Poll: Newsom in Trouble

July 30, 2021 — The University of California at Berkeley’s Institute of Governmental Studies released their latest Golden State survey that finds Gov. Gavin Newsom’s (D) strength in the upcoming recall election dissipating.

According to UC Berkeley, among likely voters, 47 percent would vote to recall Gov. Newsom and 50 percent would not, clearly the closest ballot test result seen to date. The recall election is scheduled for Sept. 14, and voters will first choose whether to remove the governor from office before choosing a replacement among 46 ballot qualified candidates. The replacement candidates’ votes count only if a majority supports removing the subject from office, in this case Gov. Newsom.

The Berkeley poll (July 18-24; 5,795 registered California voters; 3,266 likely California recall election voters, online) finds Newsom in trouble only among likely voters, those screened as almost certain to participate in the recall election. Within the entire polling sample, he returns to safe territory as the respondents break only 36-51 percent for removing him from office.

The major difference is partisanship. The parties, as one might guess, break in polarized fashion. A total of 91 percent of Democrats would vote against the recall while 95 percent of Republicans favor removal.

The independent and minor party sectors become interesting, however. Among the large No Party Preference group, 46 percent would vote to recall Newsom and 50 percent would not. The combined minor parties, which only account for approximately six percent of the electorate are breaking hard for the recall position. Within the minor party segment, 68 percent would vote to remove as compared to only 30 percent supporting the retain option.

Among Republicans, 90 percent say they are enthusiastic about the election, while 58 percent of Democrats say the same. Among the substantial segment in the “No Party Preference” or independent category, 53 percent say they are enthusiastic.

The polling analysis suggests that the governor’s fundamental problem is that Democrats are “almost unanimous” in their belief that he will win the recall election. This substantially explains the Democrats’ lack of solid enthusiasm for the irregular Sept. 14 stand-alone election.

SCOTUS Rules; Calif. Recall Scheduled

July 6, 2021 — On their last day of the year’s early session last week, a Thursday, the Supreme Court of the United States issued rulings on the Arizona voting rights case and the California non-profit organization disclosure lawsuit.

In the Democratic National Committee v. Brnovich, the Supreme Court with Justice Samuel Alito writing for the 6-3 majority, ruled that the state of Arizona did not infringe upon minority voting rights or violate Section 2 of the Voting Rights Act in both prohibiting ballot harvesting with certain exceptions, and not counting provisional ballots cast from voters who do not reside in the particular precinct that the polling place covers.

The high court agreed with Arizona Attorney General Mark Brnovich’s (R) arguments that the laws are not racially motivated, nor do they intentionally discriminate against certain segments of the voting population, thus overturning the full 9th Circuit Court of Appeals ruling.

Originally in 2016, Brnovich won at the district court level and on the first appeal to a three-judge panel from the 9th Circuit. The DNC requested an en banc review of the original appellate ruling that agreed with Brnovich, and the entire 9th Circuit membership overturned the decision, siding with the plaintiff. At that point, AG Brnovich petitioned the Supreme Court, which agreed to hear the case. (Hearing cases en banc allows the full circuit court to overturn a decision reached by a three–judge panel. Due to the decreasing probability of U.S. Supreme Court intervention, the circuit court is often the court of last resort in the ordinary life of a case, thereby amplifying the importance of en banc review.)

In his ruling, Justice Alito stated that “every voting rule imposes a burden of some sort,” and that “mere inconvenience cannot be enough to demonstrate a violation of Section 2.” He also cautioned that, “what are at bottom very small differences should not be artificially magnified.”

While agreeing that holding free and open elections is a “valid and important state interest,” he also addressed the voter fraud argument, clearly stating that attempting to prevent such abuses is also a “strong and entirely legitimate state interest.”

In her article discussing these rulings, Supreme Court expert Amy Howe, in her Howe on the Court article that was published on the SCOTUS blog, offered that the Brnovich ruling “will make it more difficult to contest election regulations under the Voting Rights Act,” and thus likely means fewer voting rights cases coming through the courts. She further categorized this decision as a “major ruling.”

Gov. Newsom’s Vulnerabilities

May 13, 2021 — The University of California at Berkeley’s Institute for Governmental Studies released another of its periodic polls this week, and while it finds Gov. Gavin Newsom (D) surviving the upcoming recall election it also identifies areas of underlying weakness.

According to the survey (April 29-May 5; 10,289 registered California voters with questions asked in English and Spanish, online), Gov. Newsom would win the impending recall vote as 49 percent of the respondents said they would vote to retain him in office and 36 percent support removal. Regarding his job approval and performance on certain issues, however, the poll identifies what could possibly become an opponent’s path to victory.

