Upward Mobility

Even at this early point in the 2014 election cycle, a grand total of 32 House members have either indicated they will run for another office or are mentioned as considering doing so. Below is a listing:

  • Arkansas – Rep. Tom Cotton (R) – reportedly moving toward a challenge to Sen. Mark Pryor (D), but has yet to finally decide.
  • Georgia – The free-for-all to replace retiring Sen. Saxby Chambliss (R) is touching a large number of Georgia House delegation members.
    • Rep. John Barrow (D) – has twice publicly said he has no plans to run for Senate, but may now be changing his mind. He is reportedly pressuring Democratic Party leaders to help clear the primary field so he has the maximum amount of time to raise general election funds without the pressure of a primary.
    • Rep. Sanford Bishop (D) – though he has received little coverage about a possible Senate bid, Mr. Bishop has reportedly been telling people in his 2nd District that he is seriously considering running for the seat.
    • Rep. Paul Broun (R) – announced Senatorial candidate
    • Rep. Phil Gingrey (R) – Georgia political insiders rate him as “very likely” to run for Senate.
    • Rep. Tom Graves (R) – announced that he will not run for Senate.
    • Rep. Jack Kingston (R) – clearly making moves to run for the Senate but has been known in the past to shy away from taking political chances. Today, he is a likely candidate, but that may change when next year’s filing deadline approaches.

New Landrieu Polling

Public Policy Polling recently surveyed a Louisiana (Feb. 8-12; 603 registered Louisiana voters) sampling group for purposes of testing three-term Sen. Mary Landrieu’s (D) re-election viability. What they found is a senator who leads all of her potential Republican opponents, but only by close or relatively close margins. Ironically, it is the individual most likely to run, Rep. Bill Cassidy (R-LA-6), who appears to be in the weakest position.

On the job approval front, Sen. Landrieu scores a very mediocre 47:45 percent positive to negative, but this is a big improvement over PPP’s last poll (August 2010) when she was upside down to the tune of 41:53 percent.

Boustany Wins in La., and Why

Just as Republican state legislative leaders had designed when using their redistricting mapping software early in the year, Rep. Charles Boustany (R-LA-7) easily defeated freshman Rep. Jeff Landry (R-LA-3) in the new 3rd Congressional District, winning a 61-39 percent victory on Saturday.

The Map

Louisiana dropped a Congressional seat in national reapportionment, and even though the Republicans controlled the redistricting pen, it was obvious that their own party would lose a seat. As is typical of these situations, it was the freshman member who was put in the expendable position.

Prior to reapportionment, Louisiana had seven Congressional seats, six Republican and one Democratic. Since the New Orleans-anchored 2nd CD is a Voting Rights Act protected district, the Republicans had no other choice but to forfeit a seat. Thus, Rep. Landry’s southern state district that legislative leader Billy Tauzin, the former Energy & Commerce Committee chairman, once held was broken into pieces. Even though 7th District incumbent Boustany was placed in the pairing with Landry, the contest was never intended to be fair.

Boustany’s 7th District territory comprised 76 percent of the new 3rd CD, and included the congressman’s home and political base of Lafayette Parish. Landry’s New Iberia Parish domain was also transferred to the new 3rd, but the final configuration only contained 24 percent of his constituency. In the end, the district performed as intended. Each candidate racked up landslide proportions in their current regions, but Landry, having so little familiar turf, could not overcome the programmed disadvantage.

The Results

Boustany carried seven of the district’s 10 parishes, including Lafayette (71 percent), in the range of 68-75 percent. Landry took the three parishes from his former district, also in a similar percentage spread, winning New Iberia with a 70-30 percent margin and the other two parishes with 65 and 67 percent of the vote.

Louisiana also has a unique election system. Using their traditional “jungle” primary format where all candidates appear on the same ballot irrespective of political party affiliation, the state chooses to schedule their qualifying contest concurrently with the national general election. That way a majority of the vote elects the candidate obtaining such, and a run-off between the top two finishers scheduled for early December is held if no one tops 50 percent. Nationally, this makes at least some of Louisiana’s federal races the last to be decided.

