close general election in a seat that is even more Republican. Costa only squeaked through in the last election 51-49%. Should Cardoza retire and thereby leave the new 16th district to Costa, the latter would become the favorite, though competition from a Republican is still a real possibility. This is another curious situation that has yet to be resolved. The GOP has a chance to gain at least one seat, probably the 21st, in this region.

District 25: Buck McKeon/Elton Gallegly – This is yet another situation where it appears a member would rather face a competitive primary than go hard against a candidate from the other party. The homes of Reps. McKeon (R-CA-25) and Gallegly (R-CA-24) were both placed in new District 25, which is comprised largely of McKeon’s current district. Gallegly also could run in the new Ventura County-based 26th district, which is a 50/50 D-R seat that only slightly tilts Republican.

Reports from the Gallegly camp, however, indicate he is looking more favorably at challenging McKeon than running in the marginal district, even though he would be the lone incumbent in the latter and currently represents a large portion of the territory. Based upon the draw in the new 25th, it is hard to classify Gallegly as anything but a decided underdog to McKeon, which makes it surprising to see him suggest he might take that option. Gallegly retiring, as he almost did two terms ago, is also a distinct possibility.

District 30: Brad Sherman/Howard Berman – The San Fernando Valley will see a major pairing as the area’s two veteran Democratic members will square-off. This is another of the California situations that could witness a major battle between the two in the qualifying primary and then in the general election, as the most likely scenario points to both Democrats moving into November under the state’s new election law. Sherman already represents about 50% of the new 30th District, as compared to Berman’s 20%, and he begins with more than $3.6 million in the bank, but that doesn’t guarantee victory. Berman is the more experienced campaigner and should command greater internal party support than Sherman. This race could turn into an epic political battle.

One other possibility, however, is for Sherman to hop over into the marginal 26th district. Particularly if Rep. Gallegly chooses to bypass the district, the 26th might become attractive to Sherman, if he thinks he can’t beat Berman. But, Sherman represents only a sliver of the current 26th, and he would be vulnerable to a Republican challenge. Thus, he has two difficult options.

District 38: Grace Napolitano/Linda Sanchez – The commission map drawers were also not kind to Rep. Linda Sanchez (R-CA-39). Regardless of where she chooses to run, she is likely to face a Democratic incumbent. Her home is placed in new District 38, but this seat is predominantly composed of Rep. Grace Napolitano’s current 38th CD. Napolitano has already announced her intention to seek re-election in the new 38th, thus forcing Sanchez into a difficult decision. She must either challenge Napolitano where she will be a decided underdog, or run in another seat. Her most likely option would be new District 47, the Long Beach seat, but she will face both state Sen. Alan Lowenthal (D) and probably a significant Republican challenger. It is possible that Rep. Laura Richardson (D-CA-37) could move here, too.

District 39: Ed Royce/Gary Miller – Something’s got to give in Orange County. The now-official map places the homes of Reps. Ed Royce (R-CA-40) and Gary Miller (R-CA-42) in new District 39, a seat that largely favors Royce in terms of current territory. Royce could choose to move south and challenge Rep. John Campbell (R-CA-48) in new CD 45, but this would still subject him to a pairing with a Republican incumbent. For his part, Miller says he won’t run against Royce or any other incumbent, meaning he could be headed toward retirement. If Royce does move into CD 45, then Campbell would be forced into a pairing either against the former or moving into new District 48 to take on Rep. Dana Rohrabacher (R-CA-46). In any event, among the quartet of Orange County Republican congressmen – Royce, Miller, Campbell and Rohrabacher – expect one of them not to return.

District 44: Janice Hahn/Laura Richardson – The situation involving the minority-weighted new 44th District is also surprising. Rep. Janice Hahn (D-CA-36), who just won her seat in a July special election, has already announced she will seek re-election in the heavily Hispanic 44th District rather than face Rep. Henry Waxman (D-CA-30) in the district that contains the bulk of her current seat. In this Compton-Culver City-South Gate CD, Hahn will have a white population that tallies only 9 percent, meaning she is vulnerable to a challenge from a minority office holder such as Assemblyman Isadore Hall (D), who has already announced his intention to run for Congress, and probably Rep. Laura Richardson, since she currently represents a large portion of the territory.

The new primary law cuts poorly for Hahn. She very well may be able to qualify for the general election by at least placing second in June, but in November she will be one-on-one against either a black or Hispanic opponent. In this situation, particularly since she currently represents such a small portion of the 44th, she becomes a decided underdog.

