Incumbents Facing Challenges in 2012 – Part I

Though it is still difficult to forecast the complete US House political picture next year, mostly because redistricting is only about half finished, we already see that more than 40 sitting members will draw serious competition in either the 2012 primary or general election.

Below is a list of 22 incumbents who will be in competitive campaigns next year from states where redistricting is complete. The second half of the overall group will be featured in our Wednesday report.

AR-1 – Rick Crawford (R) – Redistricting added more Democrats to what already was a highly Democratic seat. Crawford will be in a toss-up situation.

CA-3 – John Garamendi (D) – The new 3rd district could conceivably elect a Republican. Watch for a serious GOP challenge to Rep. Garamendi, who is serving his first full term.

CA-9 – Jerry McNerney (D) – Potential challenges in both the Democratic primary and general election await Mr. McNerney, who has chosen to run in a seat that doesn’t include his Bay Area political base.

CA-10 – Jeff Denham (R) – Though Rep. Denham will be the heavy favorite in this new district, it is not as Republican as his current CA-19.

CA-16 – Dennis Cardoza (D)/Jim Costa (D) – The redistricting commission greatly altered the Fresno area. Rep. Costa announced for CA-16 even though his home is in the new 21st, which is much more Republican. Rumors persist that Cardoza may retire.

CA-24 – Lois Capps (D) – The new Santa Barbara seat is a 50/50 district now, so former lieutenant governor and state Sen. Abel Maldonado (R) is a very strong challenger here.

CA-25/26 – Elton Gallegly (R) – Rep. Gallegly can either run against fellow GOP Rep. Buck McKeon (R-CA-25) or in the new marginal 26th district (Ventura County). Keep a retirement watch on Gallegly who even announced such before the 2008 election, only to change his mind.

CA-30 – Brad Sherman (D)/Howard Berman (D) – This will be a tough primary and general election for the two veteran Democratic congressmen. One will not return to the next Congress.

CA-31 – Joe Baca (D) – Rep. Baca does not like his new, and more competitive, 31st district and may hop over to the more Democratic 35th CD, created as an open seat.

CA-32 – David Dreier (R) – Congressman Dreier’s current 26th district seat was broken up into six different parts. He will not run in District 32, as this seat is highly Democratic. Most of his options are poor. If Elton Gallegly does not run in District 26, then that seat is a possibility for Dreier. He could also swing down into District 31 if Rep. Baca moves to CA-35.

CA-38/47 – Linda Sanchez (D) – There is a good possibility that Rep. Sanchez will face strong primary opposition either from Rep. Grace Napolitano (D-CA-38) in the new 38th district, where both of their homes reside, or in the Long Beach-based new 47th district. There, state Sen. Alan Lowenthal (D) has already said he will run. Rep. Laura Richardson (D-CA-37) is also a potential candidate. This seat is also in play for the Republicans. Former Rep. Steve Kuykendall (R-CA-36), is saying that he, too, will run here next year.

CA-39 – Ed Royce (R)/Gary Miller (R) – This is a Republican pairing. The winner retains the seat for the GOP, but one of the two will not return. Most of the territory currently belongs to Royce, who has to be regarded as the favorite in this new configuration.

CA-44 – Janice Hahn (D) – Newly elected Rep. Hahn will likely draw a challenge from fellow Democratic Rep. Laura Richardson (D-CA-37) and state Assemblyman Isadore Hall (D). The seat is heavily minority, so facing either a strong African-American or Hispanic opponent in the general election could doom Hahn’s re-election chances.

CA-52 – Brian Bilbray (R) – Rep. Bilbray was paired with Rep. Darrell Issa (R-CA-49) in new district 49, but will run in the new 52nd. The seat should elect a Republican, but the Democrats are competitive. Former state Assemblywoman Lori Saldana (D) has already announced her candidacy.

GA-12 – John Barrow (D) – Assuming the current Georgia redistricting map passes the Georgia Senate and is signed by Gov. Nathan Deal (R), Rep. Barrow will find himself in a much more competitive district. The new 12th will go from a mid-50s Obama district to one in the mid-40s. The African-American population drops precipitously, as well.

