The Senate Scorecard

With most of the primary season now behind us and all of the Senate match-ups in place, sans Arizona and Wyoming, it’s time to examine the national outlook.

After seeing several competitive primaries decided in the past several weeks, we now sit on the cusp of the final short sprint to Election Day with Senate control still considered to be in “toss-up” mode. As we know, 33 Senate races are standing for election in November with 11 of those seats being open due to retirement and defeat, thus giving more conversion opportunities for each side. Of the 33 Senate races, a little under half of them are considered safe for the respective incumbent and, according to our count, six of the races are rated as toss-ups (Ind., Mass., Mo., Mont., Va., and Wis.).

If the Democrats were to win all of the “lean Dem” and toss-up races, and Independent former governor Angus King clinches the Maine race and decides to caucus with them, the Senate Democrats would actually add a net of three seats to their conference, bringing the total majority number to 56. Early in the election cycle it looked extremely unlikely that the Democrats would pick up any seats, however, as this year has unfolded, more Republican-held seats have come into play and some of the Democratic seats initially thought to be potentially vulnerable like Connecticut, Washington, and Pennsylvania are all trending more solidly leftward. Democrats also are in much better shape in North Dakota, as former attorney general Heidi Heitkamp continues to perform well against at-large Rep. Rick Berg (R), who began the race as a big favorite.

Conversely, if Republicans sweep the toss-ups and “lean R” races they would have a net gain of eight seats, bringing their total to 55 seats, even if King wins and caucuses with the Democrats. Thus, 56D to 55R appear to be the extreme swing parameters for the two parties.

While most political pundits still can’t say with any certainty who is going to control the Senate come January, it is becoming obvious that the ratio will be close. Neither party has so far broken out with the kind of drive to create a sweep, and several other campaigns have unfolded differently than originally predicted. It seems when one party makes a gain or falls behind, the other experiences a similar action, thus keeping the balance between the two in check.

For example, the political climate has become better for Republican candidates in Nebraska and Florida, while Democrats are approaching lock-down positions in Connecticut and Washington.

In the Cornhusker State we see that former senator Bob Kerrey’s return to politics after a 12-year absence while living in New York City has not been well received. GOP nominee Deb Fischer consistently holds polling leads that exceed the 18-20 point range. The best poll, from a Nebraska Democratic perspective, is the June Garin Hart Yang survey that put Kerrey within 12 points of his Republican opponent.

Turning to the Sunshine State, two-term incumbent Sen. Bill Nelson, who has a substantial campaign resource advantage over his new official Republican opponent, Rep. Connie Mack IV (R-FL-14), fresh from his solid primary victory earlier in the week, has failed to establish a firm lead. Polling consistently shows this race moving much closer to toss-up status, and while Sen. Nelson maintains a slight advantage, his edge is minimal and this campaign is quickly becoming as hot as a typical Florida summer.

In Connecticut earlier this week, GOP primary voters, by an overwhelming 73-27 percent margin, again fielded their losing 2010 candidate, former wrestling company executive Linda McMahon, this time to compete against newly nominated Rep. Chris Murphy (D-CT-5). The two are vying for retiring Sen. Joe Lieberman’s open seat. In recent polling, Murphy has opened up a strong lead when paired against McMahon. Former Rep. Chris Shays (R-CT-4) consistently polled better in general election match-ups with Murphy, but he fared poorly in his nomination battle. With President Obama sure to run well in Connecticut and thus setting the tone for the entire Nutmeg State Democratic ticket, Rep. Murphy has established himself as the clear front-runner. Seeing him fall would now be considered a major upset.

Sen. Maria Cantwell, who serves the Evergreen State of Washington, has historically not been the most popular of incumbents. Her re-election prospects have improved considerably, however, since drawing a second-tier opponent in the person of state Sen. Michael Baumgartner. The senator placed almost 26 percentage points ahead of Baumgartner in the jungle primary earlier this month. While Washington originally had the potential of becoming a competitive race, Sen. Cantwell has considerably strengthened her position and this contest is virtually out of reach for the GOP.

As Election Day draws nearer, we continue to see a Senate that is still very much in play for both parties. Right now, it appears the Democrats are safe, likely, or lean winners in 18 states, while Republicans have that same status in nine. This means the Democrats are hovering around the 48 mark and the GOP is closer to 46. Of the six toss-ups, Democrats currently hold four states and Republicans two. Remember, Democrats must defend 23 of the in-cycle seats versus just 10 for their counterparts.