California is likely to dominate the 2012 US House picture because as many as 20 seats could become competitive either in the primary or general election, and in many cases, both. Watch in the coming days for even further developments.

Senate Financials Tell Interesting Stories

The second quarter US Senate financial disclosure summaries are now available and in almost all cases, the incumbents have prepared adequately for their re-election campaigns. Obviously, the size of the state dictates the money range needed to run a viable effort, so the benchmark cash on hand figures differ greatly. All in-cycle incumbents have more than $1.5 million in assets with the exception of Sen. Joe Manchin (D-WV), who possesses $1.279 million. Massachusetts Sen. Scott Brown (R) has the most money in the bank, $9.628 million. The next closest cash on hand figure is Sen. Bill Nelson’s (D-FL) $6.057 million.

The only incumbent with less cash on hand than a challenger is Sen. Dean Heller (R-NV). Rep. Shelley Berkley (D-NV-1) has $2.476 million in her campaign account versus Heller’s $2.272 million. The comparison is a bit unfair, however, because Heller is an appointed incumbent, replacing the resigned Sen. John Ensign (R). Therefore, his Senate incumbency is short-lived and should not be measured comparably to the other in-cycle full-term Senators.

The Senate incumbents having the strongest fundraising cycle to date are Scott Brown ($3.739 million), Bill Nelson ($3.695 million), and Democrat New Jersey Sen. Bob Menendez ($3.581 million). The strongest open seat/challenger fundraisers are Ohio state Treasurer Josh Mandel (R), who still has yet to announce his Senate candidacy, Connecticut Rep. Chris Murphy (D-CT-5), who is seeking retiring Sen. Joe Lieberman’s (I) open seat, and Rep. Denny Rehberg (R-MT-AL) challenging one-term Sen. Jon Tester (D-MT). Mandel raised $2.339 million, Murphy $2.012 million, and Rehberg $1.964 million.

The fundraising and resource components provide some idea as to how competitive some of the projected close races might become. Sen. Nelson, for example, continues to prove he is in solid shape by every measuring instrument. His $6.057 million cash on hand is more than seven times as great as his closest financial opponent, GOP former interim Sen. George LeMieux. Sen. Ben Nelson (D-NE), commonly viewed as the most vulnerable incumbent seeking re-election, raised only $111,000 more than Attorney General Jon Bruning, but leads his chief Republican opponent $2.916 million to $1.265 million in the cash on hand category.

The competitive race that is proving to be the closest, at least in resources, is the Nevada Senate race. There Rep. Berkley shows $2.476 million compared with Sen. Heller’s $2.272 million cash on hand. This race could turn out to be the most hotly contested in the country. Nevada is a tight swing state, both candidates are equally well-known, and they both possess the same quantity of campaign resources. With turnout expected to be high in the presidential election year, the final wave will likely decide this campaign. The same can be said for the Virginia Senate race. There, former Sen. George Allen (R) has raised $2.615 million with $1.649 million on hand. Tim Kaine, the former governor and Democratic National Committee chairman, has raised a similar, but smaller, $2.266 million but has slightly more in the bank, $1.875 million.

As we know, finance tells only part of any political story, but no one denies that the dollar count is a highly important factor of any campaign effort.

Below is a link to a PDF spreadsheet containing the relevant financial numbers for all 33 Senate races being contested in 2012. The only state not recording any figures is Wisconsin. Sen. Herb Kohl (D) is retiring, and no one has yet formally declared their candidacy for the open seat.

Our Rundown of 23 Former Congressmen and Congresswomen Who May Run Again

At this point, early in the 2012 election cycle, nine former members of Congress have announced that they will run again next year. An additional 14 confirm they are considering mounting another congressional campaign effort, but have not yet made a final decision.

The House Open Seats

As we approach the midway point in the national redistricting process, it is a good time to check the status of the House open seats. Because reapportionment creates a dozen new seats, the incumbent-less district count is already 29. An average election cycle features about 35 open seats, although the last two elections have broken the 40 mark. Should the proposed maps in California and North Carolina pass, at least three more vacancies will be added to the 2012 total. And if Utah Reps. Jim Matheson (D-UT-2) and Jason Chaffetz (R-UT-3) along with Wisconsin Rep. Tammy Baldwin (D-WI-2) run statewide, as they are considering, then three more would be added.

