Weekly Redistricting Outlook

Significant redistricting action occurred in the following six states during the past week: Arizona, Colorado, Nevada, Ohio, South Carolina, and Virginia.

ARIZONA (current delegation: 5R-3D; gains one seat) – The Arizona state Supreme Court failed to grant impeached Independent Redistricting Commission (IRC) chair Colleen Mathis (I) a stay over the state Senate and governor’s decision to remove her from office. The Court has agreed to hear Mathis’ motion to overturn her removal, but the judicial body won’t allow her to return to the Commission before the case is heard. Thus, the Arizona congressional map is on hold for an indefinite period of time.

Mathis supporters and the Democratic Party were hoping the high court would reinstate her so the Commission would have time to pass the map that had been previously laid out for comment. The public is allowed 30 days to express opinion after which changes can be made. That period ended just days after Mathis was removed, thus denying the panel a clear majority to enact the plan. Over the course of time, the Mathis map would likely produce a 5D-4R Democratic majority in the Arizona delegation.

Should she lose her legal maneuvering, the process to fill the Mathis vacancy would begin anew as a different chairman would be chosen as defined through the procedures governing commission membership. By law, the IRC must have two Democrats, two Republicans, and an Independent who becomes the chairman.

COLORADO (current delegation: 4R-3D) – The state court drawing the de novo map released its plan and basically adopted the Democratic outline. This is not a surprise, as the Colorado courts have repeatedly favored the Democrats in previous decades. The most endangered member of the delegation now appears to be sophomore Rep. Mike Coffman (R-CO-6), as his Arapahoe County-based district now wraps around into Adams County, northeast of Denver, and adds a much higher number of Democrats to what was his safe Republican seat. The 6th District goes from 46 percent Obama in the 2008 presidential contest to 54 percent Obama, suggesting that the district will become highly competitive in the 2012 election and likely beyond.

The big winner for the GOP is freshman Rep. Cory Gardner in the 4th District. Formerly a safe Republican seat, the 4th went Democratic for one term prior to Gardner’s victory in 2010. His eastern Colorado seat goes from 49 percent Obama to 42 percent Obama, representing a substantial jump in Republican voters.

The other districts remain in about the same partisan ratio as they were during the previous decade. This means the 3rd District of freshman Republican Rep. Scott Tipton remains as a swing seat. CD-4 changes from 47 percent Obama to 48 percent. The map, which is unlikely to be challenged, will create an even more competitive plan than in the past decade.

The state court was forced to draw the map because the legislature deadlocked over the congressional plan during the regular session.

NEVADA (current delegation: 2R-1D; gains one seat) –
It appears the Republicans will not challenge the lower court-drawn congressional map. Petitioning the state Supreme Court would be the next step in the process. It is unlikely the high court would overturn what the lower court devised, so such action is futile, Republican leaders apparently believe. The court created a 1D, 1R map with two seats rated as competitive.

OHIO (current delegation: 13R-5D; loses two seats) – Republicans are still trying to put a two-thirds coalition together in both houses of their legislature to pass a modified congressional map. At this writing, the chances of forming such a consensus appear slim. Failure to pass a new map means reverting to the previous enacted plan over which Democrats are currently gathering petition signatures to force a ballot referendum. If successful, the map will go to the voters in the general election of 2012, meaning a court will draw an interim 16-seat Ohio map for the current election cycle.

SOUTH CAROLINA (current delegation: 5R-1D; gains one seat) –
A new Voting Rights lawsuit was filed against the state’s recently enacted congressional map that should return six Republicans and one Democrat to Washington. The lawsuit, brought by a group of African-American voters, claims that too many black voters were packed into Rep. Jim Clyburn’s (D) 6th District. Because the US Justice Department has already granted pre-clearance to the South Carolina congressional plan, any lawsuit charging illegalities over minority representation is unlikely to succeed.

VIRGINIA (current delegation: 8R-3D) –
As expected, now that Republicans will assume control of the state Senate, the new leadership announced they will wait until the next legislative session, when they are officially in control, to move a congressional map. Expect the 8R-3D ratio to be strengthened and remain locked for the ensuing decade. The new session begins in January.