King Leading in Maine Poll

A new MassINC Polling Group political survey (June 13-14; 506 likely Maine voters for television station WBUR) gives Independent former governor Angus King a huge 50-23-9 percent lead over newly nominated Republican candidate Charlie Summers and Democrat Cynthia Dill, respectively.

The Maine Senate race could become nation’s most important, because there are two scenarios where King alone would decide if Republicans or Democrats control the majority in the next Congress, should he be elected. To date, the former governor, though a liberal, has not committed to joining either party. Should President Obama be re-elected and Senate Republicans reach 50, King caucusing with either side would make that party the majority. The same would be true if Mitt Romney unseats the President and the Democrats claim 50 seats.

State Sen. Dill has the most difficult path to victory in the three-way scenario. According to the MassINC data, Democrats choose King 60-17 percent over the now-official Democratic nominee. Interestingly, his mark among Democrats is even better than within the Independent sample cell. Of those claiming to affiliate with neither party, King records 57 percent. Though his margin is strong, it is not insurmountable, particularly in a three-way race. Gov. Paul LePage (R) was elected from a similar configuration two years ago with just 37.6 percent of the vote. If the Senate majority truly reverberates on Maine’s outcome, then expect the race to become heated as Election Day nears.

A Look at Key June 12 Results

In addition to the Arizona election noted in our previous blog post, several key states hosted primary and run-off elections last night. Two Democratic run-offs were held in Arkansas, and freshman incumbent Rick Crawford (R-AR-1) and open-seat nominee Tom Cotton (R-AR-4) now have official Democratic challengers.

In the 1st District, a seat made even more Democratic in redistricting, District Attorney Scott Ellington slipped past state Rep. Clark Hall 51-49 percent, despite the latter having the financial advantage. This will be an interesting contest since the 1st District is even more Democratic, but Arkansas figures to be one of President Obama’s worst states. The evolution of this campaign will be worth watching.

In retiring Rep. Mike Ross’ 4th District, state Sen. Gene Jeffress romped to an easy 61-39 percent win, despite primary first place finisher Q. Byrum Hurst outspending him. Jeffress will now face Cotton in the general election. Despite the lopsided run-off win last night, this district is a prime GOP conversion opportunity.

In Maine, state Sen. Cynthia Dill (D) scored a strong 45-35-12 percent victory over former secretary of state Matt Dunlap and state Rep. Jon Hinck, respectively. Dill will face the GOP winner, former secretary of state Charlie Summers, and Independent former governor Angus King. In Dill, the Democrats have a candidate who will run a credible campaign, which, ironically, will help Summers. The only way the Republicans have a chance in a Maine statewide race is to win a close three-way race, and the groundwork is now laid for such a contest. King is still the overwhelming favorite, but it is the Dill campaign that will now help determine how this race progresses in November. This campaign has the potential of becoming quite interesting.

The North Dakota Republican electorate chose a congressional nominee different from the party-endorsed candidate. Former at-large congressional nominee Kevin Cramer upended public service commissioner and Republican convention-endorsed candidate Brian Kalk by a 55-45 percent score. Cramer will face former state representative Pam Gulleson who was unopposed for the Democratic nomination. He now becomes the prohibitive favorite to win the open seat in the November election.

In South Carolina’s new 7th District, as expected, former lieutenant governor Andre Bauer and Horry County Commission Chairman Tom Rice advanced from the primary and will decide the Republican nomination in a June 26 run-off election. Bauer placed first with 32 percent of the vote as compared to Rice’s 27 percent, but the former’s margin may not be enough to hold the lead in the secondary campaign. On the Democratic side, former Georgia state representative Gloria Tinubu scored an outright 52 percent win over attorney Preston Brittain and three others. Tinubu resigned her seat in the Georgia legislature earlier in the year to come to South Carolina and run for the state’s new congressional district, an unusual situation to say the least. The Republican nominee will be the heavy favorite to win the seat in November.

Finally, in Virginia, former senator George Allen (R) was renominated with a somewhat disappointing 66 percent of the vote for the right to reclaim the seat he lost six years ago. The ex-senator defeated three minor GOP candidates. Allen will now face former governor Tim Kaine (D) in a general election campaign that promises to go down to the wire.