Of the 29 open districts, 12 are new seats, nine current incumbents are running for Senate, two are running for governor, another pair are retiring from politics, one is seeking the U.S. Presidency, and one more is running for mayor of San Diego. Two members resigned their seats; one because of being appointed to the Senate; one due to scandal. Nine of the vacating incumbents are Democrats, six are Republicans. The two vacant seats split evenly, one from each party.

Most of the current seats will stay within the designated party control, but at least six (IN-2, Donnelly; MT-AL, Rehberg; NV-2, Vacant – special election Sept. 13; NM-1, Heinrich; OK-2, Boren; and TX-14, Paul) will likely join the competitive ranks.

With already a large number of open seats in the 2012 election cycle, it would not be surprising to see the total number approach 50 before filing closes in each of the states. Should this happen, added to the 97 members currently serving their first term, a full one-third of the House will have two terms of seniority or less in the next Congress.

The Supreme Court Rules in Nevada’s 2nd CD

The Nevada state Supreme Court late yesterday clarified the state’s special election law. The court agreed, on a 6-1 vote, with the Republican objection to the Democratic Secretary of State’s scheduling of one federal special election to fill a vacancy and awarding all qualified candidates ballot placement regardless of party. The high court ruled that the political parties do have the right to nominate their own candidates.

This means that ex-Nevada Republican Party chairman Mark Amodei, also a former state legislator, will face Democratic state Treasurer Kate Marshall on Sept. 13. The winner will fill the unexpired term of former Rep. and current Sen. Dean Heller (R). Gov. Brian Sandoval (R) appointed Heller to replace Sen. John Ensign (R) when the latter resigned.

The special election will take place in the current NV-2, an expansive district that touches all 17 of the state’s counties. The winner will then run for a full term in the new 2nd district, whose boundaries will become known when the state completes its redistricting process. No map was passed during the regular legislative session, so a court will draw the lines from scratch. The addition of a new 4th district in Las Vegas means that the 2nd will become northern Nevada’s seat.

Nevada Republicans Choose Amodei; Angle Waits in the Wings

The Nevada State Supreme Court will eventually decide if the Republican Party’s action taken this weekend has meaning. The GOP officials held a nominating convention on Saturday to choose a candidate for the 2nd Congressional District special election tentatively scheduled for September 13th.

In what constituted little surprise, former state party chairman Mark Amodei, who spent 12 years as a state legislator and briefly ran for US Senate in 2010, was selected as the Republican congressional nominee by the voting members. He easily defeated state Sen. Greg Brower and former Navy Cmdr. Kirk Lippold on the first ballot.

But, the nomination may become irrelevant. Soon after Rep. Dean Heller (R-NV-2) was appointed to replace resigned Sen. John Ensign (R), Democratic Secretary of State Ross Miller ruled that the special election process would be conducted as an open one-election contest in which all individuals desiring to run would qualify for the ballot. The Nevada Republican Party sued to overturn Miller’s decision, arguing that the ambiguous state election code pertaining to special election process – this is the first federal special election in Nevada’s history – actually allows the political parties to choose their own nominees. A lower court judge agreed with the Republican argument, hence the necessity for the state Supreme Court to become involved. The high court’s only action so far is to say that they may need more time to decide and Gov. Brian Sandoval’s Sept. 13 election date schedule may have to be postponed.

The Nevada Democratic Party has yet to make any move vis-a-vis the special election and now find themselves facing a key decision. Officially backing Secretary of State Miller’s “battle royal” election format concept, the party may now be forced to caucus and nominate a candidate so that Amodei and the Republicans don’t gain a major advantage should the high court uphold the lower court ruling. If the Democrats do convene, state Treasurer Kate Marshall, already an announced congressional candidate, is the prohibitive favorite to receive the official party nod.

But the uncertainty for Amodei, in particular, won’t end with the Supreme Court ruling or even the special election itself. Sharron Angle, the former state assemblywoman who became the GOP 2010 Senatorial nominee only to lose to Majority Leader Harry Reid in the general election, was originally a candidate in the special election but has since withdrawn. She has the luxury of simply waiting for the regular election in the newly drawn seat to run either against a brand new Republican incumbent, now most likely Amodei should the GOP hold the seat in September or whenever the special is actually held, or a Democrat in what should be a Republican-leaning seat under the new redistricting plan.