Nevada Restores Calm

Nevada Republicans have now officially chosen a caucus voting schedule that appears to break the January logjam and restores a sense of order to the GOP presidential nominating process.

Under Republican National Committee rules, the only states allowed to hold a delegate-selecting nomination event (primary or caucus) prior to Super Tuesday (March 6 in 2012) are Iowa, New Hampshire, Nevada and South Carolina. However, Florida upset the apple cart earlier this month by moving to Jan. 31 and is willing to accept the consequences of a party-imposed penalty that forces them to relinquish half of their delegates. But the Nevada Republicans, under the reasoning that they are still the first event in the west, may have brought sanity back to the process by choosing Feb. 4 as their caucus date. This allows New Hampshire, featuring their first-in-the-nation primary, to choose Jan. 10. Iowa has already laid claim to Jan. 3. South Carolina will hold their party-run primary on Saturday, Jan. 21.

The action finally means that the campaigns can now enter the home stretch of the early nominating events with a defined calendar. Expect activity to quickly become heavy in Iowa and New Hampshire, in particular. The Hawkeye State may be the site of the more intense interest because Mitt Romney already has a healthy lead in the Granite State, and Iowa is close. It is clear that the latter state may become a do-or-die venue for Gov. Rick Perry. Now languishing in the polls, Perry does have strong financial backing, on par with Romney, and must prove he can deliver votes in the first contest to be taken seriously. Retired business executive Herman Cain continues to show strong support and is certainly still the campaign wild card.

Does Money Matter in Presidential Campaigns?

While presidential candidate Herman Cain is vaulting up the polling charts – the latest Rasmussen Reports poll (Oct. 14-15; 1,000 likely voters) actually puts him ahead of President Obama 43-41 percent – his campaign is lagging behind in spendable resources. According to the just-filed FEC financial disclosure reports, the retired business executive only has $1.34 million cash-on-hand with $675,000 in debt. This contrasts with former Massachusetts Gov. Mitt Romney’s $16.46 million and Texas Gov. Rick Perry’s $15.08 million. Rep. Ron Paul (R-TX-14) is next with $3.67 million in the bank.

It is often said that political money is least important in a presidential race because of the extensive earned media coverage the candidates receive. This is true to a point, but Cain’s financial shortcomings, should they continue, might be felt in places like Iowa, the site of the nation’s first delegate selection event. The fact that the campaigns must convince their supporters to attend an actual political meeting instead of just going to vote, means a stronger organization requirement is necessary.

Immediately after Iowa, the campaigns will pivot to New Hampshire, Nevada, South Carolina and Florida, all within the month of January. Feeding such a mobile political machine will be expensive, so Cain will need to command greater resources if he is to fulfill his current standing. Failing to produce in the early states will be seriously problematic for Mr. Cain, since the expectation level surrounding his campaign has grown exponentially.

A December New Hampshire Primary?

Earlier this week, New Hampshire Secretary of State Bill Gardner indicated that he might consider setting a Presidential primary date as early as Dec. 6 unless Nevada moves back the date of its caucuses to January 17th or later.

Gardner, who has set the date of New Hampshire’s “first-in-the-nation” primary since 1976, issued a memo on Wednesday calling both Tuesday, Dec. 6, and Tuesday, Dec. 13, “realistic options” unless Nevada agrees to its nomination contests after Jan. 17.

Florida’s recent rescheduling of its primary to Jan. 31, which we reported in our Oct. 3 edition, is the action that set the dominoes in motion. As a result of the Sunshine State’s action, Iowa, Nevada and South Carolina have all moved up the dates of their primaries to maintain their status — in that order — as the first nominating contests in the 2012 cycle. Gardner has sent an early signal that the New Hampshire date will be significantly earlier by moving up the Granite State’s candidate filing period to open on Oct. 17 and close 11 days later on Oct. 28.

South Carolina has set its primary for Jan. 21, and Nevada officials have already set its caucus for Jan. 14. Iowa officials have indicated that Jan. 3 is going to be the date of the nation’s first caucus.