IL-8/14 – Joe Walsh (R)/Randy Hultgren (R) – Another Republican pairing. Rep. Walsh’s current 8th district was eviscerated in redistricting. His best chance at winning re-election to a second term is to challenge fellow GOP Rep. Randy Hultgren in new District 14. A child support payment scandal surrounding Walsh puts Hultgren in the early favorite’s position.

IL-10 – Bob Dold (R) – Redistricting makes the marginal 10th even more Democratic. Freshman Rep. Dold has already announced he will run for re-election here.

IL-11 – Adam Kinzinger (R)/Judy Biggert (R) – Rep. Kinzinger, like Mr. Dreier in California, saw his current district split multiple ways. He will have several choices of where to seek re-election. New district 11 is certainly one of his options, but none are particularly appealing unless Rep. Don Manzullo (R-IL-16) decides to retire. Rep. Judy Biggert (R-IL-13) could also seek re-election here, though the new 11th is much more Democratic than her current seat. Former Rep. Bill Foster (D-IL-14) has already announced his candidacy in this newly configured seat as has a strong chance to convert it to the Democratic column, particularly with President Obama leading the ticket.

IL-13 – Tim Johnson (R) – Originally paired with Rep. John Shimkus (R-IL-19) in the new 15th District, Rep. Johnson has chosen to seek re-election in the marginal 13th District. He can expect serious general election competition.

IL-17 – Bobby Schilling (R) – Though redistricting brought the seat back toward Schilling’s base in the Quad Cities region, the new 17th will be even more Democratic than the previous district. Several strong Dem challengers are already running. Schilling finds himself in a toss-up situation, at best.

Our Rundown of 23 Former Congressmen and Congresswomen Who May Run Again

At this point, early in the 2012 election cycle, nine former members of Congress have announced that they will run again next year. An additional 14 confirm they are considering mounting another congressional campaign effort, but have not yet made a final decision.

Those who have announced their candidacy are highlighted in blue. The names in italics are possible candidates:

The House Open Seats

As we approach the midway point in the national redistricting process, it is a good time to check the status of the House open seats. Because reapportionment creates a dozen new seats, the incumbent-less district count is already 29. An average election cycle features about 35 open seats, although the last two elections have broken the 40 mark. Should the proposed maps in California and North Carolina pass, at least three more vacancies will be added to the 2012 total. And if Utah Reps. Jim Matheson (D-UT-2) and Jason Chaffetz (R-UT-3) along with Wisconsin Rep. Tammy Baldwin (D-WI-2) run statewide, as they are considering, then three more would be added.

Of the 29 open districts, 12 are new seats, nine current incumbents are running for Senate, two are running for governor, another pair are retiring from politics, one is seeking the U.S. Presidency, and one more is running for mayor of San Diego. Two members resigned their seats; one because of being appointed to the Senate; one due to scandal. Nine of the vacating incumbents are Democrats, six are Republicans. The two vacant seats split evenly, one from each party.

Most of the current seats will stay within the designated party control, but at least six (IN-2, Donnelly; MT-AL, Rehberg; NV-2, Vacant – special election Sept. 13; NM-1, Heinrich; OK-2, Boren; and TX-14, Paul) will likely join the competitive ranks.

With already a large number of open seats in the 2012 election cycle, it would not be surprising to see the total number approach 50 before filing closes in each of the states. Should this happen, added to the 97 members currently serving their first term, a full one-third of the House will have two terms of seniority or less in the next Congress.

A Wide-Open Republican Presidential Field

Indiana Gov. Mitch Daniels’ announcement over the weekend that he would not seek the presidency means the Republican nomination is completely up for grabs. Though former Massachusetts Gov. Mitt Romney has a substantial lead in the New Hampshire primary according to a new CNN/WMUR-TV poll (784 New Hampshire adults, 347 Republicans), the same data shows that 87 percent of those sampled have not definitely decided who they will support for president. In the south, the heart of the Republican nomination voter base, no remaining candidate has the inside track to winning the critical South Carolina, Florida, and Georgia primaries, among others.