Though Boustany finished first on Nov. 6th, his 44 percent total was well short of a majority, hence Saturday’s run-off. Only 19.3 percent of the district’s 500,592 registered voters participated in the run-off election, meaning 96,584 total votes were cast. Of that number, 16,835 people took advantage of the early voting option, meaning 82.6 percent of voters went to the polls this weekend.

The Future

Considering Louisiana’s tradition of not defeating incumbents of either party, Boustany can count on representing this seat at least until the end of the current decade. But, we may not have seen the last of Landry, either. Speculation was beginning to surface that, if he lost this run-off battle, we would see him enter next year’s Senate race against three-term incumbent Mary Landrieu (D). It is widely believed that Rep. Bill Cassidy (R-LA-6) is planning a Senatorial campaign, but this may not matter in the least to the now-defeated Landry.

House Happenings

Some district updates from around the country:

LA-3

The final 2012 House campaign is nearing a conclusion. Under Louisiana law, if no candidate receives a majority of the vote on Election Day, a run-off between the top two finishers, regardless of political party affiliation, is to be held at a later date. That time, in the case of the LA-3 contest between Republican Reps. Charles Boustany (R-LA-7) and Jeff Landry (R-LA-3), is a week from Saturday, Dec. 8. The two incumbents were forced into one southwest Louisiana district because the state lost a seat in reapportionment. Seventy-six percent of the new 3rd District comes from Boustany’s current 7th CD.

A newly released poll, from Red Racing Horses/PMI (Nov. 27-29; 600 likely LA-3 voters), gives Rep. Boustany a 51-33 percent lead over Landry. In the original election among five candidates (three Republicans, one Democrat, and one Libertarian), Boustany placed first with 44.7 percent of the vote versus Landry in second tallying 30.1 percent, a difference of 45,596 votes from 311,393 ballots cast. Boustany looks to be in strong shape in terms of past performance, polling spread, and geography, but a substantially lower Dec. 8th turnout could yield a much closer electoral affair.

IL-2

As predicted, the Illinois legislature just passed a bill that will move the IL-2 special general election to April 9 from March 19. Under Illinois election law, the seat must be filled within 155 of the vacancy occurring, hence the original schedule. But, with local and municipal elections already scheduled for April 9, it made financial and practical sense to combine all of the contests on the one date. Gov. Pat Quinn (D) will sign the bill.

In this case, the general election is a mere formality as the Democratic primary winner will easily hold this seat. The date of that first election, Feb. 26, does not change. It is here that Rep. Jesse Jackson Jr.’s replacement will effectively be chosen.

The Democratic field now stands at seven candidates, which includes former US representatives Debbie Halvorson (D-IL-11) and Mel Reynolds (D-IL-2), state senators Donne Trotter, Toi Hutchinson and Napoleon Harris, Cook County CEO Robin Kelly, and Chicago Alderman Anthony Beale. Pastor Corey Brooks and Chicago Alderman Will Burns have removed themselves from consideration.


CA-51

Another vacancy has occurred in the House, but only until the new Congress convenes. This means one less vote for the Lame Duck session. Rep. Bob Filner (D) resigned from Congress to officially become mayor of San Diego, a position he won in the November general election. His replacement in Congress, state Sen. Juan Vargas (D), will take office as a regular-term freshman in January.

MO-8

A quirk may soon occur in the race to succeed outgoing Rep. Jo Ann Emerson (R). Lt. Gov. Peter Kinder has reportedly asked Republican Party leaders to consider appointing him as the replacement Republican nominee. The local county committees from both parties will choose nominees in lieu of a special congressional primary.

The succession process for filling a vacancy in the office of Missouri lieutenant governor is unclear. Therefore, it is quite possible that Gov. Jay Nixon (D) will be able to appoint Kinder’s replacement should the latter be elected to Congress in the yet-to-be-scheduled special general election. If Nixon appoints a member of his own party, which is a certainty, the Democrats would then control every statewide constitutional office despite the state’s strong tilt to the right in federal elections. This would leave Sen. Roy Blunt as the sole Missouri Republican statewide elected official.

