2022: The Unannounced

July 19, 2021 — The Fox News website ran a story late last week saying that there remain five in-cycle US senators who have not yet revealed their political plans for 2022. Below is a review of those senators’ political situations and clues that could provide a glimpse whether they are headed toward re-election or retirement.

The best hints will be forthcoming in a matter of days as the second quarter campaign financial disclosure reports will be released shortly on the Federal Election Commission website. Last Thursday was the deadline for filing the reports for the period covering April 1 through June 30.

The five senators, listed alphabetically by state are Sens. Lisa Murkowski (R-AK), Chuck Grassley (R-IA), John Thune (R-SD), Patrick Leahy (D-VT), and Ron Johnson (R-WI).


Sen. Murkowski:

State: Alaska
Appointed: 2002
Re-elected: 2004, 2010, 2016
Age at time of 2022 election: 65
Victory Margin 2016: 44.4 – 29.2%

Announced Major Opponents:
• Karl Speights (R) – Retired Air Force officer
• Kelly Tshibaka (R) – Former AK Administration Commissioner

It is assumed that Sen. Murkowski will run for re-election, though her return path to Washington may be a difficult one to traverse. Last night, her campaign spokesperson stated that the Senator’s second quarter disclosure report would show $1.15 million raised for the quarter with $2.3 million cash-on-hand. These are financial numbers that suggest she will seek re-election.

Alaska has changed its nominating system and will be the first state to adopt a “top four” primary procedure. Similar to California, Louisiana, and Washington that use the jungle primary format to send the top two candidates to the general election, Alaska will instead advance the top four from the slate primary. The change virtually ensures that Sen. Murkowski will not again lose the Republican primary as she did in the 2010 election. In that year, she was forced to run a highly efficient general election write-in operation to win her second full term.

Early polling numbers find Sen. Murkowski with very poor favorability numbers among Republicans and running a distant third behind Kelly Tshibaka (R), who is already the state Republican Party’s officially endorsed candidate. Dr. Al Gross (D), the 2020 Senate nominee, has not yet committed to running again, but he, too, runs ahead of the Senator in the previously released surveys.

While the top four system guarantees Sen. Murkowski will secure a ballot position for the general election, winning her re-election is in doubt.

Last week Sen. Grassley stated that he would make his political plan public before Nov. 1. Despite his advanced age, it is presumed in all sectors now that Sen. Grassley will seek re-election. He has filed a 2022 campaign committee with the FEC, has a semi-updated website, and it will be interesting to see how active his fundraising became in the second quarter. His March 31 report revealed a cash-on-hand figure of $2.04 million to begin the re-election cycle.

The Controversy over Donald Trump’s Endorsement of NC Senate Candidate, Rep. Ted Budd

June 23, 2021 — Three Politico publication reporters, Burgess Everett, Melanie Zanona, and Olivia Beavers, combined on an article published yesterday (Nasty N.C. Senate primary tests Trump’s sway over the GOP) that merits refutation.

The piece details former President Trump’s public endorsement of US Senate candidate Ted Budd, the 13th District congressman, at the North Carolina Republican Party convention on June 5, and reactions to the development. Generally, and not surprisingly, it casts the endorsement and Rep. Budd’s statewide chances in a negative light.

Therefore, a number of points require balance.

1. To begin, the story quotes key Republicans, such as retiring North Carolina US Sen. Richard Burr (R) and South Carolina Sen. Lindsey Graham (R), who are downplaying the Trump endorsement’s effectiveness, with Sen. Burr going so far as claiming that ex-governor Pat McCrory is basically the only candidate who could win the upcoming general election. It is important to note here that McCrory failed to win re-election in 2016, the last time he was on a statewide ballot.

2. Secondly, a released Meeting Streets Insight poll conducted for the Budd campaign (June 9-10; 500 likely North Carolina Republican primary voters; live interview) highlights a different perspective.

The MSI survey found McCrory leading the GOP field 45-19-12 percent over Rep. Budd and former US representative, Mark Walker, respectively. When the polling sample is informed of the Trump endorsement – only 20 percent were aware before the pollsters provided the information – the ballot test completely flips to 46-27-8 percent with Rep. Budd leading, followed by ex-governor McCrory and former Rep. Walker. Obviously, this suggests the Trump endorsement still has power within the North Carolina Republican primary voter segment.