With southern favorites like ex-Arkansas Gov. Mike Huckabee, Mississippi Gov. Haley Barbour, and presumably former vice-presidential nominee Sarah Palin all out of the race, does this open the door for others such as former New York City Mayor Rudy Giuliani or Texas Gov. Rick Perry? Both have made recent comments suggesting that they could enter the race. Giuliani would jump-start his campaign with a strong New Hampshire strategy, where Perry would be attractive to the base conservative voter, particularly those residing in the south. Former Minnesota Gov. Tim Pawlenty, now an official candidate, and Rep. Michele Bachmann (R-MN-6), a likely one, could hurt each other in neighboring Iowa, since they may negate what could be each other’s regional advantage in the first-in-the-nation caucus. Former House Speaker Newt Gingrich, who usually polls toward the end of the top tier of candidates, has stumbled out of the gate with a series of early gaffes.

This Republican primary is shaping up to become the most wide open race we’ve seen in the modern political era.

Presidential Mathematics

In the past few days, developments have occurred that help define the Republican presidential field of candidates. Mississippi Gov. Haley Barbour, after giving every indication he was beginning to build a bona-fide presidential campaign apparatus, now says he won’t run. Rep. Ron Paul (R-TX-14) is forming a presidential exploratory committee, meaning his son, Sen. Rand Paul (R-KY), will not become a candidate. Former New York City Mayor Rudy Giuliani, now traveling to New Hampshire on a regular basis, says he will run if he doesn’t believe that another Republican candidate could actually defeat Pres. Barack Obama in a general election.

We still must hear definitively from former Arkansas Gov. Mike Huckabee, ex-VP nominee Sarah Palin, and Indiana Gov. Mitch Daniels, all of whom may not enter the race, and Massachusetts ex-Gov. Mitt Romney, Rep. Michele Bachmann (R-MN-6), ex-House Speaker Newt Gingrich, and former Minnesota Gov. Tim Pawlenty, all of whom either will, or probably will, run.

Looking at the delegate counts and apportionment systems that each state employs uncovers a road map to victory for one of the eventual candidates. Eleven states are winner-take-all (of Republican delegates) and another nine are winner-take-all by congressional district. These states proved key to Sen. John McCain’s come-from-behind victory in 2008. Remember, the McCain candidacy had been given up for dead until the actual voting began. His close wins in South Carolina, Florida, Missouri, and Arizona (though the margin between McCain and the other candidates wasn’t particularly close in his home state, he still managed to garner only 47 percent of the vote within his own Arizona party base) gave him such a commanding lead in the delegate count that it soon became obvious no one could catch him.

Interestingly, despite his under-the-radar approach to the 2012 campaign, the delegate-rich states stack up pretty well in former Mayor Giuliani’s favor, considering his home base of New York (101 delegates) and New Jersey (53), are in the winner-take-all category. Connecticut (28), the District of Columbia (19), Delaware (17), and Vermont (17) are all other places the ex-NYC chief executive could win. Maryland (37 delegates), another Giuliani potential, is in the winner-take-all by congressional district category. The big states of California (172) and Florida (93) are also there, as are Ohio (72) and Wisconsin (42).

All totaled, the winner-take-all and the winner-take-all by congressional district states contain 1,096 delegates of the grand total of 2,422 that form the Republican National Convention. This means 45.2 percent of all delegates will be chosen in either winner-take-all or winner-take-all by CD states. The remainder are in caucus, proportional systems, or hybrids like Louisiana (48 delegates) where both a primary and caucus are used.

The winner-take-all by congressional district awards a candidate a certain number of delegates for winning the statewide vote (usually their base 10 delegates that all states receive, and whatever extra and bonus votes they earn for electing Republican candidates to office) and another three delegates for every congressional district won. This system is interesting because some congressional districts in places like Los Angeles, where Republicans routinely receive well less than 30 percent of the vote are of equal stature to the strongest of GOP districts in terms of delegate allocation for the Republican presidential primary. While it is unlikely that any one candidate would win all of the delegates in a winner-take-all by CD state, it is possible for an individual to snare the vast majority, which matters greatly in the national vote count.

Whether Rudy Giuliani comes back from political oblivion to stake his comeback on a winner-take-all state strategy is unclear right now. What is evident, however, is that the person carrying the preponderance of these winner-take-all states and districts will almost assuredly win the 2012 Republican nomination and become Obama’s future general election opponent.

Early Redistricting Projections

Now that the new apportionment and population numbers are official, we can begin calculating each party’s chances of prevailing in the redistricting wars. Much of the action will occur in the states that either gained or lost congressional seats in yesterday’s 2010 national apportionment.