The Cal-Berkeley result is very similar to another poll conducted within the same time period. Survey USA went into the field during the April 30 – May 2 time segment and interviewed 750 California registered voters of which 642 were identified as likely to vote in the gubernatorial recall election. S-USA found the sampling universe broke 47-36 percent in favor of Gov. Newsom remaining in office, almost identical to Cal-Berkeley’s tally from their much larger online sample.

Cal-Berkeley delved deeper into how the respondent sample was viewing the governor’s job performance and his standing within the electorate, and its results suggest that a focused opposition campaign could yield a close outcome.

Perhaps most troubling to the Newsom strategy team is the question that tested enthusiasm within the electorate. While Democrats were breaking 75-8 percent to retain the governor, the enthusiasm metric showed that only 36 percent of them have a high interest in the election. Another 30 percent fell into a moderate interest level, and 34 percent of the self-identified Democratic voter base said they had little or no interest.

Republicans, on the other hand, registered a 75 percent high interest level, suggesting that their turnout for the eventual election will be much greater. Though Democrats hold a large 46-24 percent party registration advantage, the interest level suggests the eventual election result could fall into a closer range. Among GOP voters, the governor would be ousted in a whopping 85-8 percent margin.

Those registering under the No Party Preference category, who account for another 24 percent of the California voting universe, would retain the governor with a 45-33 percent margin, while the six percent who identify with a minor party break 48-29 percent for removal.

Overall, Gov. Newsom’s job performance improved from Cal-Berkeley’s late January poll and stands at a 52:43 percent positive to negative ratio. In January, the performance ratio was an upside-down 46:48 percent. This is largely due to improvement regarding his handling of the Coronavirus issue, as 45 percent rate his performance as excellent or good, while 35 percent say poor or very poor. Another 16 percent gave him a fair rating, which on this poll seems to indicate a moderate support level as opposed to leaning in a negative direction as some other pollsters characterize the term.

California Recall Getting Interesting

March 17, 2021 — Just days before reaching the recall petition deadline, Emerson College for the Nextar Media Group, an entity that owns several news stations throughout California, conducted a poll regarding the respondents’ predispositions about removing Gov. Gavin Newsom (D) from office.

The poll, conducted March 12-14 of 1,045 registered Golden State voters, finds Gov. Newsom’s position becoming more tenuous as the recall organizers prepare to deliver the last of their petitions today that will likely lead to a removal election.

It appears the proponents have a strong chance of qualifying. Last week, they reported gathering 2.055 million signatures. The minimum number of valid signatures to force an election is 1,495,709, which represents 12 percent of the total number of people voting in the preceding gubernatorial election, 2018 in this case. The organizers say they can withstand a 25 percent rejection rate and still qualify the recall. Of the signatures so far delivered and checked, the acceptance rate is 82 percent, far above the minimum needed to qualify.

According to the Emerson poll, the gap between those who would vote to retain Gov. Newsom and remove him has narrowed. Emerson found 42 percent of the respondents expressing a preference against recalling Gov. Newsom, while 38 percent favor doing so.

One year ago (March 17-18, 2020), 52 percent in a Remington Research Group poll said they would oppose recalling the governor with just 31 percent saying they would vote for removal from office. The University of California at Berkeley in late January of this year, found a 49-36 percent split in favor of retaining the governor. In February, however, a WPA Intelligence survey saw the retain lead dwindling to 47-43 percent. Now, Emerson College posts its 42-38 percent number.

Perhaps the more daunting part of the Emerson poll for Gov. Newsom was the 2022 re-elect question. Here, only 42 percent said they wanted to see him re-elected as opposed to 58 percent indicating they prefer someone different.

On the positive note for the governor, his overall job approval rating is still in positive territory, but just barely (45:44 percent); yet even better, a substantial margin of the sampling universe, 57-43 percent, believe California is on the right track.

Reviewing the House Vacancies

April 2, 2020 — With the COVID-19 virus playing havoc with virtually every aspect of American life, including elections, how are the House vacant seats being affected?

North Carolina Rep. Mark Meadows (R-Skyland/Buncombe County) resigned from Congress Monday night to become White House Chief of Staff, which brings the total number of vacancies to a half-dozen. Special elections are scheduled in four of those, with three to be decided on or before May 12.

Originally, the special elections in Maryland and New York were supposed to be the first to go to the voters, but the COVID-19 precautions changed the date of the New York election and the voting system in Maryland. Former Rep. Kweisi Mfume, who easily won the crowded Democratic primary on Feb. 7, will win the special general on April 28 but the process now becomes all-mail. The Republican nominee is event planner Ken Klacik, but this Baltimore city district and surrounding area will easily remain in Democratic hands. We can expect Mfume to break 75 percent of the vote.