The Manchin Compromise

June 18, 2021 — West Virginia Sen. Joe Manchin (D) offered a detailed compromise Wednesday to the S.1/HR-1 package that will be debated and likely voted upon in the Senate next week.

The controversial legislation would nationalize voting procedures, and Sen. Manchin has said he would not support a final package unless Republican votes could be recruited to break a filibuster. According to news sources, no Republican is currently supportive.

Sen. Manchin released what he terms is a compromise measure, (Voting Legislation For the People Act Compromise), and presumably a substitute for S.1, or “For the People Act,” as it is formally entitled. His proposal includes 26 points in addition to five sub-points.

The chances of the Democratic leadership accepting the Manchin compromise on face value are virtually nil because his measure does not include some of the key planks found in the S.1 language.

For the purposes of this column, let’s look at a few of what could be the more controversial pieces of the Manchin offering both from a political and constitutional perspective.

• Point 3 states that the measure would “ban gerrymandering and use computer models” for redistricting. Accepting this would be difficult since there is no common definition of “gerrymandering.”

Additionally, though computer models are already used in every state to draw districts, Sen. Manchin may be referring to the Iowa process in which the legislature allows the committee staff to draw maps through a specific computer model without regard to an incumbent’s residence but based solely on geographic and some demographic characteristics.

Trump Endorsement Matters in North Carolina Senate Primary

Former President Donald Trump’s endorsement changes the face of the race for Senate in North Carolina.

June 16, 2021 — North Carolina US Rep. Ted Budd’s (R-Advance) Senate campaign released an internal Meeting Street Insights poll (June 9-10; 500 likely North Carolina Republican primary voters, live interview) Monday that finds former President Donald Trump’s endorsement completely changes the 2022 statewide Republican primary.

Rep. Budd is challenging former Gov. Pat McCrory and ex-US Rep. Mark Walker for the GOP nomination succeeding Sen. Richard Burr (R) who is not seeking re-election to a fourth term.

According to Meeting Streets, former Gov. McCrory would lead the field, as other polls have shown, by a wide margin. On the first ballot test, McCrory scores 45 percent preference as opposed to 19 perecent for Rep. Budd, while 12 percent choose ex-representative Walker.

The picture drastically changes, however, when the pollsters ask if the respondent is aware that former President Trump has endorsed Rep. Budd. Only 20 percent of the sampling universe expressed knowledge of this development. On what the pollster terms the “educated” ballot test, meaning the respondent is told that Trump has, in fact, endorsed Rep. Budd, we see the drastic transformation.

With the Trump endorsement becoming known, Rep. Budd soars to the lead with 46 percent support, while McCrory drops to 27 percent, and ex-Rep. Walker falls to eight percent.

McCrory’s campaign fielded a Public Opinion Strategies survey in early April (April 6-8; 500 likely North Carolina Republican primary voters, live interview) and found the former governor leading 48-13-9 percent over Walker and Budd, respectively.

This was followed later in the month by a Spry Strategies study (April 21-24; 700 likely Republican North Carolina primary voters; combination live interview and interactive voice response system) that found a 40-11-5 percent split, again with Rep. Budd trailing his two opponents.

Dueling Dual Polls

June 14, 2021 — We open the week looking at conflicting polls from two Midwestern statewide races. The Michigan Republican Party published a survey that conflicts with earlier data we’ve seen about their state’s gubernatorial race, and the two leading Ohio Republican Senate contenders both released recent surveys that best tell their own campaign story.

In the Wolverine State, the Competitive Edge Research & Communication firm, polling for the Michigan Republican Party (May 26-June 4; 809 likely Michigan voters), projects retired Detroit Police Chief James Craig (R), who is soon expected to announce his bid for governor, leading incumbent Gretchen Whitmer (D) by a spread beyond the polling margin of error, 45-38 percent.

Curiously, the MIGOP leadership also released the ballot test that featured the party’s 2020 and 2018 US Senate nominee, John James. Here, the CERC finds Gov. Whitmer leading James, 50-45 percent. James has not indicated that he is going to enter the gubernatorial race, so it is surprising to see the Republican Party releasing data that puts one of their top political figures in a weaker position. James lost the 2020 Senate race to incumbent Gary Peters (D) by a tight 50-48 percent count.