McIntyre Wins, Finally, in NC-7

Only one 2012 US House election remains unresolved, as the state of North Carolina has now certified Rep. Mike McIntyre (D) as the winner of their 7th Congressional District contest. After all of the ballots were finally recounted, McIntyre actually gained one tally and secured a now official 654-vote victory over state Sen. David Rouzer (R).

The North Carolina redistricting plan gave McIntyre a much more challenging seat, as thousands of Democratic voters in the Lumberton area were placed in a different district. The changes made the Wilmington-anchored southeastern North Carolina seat a very competitive one and will likely be so again in 2014.

The one remaining House seat to be decided will be finalized in southwest Louisiana (LA-3) on Dec. 8. There, two Republican incumbents face each other in a run-off election since neither captured a majority of the vote in the Nov. 6 statewide primary vote.

Rep. Charles Boustany (R-LA-7), originally elected in 2004, and freshman Rep. Jeff Landry (R-LA-3) are vying for the new 3rd District. Since the new 3rd is comprised from 76 percent of Boustany’s current constituency and includes his home political base of Lafayette, he is regarded to be the favorite for the run-off. But, as we have repeatedly seen, anything can happen in a low-turnout election.

NOTE: Former Rep. Jesse Jackson Jr.’s (D-IL-2) post-election resignation has caused a vacancy in his Chicago-anchored seat, which will be filled via special election early next year. The all-important Democratic primary is scheduled for Feb. 26, with the general election to be held March 19. A bill is making its way through the legislature to allow the governor to schedule the special general concurrently with the April 9 local and municipal elections, and is expected to pass. Current law requires all Illinois political vacancies to be filled within a 155-day period after the incumbent officially exits.

La. House Race Still to be Decided

All but one of the 2012 US House races have been called and further legal challenges and recounts in at least two districts notwithstanding, a group of 234 Republicans and 201 Democrats will take the oath of office on Thursday, Jan. 3, 2013. Though we know the partisan count, the identity of the 234th Republican member is still undetermined. The election cycle’s final campaign will feature Louisiana GOP Reps. Charles Boustany (R-LA-7) and Jeff Landry (R-LA-3) vying for the right to represent the state’s new 3rd District on Dec. 8.

Under Louisiana election law, the state’s primary date is scheduled concurrently with the national general election day, meaning that Bayou State voters went to the polls for the first time just this past Nov. 6th. If no candidate receives a majority of the vote in what is commonly called the jungle primary, then a run-off election between the top two finishers, regardless of political party affiliation, is held at a later date. California and Washington also use this system, but Louisiana is the only one that holds their primary concurrently with the general election. Because they choose this electoral method, the state’s voters can elect a candidate outright without a second election. In the other jungle primary states, candidates must advance to the run-off election regardless of the percentage received.

Due to national growth patterns and after-effects of the devastating Hurricane Katrina in 2005, Louisiana failed to keep all seven of its congressional districts in reapportionment. Therefore, two members would inevitably be forced into a pairing. The legislature placed veteran Rep. Boustany, elected in 2004, and freshman Landry together in a new southern district. The new seat heavily favors Boustany, because he currently represents 76 percent of the territory and his home base of Lafayette is included whole. Landry sees only 24 percent of his current 3rd District constituency carry over to the new LA-3.

In terms of campaign funding, the two will undoubtedly raise and spend more than $5 million combined. So far, Boustany has obtained just under $3 million, spending $2.64 million and retaining $917,612 for the period beginning October 18th. Landry raised $1.832 million, already spent $1.194 million and had $638,316 in the bank at the close of the Oct. 17 pre-general election reporting period.

Though the outcome will not change the House’s new partisan division, the final result will still be interesting. The pairing is clearly designed for Boustany to win — and he placed first in the Nov. 6 primary election garnering 45-30 percent, a margin of 45,589 votes. But strange things often happen in run-offs. Landry enjoys strong support among the Tea Party activists of southern Louisiana, but exactly what impact they will have in what promises to be a low-turnout election remains unknown.

In another boost for Rep. Boustany occurring just yesterday, the primary’s third place finisher, Democrat Ron Richard who recorded 21.5 percent (67,058 votes), publicly threw his support behind the veteran congressman.