• In Texas, with four new seats to add to its delegation, Republicans must have a goal of gaining three of those four in order to send a 26R-10D delegation to Washington.
• It is likely that Florida will split its two new seats between the parties, but Republicans must exit the Sunshine State up 20R-7D.
• New York, losing two seats, also will see a likely outcome of each party being down one seat. That would mean a delegation that’s the mirror image of Florida: 20D-7R.
• Ohio, already at 13R-5D, will lose two seats. A 12R-4D delegation should be the Republican goal, since they control the entire redistricting process.

Democrats should gain the new seats in Nevada and Washington, while making the Republicans absorb the loss in Illinois, Louisiana, and New Jersey. Democrats will feel the pinch of an evaporating seat in Massachusetts, Michigan, and Pennsylvania and potentially Iowa and Missouri. Republicans will gain newly awarded districts in Georgia, South Carolina, Utah and possibly Arizona.

From a Republican perspective, their goal is to lock in the huge number of seats they just won and add approximately five more nationally. Democrats will look to gain a seat or two. Hence, the swing between the parties will be small.

Apportionment: Florida Gains, New York Loses

The Census Bureau released the new state population figures yesterday and confirmed that 12 congressional seats will change states for the coming decade. It had been clear for some time that Texas, Florida, Arizona, Georgia, Nevada, South Carolina, Utah, and Washington were going to gain, and Ohio, New York, Illinois, Iowa, Louisiana, Massachusetts, Michigan, New Jersey, and Pennsylvania were going to lose representation. But, the actual apportionment has traditionally been a bit different from the pre-census estimates. Not so in 2010.

A recent Election Data Services forecast precisely the official apportionment. If there was a surprise, it was that Florida gained a second seat and New York lost two. Prior estimates suggested that Oregon was on the cusp of gaining a seat, but that proved not to be the case as their potential 6th district actually placed 442nd, some seven seats away from acceptance. Oregon, California, and Idaho were the only states not to gain in the far west. Idaho, despite a population increase of better than 21%, more than double the national average from 2000, did not come close to gaining a third congressional district.

There was suspense, however, as to whether Missouri or Minnesota would lose the final district. The result is Missouri — as the Show Me State’s 9th district placed 437th, thus limiting them to eight seats for the ensuing decade. Minnesota held its 8th district by about 15,000 people, thus denying North Carolina a new 14th seat. The hypothetical NC-14 was the 436th district, or the next one in line.

The national population increased 9.7% over the decade. The state with the largest percentage growth increase was Nevada at 35.1%, while Michigan is the only place that now has fewer people than it did at the beginning of 2000. Michigan’s real growth rate was a negative 0.6%. The only US non-state entity to decline in population was Puerto Rico, which lost 2.2% of its population over the last ten years.

The top five population gainers are Nevada (35.1%), Arizona (24.6%), Utah (23.8%), Idaho (21.1%), and Texas (20.6%). The five states with the slowest growth rates are Michigan (-0.6%), Rhode Island (0.4%), Louisiana (1.4%), Ohio (1.6%), and New York (2.1%). California, not gaining a seat for the first time in history, had a 10.0% real growth rate. The aforementioned Oregon recorded a 12.0% increase.

The apportionment formula becomes clear when comparing Florida and Delaware. It’s a good example as to why it is easier for the big states to gain and lose seats. The Sunshine State’s rate of growth was 17.6%, but the raw number increase was 2.9 million inhabitants. Hence, the awarding of two additional seats. Delaware saw a population increase of 14.6%, but gained only 114,000 people. Their new population of more than 897,000 is large for one district, but, like Montana’s situation, is much too small for two.

The addition of two districts in Florida probably gives each party a new seat. The GOP, with a hold over the redistricting pen, will likely have a 21R-7D seat ratio goal, though the new redistricting restrictions voters placed upon map drawers may make it difficult for Republicans to take 2/3 of the seats when the statewide vote normally breaks closer to 50/50.

The switch of districts also affects the presidential election. Looking at President Obama’s 2008 winning coalition of states, his total of 365 electoral votes would diminish to 358 under the new apportionment, while the Republican total would grow to 180 if every state were to vote the same way in 2012. This means a net swing of 14 votes for the GOP, equivalent to winning a state the size of New Jersey or Virginia.