Nevada’s congressional districts will change significantly because, as the fastest growing state in the nation, a new fourth district will be created as the result of reapportionment. Though the Democratic legislature and Republican governor drew to a stalemate over redistricting, meaning a court will now draw the final map, it is pretty clear that the city of Las Vegas will have two seats, rural Clark County (Las Vegas) and the central part of the state will occupy one, and the northern sector, the heart of the district in question, will comprise the new NV-2. The current district must shed 161,424 people, which is 24% above the new state CD population target of 675,138 individuals.

The winner of the special election will represent the current 2nd congressional district for the remainder of this Congress but will run for re-election in a seat that is considerably different. The area sure to be removed from the new 2nd is the central and southern portion of the seat. Currently, NV-2 encompasses all or part of the state’s 17 counties. The places going to other districts are largely areas where Ms. Angle did not perform as strongly.

Sharron Angle choosing not to participate in the special election is a sound political decision from her perspective. Should she decide to run in the regular election, which is likely, she can continue to amass campaign resources – her ability to do so is an advantage over every other candidate – and can challenge a short-term incumbent, either Republican or Democrat, in a new district that will likely be more to her liking particularly in the GOP primary.

The 2nd district political saga may prove to be the “great unknown” of the 2011-12 election cycle. What we can expect, however, is non-stop political action from here all the way to the next regular general election.

The Angle-less Special Election in Nevada’s 2nd

Sharron Angle, the Tea Party-backed conservative who upset the Republican establishment with her GOP Senatorial primary win last year, abruptly announced that she will not file as a candidate for the Sept. 13 special congressional election in Nevada’s 2nd district. Expressing displeasure toward the electoral system chosen for the early fall vote, Angle said the technical procedures are “…an illegitimate process that disenfranchises the electorate.”

Originally, Democratic Secretary of State Ross Miller ruled that the special election would be open to all, and decided in just one voting contest. Termed a “ballot royal,” Miller copied the system used in Hawaii that features no nomination process. All candidates would have equal access to the special general ballot and the person receiving the most votes, regardless of percentage, wins the seat.

Miller made this ruling for several reasons. Primarily, it is the system that best gives his Democratic Party a chance of capturing the seat. Angle would have been strong within this format because of her solid political base, but so would a unified Democratic Party solidifying behind one candidate. If the Republicans split their votes among several contenders, the analysis showed, the Democrats, limiting their candidates to just state Treasurer Kate Marshall, could successfully steal the Republican-leaning seat.

Republicans objected to Miller’s dictate, saying he wrongly interpreted state election law. The parties themselves, the GOP argued, should be allowed to choose their nominees in caucus, similar to New York’s law, and have just two major party candidates on the ballot. Last week, a lower court judge ruled in favor of the GOP lawsuit saying that Miller’s decision was “unreasonable and absurd.” The Secretary of State and the Democratic Party are appealing to the state Supreme Court.

Candidates were originally to have filed earlier in the week (May 25th), but the judicial ruling forced Miller to extend the candidate declaration deadline all the way through June 30th. The state high court will likely make a ruling before the deadline expires.

It is obvious that Angle believes the Supreme Court will uphold the lower court ruling and allow the state party central committees to choose the special election nominees. She also knows she is not the choice of the Nevada Republican establishment. In her statement, Ms. Angle said she would consider running for public office again and did not eliminate the possibility of competing for the 2nd district in the regular cycle.

Though NV-2 will have a new incumbent before the 2012 general election, it is likely the new 2nd will be more to Angle’s liking. The current configuration in the three-seat state map allows the 2nd to touch all of Nevada’s 17 counties including dominant Clark, home to the city of Las Vegas.

Though the state’s new four-seat congressional map is in limbo today, the basic design seems clear. The Democratic legislature passed a map that had a similar look to the Republicans’ draw, but a far different partisan complexion and it led to a Gov. Brian Sandoval (R) veto. Though further effort was made up until legislative adjournment, the map will end up in court and judges will develop the final blueprint. Since the legislative intent clearly makes two Las Vegas city districts, one rural Clark County seat that stretches to the central part of the state, and a final district, the 2nd, that contains only the northern half of the state with its population anchors of Reno and Carson City, such will likely be the final map’s basis. In the two Democratic maps and one Republican, each used this same fundamental design.

This version will play right into Angle’s hands and may be what’s driving her decision to sit out the special election. Though she will face an incumbent in either the 2012 primary or the general vote, the district will be much different than the one electing the new congressman. So, it is very possible Ms. Angle will come roaring back in the regular cycle.