Gardner is bound by a New Hampshire state law requiring the Secretary of State to set their primary at least one week before any other nominating contest that would undercut the state’s much cherished “first-in-the-nation” primary status.

Gardner’s memo clearly states, “If Nevada does not adjust its caucus date to a later time, I cannot rule out the possibility of a December primary.”

Gardner subsequently told news organizations that he will not set the presidential primary date until sometime after Oct. 17.

“When I set the date, I will explain all the reasons why it ends up on that date. It’s not my preference to put it in December. The problem is all of our choices are bad choices. I just want to be pick the best of the bad,” he told NBC News last Friday.

As we reported on Oct. 3., Florida’s move, which set off this chain reaction, to change its primary date to Jan. 31 in violation of Republican National Committee rules looks to drastically alter the GOP presidential nomination fight. But accepting intra-party punishment is not the only factor involved in altering their election schedule. Under the Voting Rights Act, all or parts of 16 states are subjected to federal approval of all electoral moves, including primary/caucus date selection. Therefore, it is the Obama Justice Department that will have to grant Florida, New Hampshire, and South Carolina “preclearance” or, in this case, permission to schedule a nominating event in January 2012. Only Iowa and Nevada, in this group of five states, may move unencumbered because they are not part of the group of 16.

At this stage, it’s anybody’s guess how this calendar hopping might affect the outcome of these early nominating contests, but clearly the present front-runners, especially Mitt Romney, who polls show has now opened up a large lead over the rest of the Republican field, might like the nominations to be held sooner rather than later. This way, the vote will occur before the recently fickle GOP primary electorate has a chance to change its mind again.

The RNC’s originally proposed calendar began with the Iowa Caucus in early February, but Florida’s attempted move to the last day in January means the other four states are forced to leap-frog the Sunshine State in order to maintain their prominent political position. This means five nominating events, two caucuses (IA, NV) and three primaries (NH, SC, FL), will be held in the first month of next year followed by a five-week void until Super Tuesday in early March.

How does the proposed schedule change affect the current crop of candidates and potential late entries? The big winners under the new calendar are the two front-runners, Mitt Romney and Rick Perry. The early and compressed voting schedule favors the better-known candidates and those having the largest campaign war chests. The quicker time frame featuring five shotgun-style nominating events in a 29-day period gives less time to the current also-rans to ramp up a credible campaign and makes gaining momentum from an early surprise victory even more difficult because there simply won’t be enough time to cement a previous win.

But the potential late entries are an even greater disadvantage under the new voting schedule because they will now have less time to construct a major campaign operation from scratch. Therefore, Florida’s decision this weekend makes it even more unlikely that New Jersey Gov. Chris Christie, former New York City Mayor Rudy Giuliani, and former Vice-Presidential nominee Sarah Palin will become official candidates.

If the GOP fight winnows down to a two-candidate race in January, then watch for a very interesting race. Perry wins a one-on-one match with Romney if he can successfully cast himself as the conservatives’ candidate and frame Romney as the moderate. On the other hand, as we have seen particularly in the last 10 days, Romney has the superior campaign apparatus, so Perry will have to make a rapid operational improvement or he risks losing his early strong standing.

As so often in American politics, the schedule can be the determining factor in deciding battles. Such may be the case with the 2012 GOP presidential contest. At the very least, however, this weekend’s Florida decision has set this campaign upon a brand new course.

Muscial Chairs Again

In 2008, states began climbing over each other in order to obtain a better schedule for their own presidential nominating event, whether it be by caucus or primary. Places like Florida moved into a more prominent position, defying party rules, and were penalized half of their delegate slots, among other perks, at the respective national conventions. Saturday, the deadline for states to inform the Republican National Committee about their primary or caucus schedule will finally give us the opportunity of seeing how the primary/caucus calendar will unfold. Under RNC rules, only Iowa, New Hampshire, Nevada and South Carolina are allowed to conduct delegate selection events prior to Super Tuesday, which, in 2012, is March 6.