A Skeptical Look at Maine’s MPRS Poll Results

The left-wing Maine People’s Resource Center released their new survey (March 31-4/2; 993 registered Maine voters) of the state Senate and House races with results that are, let’s say, susceptible to a reliability scrutiny. Since the newly open Senate contest is of critical importance in determining which party will control the majority in the next Congress, it is this campaign that demands the most analysis.

According to MPRC, Independent former Gov. Angus King is staked to a commanding lead in the hypothetical general election ballot test. In the one intra-party match-up surveyed, King leads Secretary of State Charlie Summers (R) and former Secretary of State Matt Dunlap (D) by a whopping 56-22-12 percent margin, respectively. But, the poll appears to have methodology flaws.

Angus King, after developing some statewide name identification as the Maine PBS spokesman, was elected governor in 1994 as an Independent and easily won re-election four years later. He established himself as a liberal, but also as someone who will take conservative positions under certain circumstances. For example, he endorsed George W. Bush for President in 2000, but backed Democrat Barack Obama in 2008.

King has said several times that if elected to the Senate he may not caucus with either party, but will do what “is in the interest of the people of Maine.” He further said that he will caucus with the Democrats on some issues and the Republicans on others. He will eventually come to the conclusion, as both senators Bernie Sanders (I-VT) and Joe Lieberman (I-CT) have publicly advised him, that he cannot succeed without caucusing with one of the major parties for organizational purposes, including the rendering of committee positions. King will also realize that having such assignments will be “in the interest of the people of Maine,” so expect him to join the Democratic conference.

Returning to the Maine People’s Resource Center poll, the data appear to have two principal problems. First, the sample is tilted in favor of the Democrats, and the methodology description admits the result data is not weighted to reflect an accurate political party dispersion. Of those polled, 39 percent are Democrats, 29 percent Republicans, and 31 percent Independents. Considering that the actual Maine electorate divides into a 32 percent Democratic-28 percent Republican split, with 37 percent Independent (officially labeled as “unenrolled”), the polling sample is unbalanced.

Secondly, the MPRC general election ballot test is only asked with Mr. Dunlap as the hypothetical Democratic nominee. But, even in their own poll of Democratic primary contenders, state Sen. Cynthia Dill outperforms the former secretary of state 20-17 percent. Therefore, to only test the second-place finisher against the top-performing Republican and King unfairly skews the results away from the Democratic Party ballot position even though it is they who have the greater number of respondents.

MPRC also tested the state’s two House races, which are now more conventional campaigns since neither Reps. Chellie Pingree (D-ME-1) nor Mike Michaud (D-ME-2) are seeking their party’s Senatorial nomination. According to the study, Pingree leads state Senate Majority Leader Jon Courtney (R) by a huge 61-28 percent count. This finding, too, is likely skewed in Pingree’s favor especially when contrasting her 2010 re-election result (55-42 percent) in virtually the same district.

The ME-2 campaign is expected to be more seriously contested because the Republicans are fielding state Senate President Kevin Raye as their candidate. Raye ran for the seat when it was last open in 2002 and lost to Michaud 52-48 percent. According to this latest data, the Congressman leads 53-37 percent. Again, considering the sample skew, it is virtually certain that the incumbent has a substantial lead, but it is reasonable to conclude that this poll probably skews it a few points more in his favor than what is the actual margin.

The Maine Event: Michaud Out, Pingree In?

Rep. Mike Michaud (D-ME-2), despite being the first person to begin circulating US Senate nominating petitions in the wake of Sen. Olympia Snowe’s (R) retirement announcement, said last night that he will not run statewide but is seeking re-election to his 2nd District House seat. According to high-level Democratic insiders, Rep. Chellie Pingree (D-ME-1) will run for the Senate.

This is a surprising move since Michaud was quick to jump into the race and seemed to be the most committed of the potential Democratic candidates. But Pingree is far from home-free in the battle for the Senate nomination. Former Gov. John Baldacci, who spent four terms in the House before winning his statewide election in 2002, also has begun to circulate nominating petitions for the Snowe seat. His entry would mean a very expensive and potentially bloody Democratic contest.