After a winner is declared here on Dec. 8, the new 2014 election cycle will officially begin.

Last Primaries Tomorrow

Tomorrow marks the last regular primary election of this political cycle, as voters go to the polls in Delaware, New Hampshire, and Rhode Island. Louisianans also haven’t chosen their nominees and will do so in their unique version of the jungle primary that occurs on general election day, Nov. 6. In the Bayou State, if no 2012 candidate receives a majority of the votes cast, then the top two finishers will run-off on Dec. 1.

Tomorrow, however, will decide two key races: choosing gubernatorial nominees in the open New Hampshire statewide race, and whether freshman Rep. David Cicilline (D-RI-1) survives his competitive Democratic primary challenge.

The 1st Congressional District of Rhode Island encompasses the eastern part of the state, beginning at the Massachusetts border with the city of Woonsocket, taking part of the city of Providence, and then traveling south all the way through the upscale city of Newport and out to the Atlantic Ocean. Though the seat is heavily Democratic in nature (Obama ’08: 67 percent), Rhode Island voters do tend to send Republicans to Washington from time to time. Therefore, with former state police colonel Brendan Doherty (R) waiting in the wings for tomorrow’s winner, determining the Democratic nominee, especially in the person of a beleaguered Rep. Cicilline, will not end the battle for this seat.

Cicilline has problems tomorrow not so much for what he has done in Congress, but rather as a hangover from his tenure as Providence mayor. The city is teetering on bankruptcy, and Cicilline has been taking major hits in the local media for his expenditure budgets while he was the city’s chief executive. The Providence Journal newspaper has detailed the waste and abuse in city spending over the course of months, and popular local radio talk show host Buddy Cianci, the former Providence mayor who spent time in federal prison for his improprieties in office, uses Cicilline as his regular whipping boy.

The prolonged attention has caused the congressman grief and though he will likely be renominated tomorrow night, the margin between he and Democratic challenger Anthony Gemma could provide a clue as to how the general election will unfold.

Gemma is a marketing executive who ran two years ago when the seat was open, placing second to Cicilline in a four-person Democratic primary field with 23.3 percent to the winner’s 37.7 percent. Despite Cicilline being so well-known and facing three people who were largely unfamiliar to the voting populace, more than 62 percent of 2010 Democratic primary voters chose another candidate. He then won an unimpressive 51-45 percent victory in the general election. With increased negatives since that time, tomorrow’s race should be considered a serious challenge despite Gemma only raising slightly over $300,000 for the campaign.

The most competitive New Hampshire primary race is the Democratic battle for the right to succeed retiring four-term Gov. John Lynch (D). New Hampshire and Vermont are the only two states who still utilize two-year terms for their governors. So, even though Lynch has won four elections, the first New Hampshire chief executive in the modern era to do so, he has only served eight years.

Two former state legislators are squaring off for their party’s nomination, Democratic former state Senate majority leader Maggie Hassan and ex-state senator Jackie Cilley. The winner – and Hassan is only a slight favorite tomorrow – will likely face GOP former gubernatorial nominee and ex-chairman of the state Board of Education, Ovide Lamontagne. The November contest will likely be as close as the presidential election here will be, in what will prove to be a tight and politically pivotal state.

At the congressional level, the general election contests are virtually set as Rep. Frank Guinta (R) defends his 1st District seat against the woman he unseated two years ago, former representative Carol Shea-Porter (D). The 2nd District contest will also feature a re-match of the 2010 campaign, a fierce one-point race between current Rep. Charlie Bass (R) and lobbyist Ann McLane Kuster (D). An equally close contest is forecast for this year. The two Republican incumbents face multiple primary opponents tomorrow, but none are serious. Both Democratic candidates are unopposed.

House Realignment Scorecard

The conventional wisdom during the past 18 months was that Democrats were going to make modest gains in the post-redistricting House, but such prognostications are changing. Considering the re-maps from a national perspective without regard to campaign competition factors, the Republicans are the ones who now appear to have the slight advantage.

The outlook is changing because none of the major Republican seat-risk situations appear to be producing multiple losses. Neither the New York, Florida, California, Virginia, nor Texas map is, on the surface, going to add large numbers of new Democratic House members solely because of plan configuration.