The Florida commission charged with selecting the Republican primary date is already indicating they may choose Jan. 31 for their primary vote at their meeting tomorrow afternoon, in direct violation of RNC rules. Such a move will cost them half of their 99 Republican National Convention delegates. Should they move in this direction, watch Iowa, New Hampshire, Nevada, and South Carolina all move to an early or mid-January date. This will again drastically change each candidate’s campaign strategy, and the short calendar will make each early victory all the more important in terms of political momentum.

Interestingly, should the early states split their votes and different candidates win the first caucuses and primaries, then the late states will ultimately find themselves holding all the political cards, and with their full complement of delegates. If no clear leader emerges from the early states, then the bigger late states like Pennsylvania, Ohio, Texas and California will have a much greater say in determining who becomes the Republican nominee. With the nominating schedule finally being set on Saturday, the official calendar could tell us a great deal about who may become the eventual winner.

Saturday: The Turning Point

Clearly the most important day of the 2012 Republican presidential nomination campaign occurred Saturday. Rep. Michele Bachmann’s (R-MN-6) victory at the Iowa Straw Poll sent former Minnesota Gov. Tim Pawlenty packing, while 1,200 miles away at the Red State Gathering event in Charleston, SC, Texas Gov. Rick Perry formally joined the race.

Rep. Bachmann’s preliminary Hawkeye State victory was no surprise. It had been clear for weeks that she and Rep. Ron Paul (R-TX-14) had the strongest vote-gathering potential within the regular universe of Straw Poll attendees. Ironically, it was Pawlenty who had the best campaign organization and spent more than any other candidate – far above $1 million. The fact that he finished a distant third (2,293 votes to Bachmann’s 4,823 and Paul’s 4,671) caused him to officially end his campaign on Sunday.

The high Straw Poll turnout proved to be the event’s biggest revelation. Many political pundits and outside observers were predicting a lower than average rate of participation in the days approaching the carnival-style political affair held at Iowa State University in Ames, saying that none of the candidates were exciting the rank and file GOP voters.

In 2008, when former Massachusetts Gov. Mitt Romney won the Straw Poll, more than 14,000 people voted, with as many as 20,000 on the grounds. At its historical high point in 1996, more than 30,000 individuals cast ballots but that was when candidates were allowed to bus and fly people in from all over the country. Beginning in 2000, participation was limited to Iowa registered voters. Some predicted that overall turnout for the current event could be as low as 10,000. But on Saturday, 16,829 people cast ballots.

Aside from Pawlenty, the event’s biggest loser could well be Mr. Romney. Making the decision to bypass the Straw Poll and participate only in the pre-event debate held last Thursday evening, Romney scored just 567 votes. Though he and two other candidates, former House Speaker Newt Gingrich and ex-Gov. Jon Huntsman, refused to participate in the Straw Poll, the Iowa Republican Party officials still added their names to the official ballot. Gov. Perry and former V-P nominee Sarah Palin, neither of whom were candidates at the time of the state party ballot deadline vote, were not placed on the ballot.

Though Perry’s name was not on the Straw Poll ballot, an independent expenditure group supporting his running for President, called Americans for Rick Perry (AFRP), did organize for purposes of convincing Perry supporters to attend the event and write-in the governor’s name. Because AFRP is not officially tied to the candidate, obtaining tent space on the event grounds was not allowed. With no ability to work inside the gates and not even having a candidate, AFRP still was able to deliver 718 write-in votes. This total was better than what was recorded by three campaigns whose candidate actually participated in the Thursday debate and were on the official ballot: Romney, Gingrich (385 votes), and Huntsman (69).

Certainly Saturday’s biggest winner was Michele Bachmann. The biggest loser was Tim Pawlenty. But the underlying story is Perry and Romney. Gov. Perry, via a write-in campaign organized solely from the outside by an unconnected group in just three weeks, scored a respectable number of votes by all accounts. Romney, by finishing under Perry, creates a greater image of vulnerability and poses questions about his strategic decision to skip the Iowa Straw Poll. He has made past comments that he would also bypass the significant straw poll events in Florida and Michigan. It will be interesting to see if the Iowa results prompt a change of plans from the Romney camp.