In May, the Target Insyght survey research company (May 9-11; 800 registered Michigan voters) painted a different picture, forecasting a 48-42 percent lead for Gov. Whitmer over Craig and 49-39 percent against James.

The difference could be attributed to James retiring as chief of police after the TI poll was conducted and before the CERC survey was taken. Former chief Craig is a well-known and popular figure in Detroit, and the accolades given him for his tenure could certainly have helped his polling data at least on a short-term basis.

Additionally, Gov. Whitmer has been caught in several inconsistencies regarding her COVID shutdown policies, which were some of the most drastic in the country. More than once, she was found not following the letter of her own directives for herself and family.

Poll: Murkowski Trailing Badly

June 10, 2010 — A new Alaska statewide political survey suggests that Sen. Lisa Murkowski (R) is in serious danger of losing her coming re-election campaign.

Change Research, polling for the 314 Action Fund, an organization committed to electing more scientists to public office, conducted a study of the Alaska electorate and found incumbent Sen. Murkowski, who is looking to win a fourth full term, (R) faring poorly.

The poll (May 22-25; released June 9; 1,023 likely Alaska voters, online) tested Murkowski against announced Republican opponent Kelly Tshibaka, the former Alaska Commissioner of Administration, Dr. Al Gross, the 2020 Senate Democratic nominee who lost 54-41 percent to Republican incumbent Dan Sullivan, and John Wayne Howe of the Alaska Independence Party.

In 2020, Alaska voters adopted a new ballot procedure initiative that changes the state’s nomination system into a unique “top four” jungle primary. This means the four candidates attracting the most votes in the initial election all advance into the general election.

With Sen. Murkowski having trouble within her own Republican Party, this system prevents her from again facing a closed partisan primary like the one she lost in 2010, since it is difficult to fathom she or any other incumbent failing to even place fourth in a primary election. In the year she lost re-nomination, Sen. Murkowski was able to quickly rebound and win as a write-in general election candidate.

While the top-four system likely helps Sen. Murkowski, the new general election system may not play to her favor. After the top four candidates qualify, the ranked-choice voting system takes effect to decide the general election. This means voters will rank the candidates from 1 through 4.

Once the fourth place finisher is determined, assuming no one has reached 50 percent, those voters who rank the fourth place finisher as number 1 have their ballots retrieved and their second choice is added to the remaining totals. This process continues in rounds until one candidate secures majority support.

S-1: An Unintended Consequence?

June 7, 2021 — Senate Majority Leader Charles Schumer (D-NY) has scheduled the controversial federal elections bill, S-1, the companion measure to the House-passed HR-1, for debate on June 21, which appears to be a curious move. At this point, it seems improbable that the leadership can break the filibuster rule, and without doing so, how does the bill pass?

If such an observation is correct, then what does Sen. Schumer gain from bringing the bill to the floor, and will there be unintended consequences? These are questions to be answered after the bill is debated and either passed, dispensed with, or put on hold for a future legislative maneuver.

As we know, the filibuster rule is surviving because Democrats Joe Manchin (D-WV) and Kyrsten Sinema (D-AZ) won’t support changing the rule. Both senators, at least at this point, seem intransigent in their position.

Sen. Manchin just this week verbally shot back at reporters for continually asking him if he is changing his stance on the filibuster rule. “I’m not separating our country, OK?” Manchin said. “I don’t know what you all don’t understand about this. You ask the same question every day. It’s wrong.”

The Daily Kos Elections site yesterday published a filibuster-related response from Sen. Sinema to an Arizona constituent identifying himself through an email address as Triumph110. Below is an excerpt from a very long historically based response:

“I have long said that I oppose eliminating the filibuster for votes on legislation. Retaining the legislative filibuster is not meant to impede the things we want to get done. Rather, it’s meant to protect what the Senate was designed to be.

“I believe the Senate has a responsibility to put politics aside and fully consider, debate, and reach compromise on legislative issues that will affect all Americans. Therefore, I support the 60-vote threshold for all Senate actions. Debate on bills should be a bipartisan process that takes into account the views of all Americans, not just those of one political party. Regardless of the party in control of the Senate, respecting the opinions of senators from the minority party will result in better, commonsense legislation.