Though the Republican field of candidates is slow to form, another possible candidate is lurking in the background and has the luxury of waiting. Independent former Gov. Angus King, who served as Maine’s chief executive for the eight years preceding Baldacci’s two terms in office, says he is seriously considering running. His advantage as an Independent candidate is not having to file until June. Currently, unless the legislature takes action on Gov. Paul LePage’s (R) suggestion to extend the filing deadline, the major party candidates must return their qualification papers by March 15. The extended period would give King ample time to determine the strength of both the Democratic and Republican candidates before making a final decision whether to become a candidate.

Another ramification from Michaud’s decision is that several other Democratic politicians may again have to reverse course. Former Secretary of State Matt Dunlap had announced his Senate candidacy long before Ms. Snowe decided not to run. When Michaud jumped at the open Senate seat, Dunlap immediately turned around and began circulating petition signatures in what he thought was an open 2nd Congressional District. State House Minority Leader Emily Cain (D), who ruled out a Senate run long ago, also jumped into the 2nd District race when she heard Michaud was vacating. Same for ex-state Sen. Bruce Bryant. With Michaud back in the House race, all of these individuals are placed in an uncomfortable political box.

Republicans began moving toward the 2nd District race, too. Kevin Raye, the state Senate president who lost to Michaud when the seat was last open in 2002, had already announced his congressional campaign even before the seat came open for two days. Speculation has been rampant, however, that he might declare for the Senate upon Snowe’s retirement decision. Michaud returning to the House race may lead to that eventuality for Raye. State Sen. Debra Plowman and 2010 nominee Jason Levesque also hopped into what they thought was an open House seat race. It remains to be seen how many of these Republican contenders stay in the congressional race, now that it is back to challenger status.

But the statewide race becomes all the more interesting with the latest developments. Michaud is a better fit for the state because he doesn’t take as extreme ideological positions as Pingree, the former national president of Common Cause. Should King enter as an Independent, and the Republicans field a viable candidate, such as Raye, perhaps, the general election takes on a whole different feel. King is truly independent, holding positions that at times are favorable to both Democrats and Republicans. He endorsed, for example, George W. Bush in 2000, but went with John Kerry in 2004. He followed with an endorsement of President Obama in 2008. Such a scenario would lead to a tight three-way campaign.

The developments during this past week has turned Maine politics on its head. While Democrats begin the open Senate race in the favorite’s position, Republicans are certainly viable, most likely in the person of state Senate Majority Leader Jon Courtney, in Pingree’s open 1st District, though the seat leans decidedly Democratic. Still, Maine voters are known for their independent streak.

All of a sudden, what appeared to be a very quiet political year in the Pine Tree State is now anything but that.

Ins and Outs

California: Well, the expected finally happen. Sixteen-term Rep. David Dreier (R-CA-26), chairman of the House Rules Committee, announced that he will not seek re-election this year. When the California Citizens Redistricting Commission split his district into seven parts, there were few viable re-election options available to the long time incumbent. It became inevitable that Mr. Dreier would end his long congressional career rather than run when entombed in a hopeless political situation.

Because he was technically paired with Rep. Grace Napolitano (D-CA-38) in the new 32nd District, the retirement does not lead to any new open seat. Mr. Dreier becomes the 38th sitting member to make public his intention not to return to the House when his current term expires. Twenty-two of the 38 are Democrats, 16 are Republican. Twenty-four are opting for retirement, while 14 are seeking a different political office.

Maine: In other news, Rep. Mike Michaud (D-ME-2) has taken out nominating papers to run for the Senate now that incumbent Olympia Snowe (R) is retiring. Maine’s other House member, Rep. Chellie Pingree (D-ME-1) is said to be considering a run. Should they oppose each other in the Democratic primary, a host of people on both sides of the aisle appear poised to enter open congressional races.

Gov. Paul LePage (R) is indicating that he will ask the state legislature to pass a bill extending the petition gathering deadline past March 15. No less than 2,000 valid registered voter signatures are required to run statewide in Maine. LePage is suggesting that Sen. Snowe’s late retirement announcement is not giving potential candidates adequate time to decide whether to run, and then circulate petitions. Much more to come on what is shaping up to be a wild campaign ride in the Pine Tree State.