Since we now know where the new seats are going and where the lost districts are coming from, more complete analyses can be rendered. While the straight numbers suggest that Democrats must score a net gain of 25 districts to re-capture the House majority by a single seat, the adjusted post-redistricting number actually increases that figure to 29.

The basis for such a conclusion is in accounting for the 12 seats that have shifted states along with several obvious conversion districts. Other factors are equally as viable in projecting an overall House partisan balance figure, but how competitive various seats are in states like California and New York can be debated in another column. For now, looking at the placement and displacement of the new seats, along with what appear to be some obvious open-seat campaigns going decidedly toward either a Democratic or Republican nominee, lead us to a +4 Republican gain figure.

Let’s first look at the multiple-seat gain or loss states, which tend to be a wash in terms of partisan divide. In Texas, the biggest gainer, the new seats of TX-25, 33, 34, and 36 are headed for a 2R-2D split. In Florida, their two new districts, FL-9 and FL-22, look to be leaning Democratic (certainly so for FL-22), but the campaign evolving in the new 9th puts the outcome in question. Republicans have recruited a strong candidate in local county commissioner John Quinones, while the Democrats are again tapping controversial one-term ex-Rep. Alan Grayson who was defeated for re-election in 2010.

On the multiple-seat reduction side, both Ohio and New York also appear to be neutralizing themselves between the parties. Both sides look to lose one net seat in each state.

But it is among the single-seat gaining and losing states where the GOP has scored well. The Republicans look to be coming out on top in gainers like Georgia (GA-9), South Carolina (SC-7), and Utah (UT-2). Democrats will have a slight edge in Arizona’s new district (AZ-9), and are likely winners in Nevada (NV-4), and Washington (WA-10).

In the states losing congressional representation, while New York and Ohio don’t give either party a clear advantage, Democrats are forced to absorb the loss in Massachusetts (MA-10), New Jersey (NJ-13), Michigan (MI-15), Pennsylvania (PA-4), and Missouri (MO-3). Republicans take the hit in Illinois (IL-19) and Louisiana (LA-7).

The GOP looks to be headed for conversion victories in Arkansas (AR-4, Rep. Mike Ross retiring), Oklahoma (OK-2, Rep. Dan Boren retiring), and likely in Indiana (IN-2, Rep. Joe Donnelly running for Senate). They will also gain three to four seats in North Carolina, but those are neutralized by what appear to be similar gains for Democrats in Illinois. All totaled, before the campaigns hit their stretch drive, it is the GOP that now enjoys a slight post-redistricting advantage and makes a 2012 House majority change even more remote.

Weekly Redistricting Update

Now that almost all of the 43 multi-congressional district maps are legally in place, little is occurring on the redistricting front, meaning that the election year 2012 political playing field has basically been established. This notwithstanding, some action did occur in Florida, Kansas, Louisiana, New Hampshire and South Carolina.

FLORIDA (current delegation: 19R-6D; gains two seats) – The Florida Senate committee of jurisdiction passed a new state Senate map to replace the one the Florida Supreme Court recently struck down. Full Senate action is expected shortly. Expect the legal challenge to the congressional map to drag on until election timing forces a decision, a similar pattern to what has occurred in many other places. Regardless of how the lower courts rule, the congressional plan will eventually come before the Florida Supreme Court. The most difficult issue to resolve is whether the congressional map complies with the voter-enacted redistricting initiative and the measure’s inherent conflicts with the federal Voting Rights Act.

KANSAS (current delegation: 4R) – Looks like it’s back to the drawing board yet again. The state House, which previously approved the congressional map, now has voted it down, sending it back to committee for re-drawing. The state Senate and House are still miles apart on a four-district map, meaning the process could still find its way to court for a judicial draw. Kansas will likely be the last state to complete redistricting. The Sunflower State primary is Aug. 7.

LOUISIANA (current delegation: 6R-1D; loses one seat) – The US Supreme Court ruled that the state of Louisiana may not proceed with its reapportionment lawsuit this year. The state was arguing that the reapportionment formula should only be allowed to count legal residents. Louisiana lost one seat in 2010 reapportionment. The high court’s ruling means any eventual ruling on the merits of the state’s case will not affect the 2012 elections.