The former congressman was elected to five terms in the House beginning with the 1986 election. He resigned to become president and CEO of the NAACP in 1996. Mfume served in that position until running unsuccessfully for the Senate in 2006, losing the Democratic primary to then-congressman, Ben Cardin. Then-state Delegate Elijah Cummings replaced Mfume in the House at that time and served until his death in October. Now, ironically, Mfume returns to replace the late Rep. Cummings.

California’s 25th District, which begins in the state’s Simi Valley and stretches to the Palmdale area, potentially features the hottest of the current special elections. Rep. Katie Hill (D) resigned the seat because of a sexual scandal leading to a multi-candidate concurrent special and regular election.

Democratic state Assemblywoman Christy Smith topped the field on March 3, and she advances to the special election runoff on May 12 with Iraq War fighter pilot Mike Garcia (R). The latter individual placed ahead of, and eliminated, former US Rep. Steve Knight (R) who was attempting a political comeback after losing to Hill in 2018. Polling is projecting a tight finish. Regardless of what happens on May 12, both Smith and Garcia are advancing to the regular general election to battle for the full term beginning in 2021. The May 12 winner is immediately sworn into the House and serves the remaining part of the current congressional session.

CA-25: Pondering Questions

March 24, 2020 — Political observers are asking many questions about the special election in California’s 25th Congressional District, the seat that former Rep. Katie Hill (D) resigned late last year, particularly after seeing a new ballot test poll enter the public domain.

In the special California primary held on March 3, a dozen candidates, six Democrats and six Republicans, battled one another either to secure majority support or one of two runoff positions for the May 12 runoff vote. Under California election law, if a candidate attracts majority support, the individual would be elected outright to serve the balance of the current term. If not, the top two finishers, regardless of political party affiliation, advance to a runoff election. It is the latter scenario that occurred here.

In addition to the special election, a second vote was held on March 3 for the regular succeeding term. In this contest, 13 candidates were on the ballot, the 12 aforementioned contenders along with Independent Otis Lee Cooper.

Not surprisingly, the two individuals finishing first in the special election also qualified for the general election. They are: freshman state Assemblywoman Christy Smith (D-Newhall) and defense contractor and Iraq War veteran Mike Garcia (R). The election totals in the two contests are somewhat different, however.

The final totals are still not tabulated. According to the Secretary of State’s office, 313,739 ballots statewide remain uncounted with virtually no progress being made last week. In the 25th District, approximately 5,500 votes await counting in order to be added to the published totals. The final tabulation will not change the first- and second-place finisher status, however.

Interestingly, despite the special and regular vote being held at the same time and on the same ballot, almost 4,000 more people voted in the special election than in the regular primary. Percentage-wise, approximately 39 percent of the district’s registered voters cast a ballot in the special while 38 percent did so for the regular primary. Statewide, the turnout measured just under 45 percent of the registered voters for the regular primary that included a contested Super Tuesday presidential vote.

Rep. Walden to Retire; Ex-Rep. Knight to Return

Oct. 30, 2019 — Veteran Republican US Representative Greg Walden (R-OR) joined the growing group of House members to announce that his congressional career will come to an end. Rep. Walden issued a statement Monday indicating that he will not seek a 12th term in office. OR-2 becomes the 30th open seat. There are now four vacancies in the House.

The veteran congressman, first elected in 1998, is the ranking Republican member on the House Energy & Commerce Committee, a panel he chaired while the GOP held the majority. He is also a past chairman of the National Republican Congressional Committee.

Oregon’s 2nd District is the only Republican seat in the Beaver State. It occupies 19 eastern counties and part of one other. The land mass covers three-quarters of the state and houses the two larger population centers of Jackson and Deschutes Counties, which contain the cities of Medford and Bend, respectively.

The Census Bureau indicates that the 2nd District now contains over 830,000 people, over 100,000 more people than originally constructed in 2011. In fact, all of the Oregon districts are now approximately this size, which explains why the state looks to be gaining an additional seat in congressional reapportionment.

Walden won 11 elections in the 2nd and has averaged 68.7 percent of the vote over his 11 victorious federal campaigns. The only time he dropped below 61 percent of the vote occurred last November when he was re-elected with 56.3 percent.

President Trump carried the district in 2016 with a 57-37 percent margin. Four years earlier, Mitt Romney notched a similar 57-41 percent victory spread. John McCain won 54-43 percent in 2008. Therefore, this seat should easily remain in Republican hands, but first the candidate fields must develop for both parties.

The district touches eight state Senate and 14 state House seats. Seven of the eight Senate seats are Republican held. In the House, the GOP advantage is twelve to two. We can expect several of these legislators to enter the open House race and what is likely to be a large number of local officials from the expansive regions.