Snowe’s Retirement a Blow to Republicans

In perhaps bigger news that Mitt Romney’s Tuesday wins in Michigan and Arizona, three-term Sen. Olympia Snowe (R-ME) sent shock waves through the political world by announcing that she has decided not to seek re-election in the fall. Despite high favorability and poll ratings, Snowe indicated she is leaving the Senate at the end of the term rather than serve in a Republican caucus that is trending far to the right of her individual ideological perspective.

The retirement is a blow to Republican chances of regaining the Senate majority, as the Maine seat appeared secure. Without Snowe in the race, Democrats become the favorites in an open seat race.

Expect Reps. Chellie Pingree (D-ME-1) and Mike Michaud (D-ME-2) to give serious consideration to running, as might former Gov. John Baldacci (D). Republican Gov. Paul LePage also has to be considered a strong potential candidate, but he has given no early indication that he will run.

Because Maine has a penchant for electing Independents in statewide contests, one also must consider who could run without being associated with a major party. Former two-term Independent Gov. Angus King would top this list of potential contenders.

Sen. Snowe becomes the 10th Senator to retire at the end of this Congress, meaning that 30 percent of the 2012 in-cycle seats will be open. Of the 10 upcoming vacancies, six are currently held by Democrats, one by an Independent who caucuses with the Democrats (Sen. Joe Lieberman), and three Republicans.

Romney Squeaks by in Maine

Mitt Romney won a close Maine caucus victory over Ron Paul over the weekend, edging the Texas congressman 39-36 percent – a margin of just 196 votes. Rick Santorum, fresh from his sweep of the non-binding Missouri primary and Colorado and Minnesota caucuses, only managed 18 percent. Newt Gingrich was fourth with 6 percent.

Turnout for the Maine caucuses was typically small. Only 5,585 people participated, but that number is actually higher than 2008; four years ago 5,431 people attended the Republican caucuses.

Romney and Paul will likely come away from this latest presidential nominating contest with eight delegates apiece. Santorum appears to have notched four and Gingrich one. Three at-large party delegates remain uncommitted. As in most caucus states, the delegates will be officially apportioned at the district and state party convention, which, for Maine, will be held over the May 5-6 weekend.

The results underscore Santorum’s fundamental campaign problem. Due to a lack of resources that prevent him from organizing in all of the states, the former Pennsylvania senator has been unable to capitalize on his strong performance in Iowa, and then in the three venues last week. This flaw likely costs him the ability to overtake Romney. In fact, the financial and organizational advantages Romney possesses likely will be enough to outlast all others in the field.

The campaigns now move onto the Arizona and Michigan primaries, which are scheduled for Feb. 28.

State-by-State House Race Review

With several more states completing their redistricting maps, it is again a good time to take an updated look at the competitive campaigns where district boundaries have been adopted. The first 12 states are covered below. The remaining dozen will be in Wednesday’s report. If the Texas court map is released this week, that analysis will be included, too.

As of now, the aggregate partisan swing pertaining to the states that have completed their maps is negligible. The remaining 14 multi-district states where the process has either not begun or isn’t complete, as well as the new Texas map, could favor the Democrats by the tune of 10 to 12 seats.

Alabama

All incumbents received winnable districts. Rep. Mike Rogers’ (R-AL-3) district was greatly improved from his perspective. The Alabama map still awaits Justice Department pre-clearance. Assuming it is granted, no partisan change is expected here.

Arkansas

The new lines most greatly affect the 1st and 4th districts. Freshman GOP Rep. Rick Crawford faces a difficult test in the new 1st District, which was made more Democratic. The retirement of Rep. Mike Ross (D-AR-4) makes the new 4th CD highly competitive in an open seat situation and is a GOP conversion opportunity. The swing will fall between R+1 and D+1.

California

The California Independent Redistricting Commission created a highly competitive map that could produce contested campaigns in as many as 23 of the 53 districts. The change in the state’s election law also adds a new twist to California campaigns. Now, the top two finishers in the June qualifying election advance to the November general regardless of party affiliation.

Among incumbents, Rep. David Dreier (R-CA-26) whose home was placed in new District 32, faces the most difficult re-election situation. He won’t run in CA-32 against Rep. Grace Napolitano (D) because the seat so heavily favors the Democrats. He could run in District 31, assuming Rep. Jerry Lewis (R) does not seek re-election there, or District 26 if Rep. Elton Gallegly (R) decides to challenge Rep. Buck McKeon (R) in the new 25th District. Neither scenario is positive for Dreier.