The Perry Announcement Strategy

Reportedly Texas Gov. Rick Perry will publicly say he’s running for President by the end of this week. The governor will speak at the Red State.com Gathering event in Charleston, SC this Saturday afternoon and is expected to reveal his future plans without formally announcing his candidacy. The choice of date and place for his “pre-announcement” accomplishes two key strategic objectives.

First, South Carolina will likely become a make-or-break state for the Perry presidential campaign. Considering that Iowa voters typically choose someone from the Midwest, it’s Rep. Michele Bachmann (R-MN-6) who is the current favorite to win the first-in-the nation caucus event. New Hampshire should belong to neighboring former Massachusetts Gov. Mitt Romney, just as it did in 2008. The Nevada Caucuses, now scheduled for Feb. 18, also should line up strongly for Mr. Romney, since he scored big there during the last nomination contest. Therefore, for Perry to capitalize in the south and become a legitimate first-tier candidate, South Carolina becomes the first state where victory for the Texas governor will be expected.

Second, though not participating in the Iowa Straw Poll event (because he is not yet an official candidate), also occurring Saturday, Gov. Perry’s Charleston statement will go a long way to upstage the event’s winner, presumably Ms. Bachmann. Setting the tone in South Carolina while simultaneously upstaging an opponent in Iowa puts Gov. Perry four-square on the national political board.

Not a bad opening salvo for this newcomer from the Lone Star State.

The House Open Seats

As we approach the midway point in the national redistricting process, it is a good time to check the status of the House open seats. Because reapportionment creates a dozen new seats, the incumbent-less district count is already 29. An average election cycle features about 35 open seats, although the last two elections have broken the 40 mark. Should the proposed maps in California and North Carolina pass, at least three more vacancies will be added to the 2012 total. And if Utah Reps. Jim Matheson (D-UT-2) and Jason Chaffetz (R-UT-3) along with Wisconsin Rep. Tammy Baldwin (D-WI-2) run statewide, as they are considering, then three more would be added.

Of the 29 open districts, 12 are new seats, nine current incumbents are running for Senate, two are running for governor, another pair are retiring from politics, one is seeking the U.S. Presidency, and one more is running for mayor of San Diego. Two members resigned their seats; one because of being appointed to the Senate; one due to scandal. Nine of the vacating incumbents are Democrats, six are Republicans. The two vacant seats split evenly, one from each party.

Most of the current seats will stay within the designated party control, but at least six (IN-2, Donnelly; MT-AL, Rehberg; NV-2, Vacant – special election Sept. 13; NM-1, Heinrich; OK-2, Boren; and TX-14, Paul) will likely join the competitive ranks.

With already a large number of open seats in the 2012 election cycle, it would not be surprising to see the total number approach 50 before filing closes in each of the states. Should this happen, added to the 97 members currently serving their first term, a full one-third of the House will have two terms of seniority or less in the next Congress.

South Carolina’s DeMint Considers Presidential Run

South Carolina Sen. Jim DeMint confirms reports that he is now considering entering the GOP presidential contest. Previously, he said he would not become a candidate. Like former VP nominee Sarah Palin who is sending outward signs that she might jump into the fray and Texas Gov. Rick Perry also confirming new interest in a presidential campaign, DeMint sees opportunity for a newcomer who could carry the Southern states. The south is the heart of the Republican voter base. Since former Arkansas Gov. Mike Huckabee, Mississippi Gov. Haley Barbour, and Indiana Gov. Mitch Daniels have all said they won’t run for President, the south is left without an obvious candidate to support.

Sen. DeMint actually has two bases of support, both of which are formidable. As a Tea Party spokesman within the halls of Congress, the Palmetto State solon would command sizable backing from the grassroots within the Republican Party base, which is significant in primary elections. Secondly, his own state of South Carolina is one of the key early nomination battlegrounds, following the Iowa caucuses and the New Hampshire primary. Since no non-incumbent Republican presidential candidate has ever carried both Iowa and New Hampshire, South Carolina plays a major role in defining the pre-Super Tuesday momentum. Though DeMint is likely to be a second-tier candidate if he enters the race, his inherent bases of support could generate more for him than originally meets the eye.