NEW HAMPSHIRE (current delegation: 2R) – The Granite State, with the easiest redistricting job in the country (the current lines are only 254 people out of balance) will soon pass a new congressional map, as its state legislative leaders indicated this past week. The final version will be a “least change” plan, since so little is required to bring the lines into reapportionment compliance. The approach is bad news for Rep. Charlie Bass (R-NH-2), whose western district is much more Democratic than its eastern counterpart. Bass is again being challenged by the woman he beat only 48-47 percent in 2010 – Ann McLane Kuster (D).

SOUTH CAROLINA (current delegation: 5R-1D; gains one seat) – After losing their legal challenge to the new South Carolina congressional map last week, the Democratic plaintiffs have decided to appeal the ruling to the United States Supreme Court. So far, the high court has postponed action on such lawsuits (e.g., the SCOTUS decision regarding the Louisiana and West Virginia lawsuits), thus keeping the legally processed maps intact for the current election cycle. It is reasonable to believe this appeal will be handled in a similar manner, and that the Palmetto State map will stand for at least the 2012 election.

Santorum Win Louisiana; Argues Delegate Count

Rick Santorum accomplished his goal Saturday night in Louisiana, easily outdistancing Mitt Romney 49-27 percent, with Newt Gingrich and Rep. Ron Paul (R-TX-14) posting 16 and 6 percent, respectively. Of Louisiana’s 46 delegates, only 20 of them were at stake in the primary and Santorum stands a good chance of capturing 14. The remainder will be chosen at the state Republican convention to be held June 1st and 2nd.

Louisiana was the type of victory Santorum needed to re-establish momentum before going to the April 3 primaries in Wisconsin, Maryland and the District of Columbia. Of the three, DC, where Romney is expected to easily romp, is a Winner-Take-All entity, so all 17 delegates should go his way. Wisconsin and Maryland both use the same allocation system. Delegate votes are awarded for winning statewide and for carrying each of their respective eight congressional districts. Wisconsin has 42 total delegates and Maryland 37. The Wisconsin vote will likely to be close, while Romney has a chance to sweep Maryland and convert all 37 delegates.

Again we saw a familiar pattern in Louisiana. Though Santorum swept all the parishes except one, Mr. Romney placed first in the state’s most urban area – New Orleans. Such a result has been consistent throughout the campaign. Romney does well in the most urbanized areas of a state, but poorly in the rural regions and very poorly in the south. Having a Republican nominee weak in the party’s base areas is not an enviable position for the GOP when they face President Obama later this year. Romney will not be able to count on commensurate urban support against the incumbent Democratic nominee.

But, it’s the overall delegate count that is the subject of much discussion and fraught with misconception. The CNN number is a good benchmark for the media counts. The broadcast organization shows Romney with 549 delegates through Illinois and Santorum with 249, Gingrich 137, Paul 69, and 137 delegates unallocated from the 33 states and territories already voting.

The Republican National Committee official count, however, tells a much different story. Factoring out those delegates who the individual states have not yet chosen nor bound for at least a first ballot vote, Romney would have 339 delegates, Santorum only 95, Gingrich 107, and Paul 22 with 300 unallocated. Using the official RNC accounting, Romney is 805 votes away from committing the 1,144 delegates required to clinch victory, rather than 595 as the media depicts.

The pro-Santorum Red, White and Blue Super PAC has an even different count. Where the RNC does not yet add recent Santorum victory states because their delegates still must be officially chosen at convention, the inclusion of states like Alabama, Mississippi and Kansas changes the picture greatly. According to Red, White, and Blue, the count is: Romney 344; Santorum 193; Gingrich 160; Paul 33; Unallocated 411. Therefore, the Santorum Super PAC projection, in similar fashion to the RNC, shows that Romney is still a whopping 800 committed votes from the magic number.

So, despite all of the aforementioned entities, and then some, looking at exactly the same results, highly diverse accounting results continue to emerge. It again proves that this Republican nomination campaign still has a very long way to go.