Several members are paired. The most notable are Reps. Howard Berman (D) and Brad Sherman (D) in the new Los Angeles County 30th District, and Reps. Ed Royce (R) and Gary Miller (R) in the new 39th District (Orange County). Should Gallegly and McKeon square-off in the new 25th, then another incumbent pairing will result.

With members still deciding where, or if, to run in 2012, the California situation is still unclear. It appears the statewide swing can go all the way from +3 Democrat to +3 Republican. After only seeing one incumbent of either party lose during the entire last decade, the new congressional redistricting map will make the Golden State one of the more hotly contested states in the country.

Colorado

The new court-produced map changes the competition factor. The plan makes the 4th District of freshman Rep. Cory Gardner (R) more Republican, but endangers sophomore Rep. Mike Coffman (R-CO-6). The western slope 3rd District remains in the swing category. The partisan swing could go from even to D+2.

Georgia

The state gained one seat in reapportionment, and Republicans adding that seat to their column is a certainty. Rep. John Barrow (D-GA-12) will face a more competitive re-election contest, but the large African-American percentage is his greatest asset and may be enough to save him. The swing could go from R+1 to R+2. Rep. Paul Broun (R-GA-10) was given a relatively safe Republican seat, but a much different one than his current district. A primary challenge here is a possibility. Like Alabama, Georgia awaits Department of Justice pre-clearance.

Idaho

The redistricting commission made only cosmetic changes in the state’s two congressional districts. Both Republican incumbents have winnable districts.

Illinois

This is the Democrats’ best state. The partisan swing could be as many as a D+4. Reps. Bob Dold (R-IL-10), Judy Biggert (R-IL-13), and Bobby Schilling (R-IL-17) all have difficult re-election challenges. Reps. Joe Walsh (R-IL-8) and Randy Hultgren (R-IL-14) are paired in the new 14th CD. Reps. Adam Kinzinger (R-IL-11) and Don Manzullo (R-IL-16) are paired in the new 16th.

Indiana

Republicans drew the Hooiser State map and are attempting to increase their 6-3 delegation advantage to 7-2. They might be successful, since 2nd District Rep. Joe Donnelly (D) decided to forego re-election in a more difficult seat and is running for the Senate. Though the 2nd District is more Republican, it is still competitive as President Obama scored 49 percent even within the new boundaries. By making IN-2 more Republican, the 8th District of freshman Rep. Larry Bucshon (R) becomes more competitive. The map improved, from a Republican perspective, freshman Rep. Todd Young’s (R) 9th District. The swing could go from R+1 to D+1.

Iowa

The new four-district map largely displaces all five current House incumbents. The loss of a seat in reapportionment causes the pairing of Reps. Leonard Boswell (D-IA-3) and Tom Latham (R-IA-4) in the very different and marginal new 3rd District. This race will be a toss-up all the way to Election Day. The new western Iowa 4th District is also competitive. Rep. Steve King (R) faces Christie Vilsack (D), the wife of former governor and current US Agriculture Secretary Tom Vilsack. The swing could go from R+1 to D+1.

Louisiana

Reapportionment costs the state one district and even though Republicans control the entire process, they will lose a seat. The new map pairs veteran Rep. Charles Boustany (R-LA-7) and freshman Jeff Landry (R-LA-3) in the new 3rd District. Boustany is favored. All of the other incumbents should be safe. With the GOP taking the reapportionment hit, the partisan swing becomes D+1 by default.

Maine

Another two-district state where little change will occur. After an attempt to make the 1st District more Republican, the final plan protects the state’s two Democrats, Reps. Chellie Pingree (D-ME-1) and Mike Michaud (D-ME-2). No change is expected here.

Maryland

The Democrats, in full control of the redistricting process, made the Republicans pay. The resulting plan will very likely increase their 6D-2R delegation split to 7D-1R. Rep. Roscoe Bartlett’s (R) 6th District goes from 57 percent McCain, based upon the 2008 presidential contest, to 62 percent Obama, thus becoming a likely Democratic conversion district. All other incumbents, including freshman GOP Rep. Andy Harris (R-MD-1), get safe seats. The partisan swing is D+1.

Redistricting action occurred in the following six states during the past week:

MAINE (current delegation: 2D) – Gov. Paul LePage (R) signed the compromise congressional map that makes only minimal changes in the existing plan. The city of Waterville switches to the 1st District from the 2nd, and other cosmetic changes comprise the recorded alterations. Even though Republicans control the entire legislative process, redistricting legislation requires a two-thirds vote of both chambers. Therefore, the “no-change compromise” map was adopted to avoid a protracted court battle. Democrats will retain both seats.

MARYLAND (current delegation: 6D-2R) – As we move closer to seeing a map proposal coming from the Democratically controlled legislature, rumors continue to fly. Last week, it appeared that the Dem leaders were going to carve up Rep. Roscoe Bartlett’s (R) 6th District but allow the GOP 1st District to stand. Now, it seems an effort is being made to draw an 8D-0R map, which means breaking up both Republican seats into multiple parts. Though the Eastern Shore would reportedly remain intact in CD 1, more Democratic Western Shore areas in and around the Annapolis area will be added. The proposed plan will soon be made public. Democrats control the entire process, so it is likely they will try for the 8-0 sweep.

NEW YORK (current delegation: 21D-8R; loses two seats) – Gov. Andrew Cuomo (D) has repeatedly said he would only sign a redistricting plan that was developed by an independent commission that he wanted the legislature to create. Now, he is sending signals that he would be open to a bi-partisan legislative compromise. He made statements to the media this week that he feels a court-drawn map would not be in the common interest of the New York citizenry. Expect the New York map to be one of the last enacted plans.

OHIO (current delegation: 13R-5D; loses two seats) – Gov. John Kasich (R) signed the legislation creating the new congressional redistricting plan. The map is designed to elect 12 Republicans and four Democrats, creating a new Columbus D seat and pairing the remaining minority party members together. Republicans Mike Turner (R-OH-3) and Steve Austria (R-OH-7) are also paired in the new 10th District. Ohio is now the 20th state to enact its congressional redistricting plan.

Fifteen maps are now law, with five more still before the Justice Department awaiting preclearance. Another four states await court action as their legislative process resulted in deadlock. The five remaining independent commissions will likely complete their combined work by early next year at the latest. So will at least two other states. This leaves a dozen late primary states to complete their processes next year. Congressional redistricting must occur in the 43 states that have more than one seat in the House of Representatives.

TEXAS (current delegation: 23R-9D; gains four seats) – As predicted by many, the new Texas congressional and state House maps will not likely pass the legal test. The San Antonio court hearing the consolidated lawsuits just indicated that it will draw an interim map while the legal process continues. This means a different map than enacted will now almost assuredly be inserted for the 2012 elections. The court has asked all parties to make their submissions for a replacement map by October 17th. The 2012 candidate filing period for the March primary begins on Nov. 17, so a new 36-district plan must be in place by at least that time. The Republican-enacted map appears to be a 26R-10D map.

Expect the court to draw a plan more favorable to the Democrats. Texas by-passed the Department of Justice and filed their preclearance submission with the District of Columbia Federal District Court. Since no decision has yet been rendered, the entire map can be re-drawn by the court of jurisdiction and not just the legally affected regions. Lawsuits were originally filed on minority group issues in and around the San Antonio-Austin area.

UTAH (current delegation: 2R-1D; gains one seat) – The appointed redistricting committee passed a plan to be considered in the special legislative beginning this week in Salt Lake City. The committee developed a map that could easily give the GOP a 4-0 sweep of the next delegation, a group that reapportionment increases by one member from its current three-seat configuration. Apparently Gov. Gary Herbert (R) is not particularly receptive to this plan, however, as he has made public statements reiterating his desire for a “fair” plan. Most interpret his statements to mean that he does not consider the legislative starting point to be acceptable.

His motives may not be purely altruistic, however. Without a district in which to run, Rep. Jim Matheson (D-UT-2), a long-time proven vote-getter in an overwhelmingly Republican congressional district during the last decade, would then be free to run statewide. The congressman says he will be on the 2012 ballot, but he has yet to decide for which office. He has not ruled out a run against Herbert or opposing Sen. Orrin Hatch (R). In reacting to the new map, Matheson was quoted as saying he could run in the new 2nd District or even in the new 4th CD, which is designed to occupy part of the Salt Lake City region in the center of the state. The Utah plan, with its many political sub-plots, continues to be one of the more interesting situations to observe. Expect the process to culminate within the next two weeks.
